BE IT ENACTED BY THE LEGISLATURE OF THE STAT OF MINNESOTA: Section 1. Minnesota Statutes 1976, Section 3.088, Subdivisions 1 and 2, are amended to read: 3.088 �EAVE OF ABSENCEJ Subdivision 1. �EAVE OF ABSENCE WITHOUT PAY] Subject to the conditions �ierein prescribed, any officer or employee of any political subdivision, municipal corporation, or school district o.f the state or institution of learning maintained by the s ate who engages , in service as a state legislator during a session or is elected to an city or count3r office within the sta e shall be entitled to leave of absence from his public office r employment without pay during any part or all of the service, ith right of reinstatement as hereinafter provided. Subd. 2. �EINSTATEMENTJ Except as therwise hereinafter provided, upon the completion of the last 1 gislative day in each calendar year or in the case of the c ' ty or county elected official u on the com letion of tYie final ay of elected office trie officer or employee shall be reinstated ,in the public position which he held at the time of entry into the legislature or elected off'ice, or a public position of lik seniority, status, a�id pay if it is available at the same sala 3T �ahich he would hacre received i.f. he hacl not talien the leave, upon the fo].lowin�, 1 I , � ' . . � , , ��3�77 � ity Bill No. . • �� ��� conditions: (1) that the position has not b en abolished or tha�. the term thereof, if limited, has not expire ; (2) that he makes written application. for reinstatement to the appointing authority within 30 days after the last legislative dar in a calendar year or 3J days after an expired elective term. pon reinstatement the officer or employee shall have the same ights with respect to accrued and future seziiority status, effi ieiicy rating, vacation, insurance benefits, sick leave, an�. other bene_fits as if he had been actually employed during t e time of the leave. Provided, however, that no public employer s all be required to ' compensate a reinstated employee or officer or any time spent by that employee or officer away from his or her work for the • employer and on the business of the state le islature at any time during the period between the first and last legislative day in each calendar year nor for time s �en awav from work for the em loSTer and on the business of such elective office. No officer or employee reinstated shall be removed or discha.rged within one year thereafter except for cause, after notice and hearing; but this shall not operate to extend a term of service limited by law. 0 �
