RESOLVED, That the Council of the City of Saint Paul hereby
authorizes the proper City officials to execute a th�^+ge:-year lease
agreement with Recycling Unlimited, Inc. , a non-profit oorporation,
for the latter ' s occupancy and use of that portion of the City' s
land situated at the Northwest corner of DeCourcy Drive and Hamline
Avenue for the purpose of recycling residential waste materials;
said agreement providing for an annual rental of $125.00, a copy of
which is to be kept on file in the Department of Finance and Manage-
ment Services.

AN AGREEMENT, Dated this day of , 1977,
by and between the CITY OF SAINT PAUL, riinnesota, hereinafter re-
ferred to as "City, " and RECYCLING UNLIMITED, INC. , a Minnesota
nonnrofit organization, hereinafter referred to as -"P,ecycling; "
. WITNESSETH:
IT IS MU'I'[TALLY AGREED BY AND BETWEEN THE CITY AND RECYCLING AS
• FOLLOWS: �
l. That the City hereby leases to Recycling, subject to the
terms and conditions as set forth herein, that property located at
the Northwest corner of DeCourcy Drive and Hamline Avenue in the
City of Saint Paul and as outlined in red on the attached map noted
as Exhibit I and made a part of this Agreement.
2. That Recycling is hereby permitted to use said land for the
purpose of recycling residential waste materials and shall accept �
residential waste materials excluding only that material as mutually
agreed on by the. parties. �
3. That any improvements, such as grading, design, construction,
and fencing, shall be in conformance with applicable law and subject
to the approval of the City.
4. That Recycling agrees to keep the premises at all times in
a clean and orderly manner and shall conduct its business at such

hours and charge such rates or fees for disposal su�ject to approval
of the City.
5. That the City shall have the right to inspect the accounts
and business records of Recycling during regular business hours.
6. 'lYhat any construction, fencing, or other fixtures ref-
erenced in Paragraph 3 s�iall be the property of the City upon ter- ,
� mination of this lease. ',
7. _ .That Recycling agrees to pay to the City a yearly rental
of One Hundred Twenty-five Dollars (�125.00) each anniversary date
of this Agreement. �
8. That this lease shall be for a period of three (3) years; �
however, either party may terminate this Agreement upon ninety (90)
days' written notice, and such termination may be without a stated
� cause.
9. That Recycling will save and hold the City harmless from .
any and all claims of whatever kind or nature arising out of its us.e
hereunder, and in order to give this indemnification full force and •
� effect, Recycling agrees to provide the City with a public liability
insurance policy in the amount of Three Hundred Thousand Dollars
($300,000.00) per individual for injury or death and Five Hundred
Thousand Dollars ($500, 000.00) in the aggregate. Additionally, such �
� insurance shall provide for Fifty Thousand Dollars ($50,000.00) in
property damage. Any employees of Recycling shall also be insured

under the Workers ' Compensation Act of the State of Minnesota, and
such insurance shall be furnished to the City in addition to the
foregoing.
10. That all approvals of the City required hereunder shall be
submitted by the City' s Director of the Department of Community
Services.
IN WITNESS� WHEREOF, The parties have set their hands the date

Finance and Management Services.
