An administrative ordinance approving the terms and
conditions of tlie 1976 Memorandum of Agreement between the
City of Saint Paul, Independent School District No. 625, and
the Plumbers' Local No. 34.
WHEREAS, tlie Council, pursuant to the provisions of Section 12. 09
of the Saint Paul City Charter and the Public Employment Labor Relations
Act of 1971, as amended, recognizes that for the purpose of ineeting and
negotiating the terms and conditions of employment, the Plumbers' Local
No. 34 is the exclusive representative for employees falling witliin the
units as certified by the Bureau of Mediation Services under Case Number
73-PR-527-A; and
WHEREAS, the City, through designated representatives, and exclusive
representatives, have met in good faith, negotiated conditions and terms of
employment for the year through Apri.l 30, 1977, for such personnel as are
set forth in the Agreement between flie City, Independent School District
No. 625, and the Plumbers' Local No. 34; r�c5w, therefore,
THE COUNCIL OF THE CITY OF 5AINT PAUL DOES ORDAIN:
Section 1. That the Agreement created as of the effective date of this
ordinance, between the City of Saint Paul, Independent School District No. 625,
and the Plumbers' Local No. 34, on file in the office of the City Clerk, is
hereby approved, and the authorized administrative officials of th.e City are
hereby auth.orized and directed to execute said Agreement on behalf of the City.
Section 2. That the wage schedules indicated in the Agreement with the
Plumbers' Local No. 34 shall take force and effect retroactively to the dates
set forth in the contract, and in accordance with the expressed intent and the
agreement of this Counci.l contained in Council File Number 266410.

5ection 3. That tlze early retiree benefits provided in 12. 26 and
12. 27 shall not become effective until the first day of the first month
following the effective date of this ordinance.
Section 4. That any other ordinance, rule or regulation, in force
when said Agreement takes effect, inconsistent with any provisions of the
terms or conditions of said Agreement, is hereby repealed.
5ection 5. This ordinance shall take effect and be in force thirty
days after its passage, approval, and publication.

This Memoraadum of Agree�ent by and between the City of Saint Paul. aad the
Iinited Association, Flumbers and Gas Fitters, Local 34.
� In full settlement of 1976 negotiations, the parties hereto have agreed as
�
� follows:
; �
1. Except as herein modified, the Agreement between the parties,
entered into December 31, 2975, shall be the basis of the
forthco�iag Labor Agreement.
2. Article 12.2 shall be amended by striking out subparagraph
12.25 which reads as follows:
12.25 Severaace benefits as established by Ordinance
No. 11490.
� and substitutiug in lieu thereof the following subparagraph:
= 12.25 Severance benefits as established by Ordinance
No. 11490 with a maximum payment of $4,000.

3. Article 12.2 shall be further amended by adding the following
subparagraph i�ediately after subparagraph 12.25.
12.26 The EMPLOYER will for the period of this AGREEI�NT
; provide for EMPIAYEES working under the title of
Water Meter Serviceman who retire after the time
of execution of this AGREII�IENT or who have retired
since September 1, 1974,and until such EMPLOYEES
reach sixty-five (65) years of age such health
insurance benefits as axe provided by the EMPLOYER.
12.27 In order to be eligible fo�--��te benefits under the -
provision of 12.26 the II�LOYEE must:
1. Be receiving benefits from a public employee
retiree act at the time of retirem�t.
2. Have severed his relationship with the City
of Saint Paul under one of the early retiree
plans.

4. Article 12 shall also be amended by adding the follo�ng paragraph
im�ediately after Article I2.5.
12.6 The provision of Article 12.5 shall not apply to
EMPIAYEES working under the title of Water Meter
Service.�nan.
5. Appendix C and D of said AGREII�NT shall be replaced with Appendix
C and D which are attached hereto and made a part hereof.
6. It is also agreed that the duration of the 1976 AGREEMENT shall be
through April 30, 1977, and that said termination date shall be
set forth in Article 32.1 of the new Collective Bargaining Agreement.
It is understood that the above settlement shall be recomm�ended by the City Negotiator,
but is subject to approval by the City Administration and adoption by the Civil
Service Co�ission and the City Council.
IN WITNESS WHEREOF, the parties hereto have affixed their signatures this 9th day
of February, 1977.

APPENDIX D ������
� Effective September 1, 1976, the EMPLOYEB shall:
(1) contribute $1.52 per hour from whieh payroll deductions have
been made for all hours worked by participating employees as
defined in Articles 12.3, 12.4 and 12.5 of this AGREEi�NT,
to a UNION designated Credit Union.
' (2) contribute $ .48 per hour for all hours worked by partici-
pating employees as defined in Articles 12.3, 12.4 and
12.5 of this AGREEMENT, to a Aealth and Welfare Fund.
(3) contribute $ .50 per hour for all hours worked by partici-
pating employees as defined in Articles 12.3, 12.4 and
12.5 of this AGREEMENT to the Pension Fund.
(4) contribute $ .06 per hour for all hours worked by partici-
pating employees as defined in Articles 12.3, 12.4 and
12.5 of this AGREEMENT, to the Journeyman and Apprenticeship
Trainin� Fund.
All contributions made in accordance with this Appendix shall be
forwarded to the Twin Citv Pipe Traders Service Association.
The EMPLOYER shall establish Workman's Compensation and Unemployment
Campensation programs as required by Minn.esota Statutes.
The EMPIAYER'S fringe benefit obligation to participating employees
as defined in Articles 12.3, 12.4 and 12.5 is limited to the contributions
and/or deductions established by this AGREII�NT. The actual level of benefits
provided to employees shall be the responsibility of the Trustees of the
various funds to which the II�IPLOYER has forwarded contributions and/or
deductions.

PURY�OSE AND RATIONALE FOR THIS.ACTIONo
This ordi.nance approves a Memorandum of Agreement for �he period
May 1, 1976, through April 30, 1977, between the City qf Saint Paul,
Independent School District No. 625, and the Plurnbers' Local No. 34.
This Agreement includes a provision which increases the maximum
Severance Pay from $3, 000 to $4, 000 as well as a provision which provides
Health Insura.nce coverage for Water Meter Servicemen who are early
retirees. The Agreement also i.ncludes a wage rate adjustment based on
the outside Union rates.
