THE COIINCIL QF THE CITY OF SAINT PAIIL DOES ORDAINs Section l. Sect�:on �.52.09 of the Saint Paul Legislative Code is hereby amended to re�ad as follows: 152�.09. Vehicles--Requirements. No public vehicle � shal`i be! licensed until it has been thoroughly and care— , fully exlamined and found to comply with the following: (1) Every vehicle licensed initial.ly as a tax�t.�ab sY�all be a new ve�iicle. Said ��cl� sha�.l be replaced by new vehicle within � sia�,�; years of the date said vehicle is first Ii- cen�sed as a taxicab. A "new vehicle" for the purpose of this subsection is defined as a vehi-�- cl� in a new and unused condition. ; (2) To be in a thoroughly safe condition for the transportation of passengers. �(3)� To be clean and of good appearance and well painted and varnished. (5) Every taxicab, except those operated solely upon the hour basis, shall be equipped with a taxi- meter in good working order, having a light, and sealed, and so placed as to enable the passenger at all times to see the fare registered when op-- erating on the meter basis. No taxicab shall be operated except upon the meter or hour basis. (6) There shall be conspicuously displayed in the compartment of the taxicab occupied by the pas- senger a printed card or sign showing the rate of fare charged, as hereinafter provided. Section 2. Section 152.10 of the Saint Paul Legislative Code is hereby amended to read as followss 152.10. License---Issuance. Upon satisfactory ful- fillment of the foregoing requirements, it shall be the duty of the License Inspector upon proof that said re- quirements have been met, to issue each public vehicle license, which shall be in such form as to contain the signature of the owner, class and passenger carrying capacity of the vehicle, the make of the car, the engir�e . number, serial number, and the 5tate license number. Every public vehicle license shall be signed by the Li- cense Inspector. The license shall haue upon it a number to be selected by said License Inspector, by whieh said license shall be designated and known. Any licensee ;��������� 3. ' who defaces, removes, or obliterates any official entry made upon his license shall in addition to any other punishment imposed by this ordinance, have his • license revoked by the City Council. The License In- spector shall keep a register of the name of each person owning or operating a �ehicle licensed under this ordinance, together with the license number and the � description, make, and necessary dimensions of such ve- hicle with the date and complete record of inspection made of it. Such records shall be open to the inspection of the public at all reasonable times. I In anv case where� the License Inspector determines, on the basis of an inspection of a taxicab, t'hat use of the taxicab for public patronage constitutes a serious threat to the public health or safetv, the License Inspec-- tor may suspend the lieense issued to that vehicle and . seize th� license plates of that vehicle. Such suspension ; of licen�e vsill last until the threat to health or safety . is correeted to the satisfaction of the License Inspector. Immediately after such suspension the License Inspector . wil7. send or deliver notice to the licensee specifying in detail the causes for the suspension and statinq that the licensee has a riqht to a hearinq on the suspension. The hearing shall be held at the x�ext meetinq �of the License Committee of the City Council after the receipt . of a written rectuest for hearinq unless a later hearinq is reQUes�ed bv the licensee. I found I that the present law provides for periodic inspections. Therefore, I only changed that section to make the License Inspector respon- I sible since the Licens� Inspector is no longer under the Chief of I Police. It would be possible, if the Committee,desires, to pro- vide inspections "every si.x months" or some other specific time period, rather than "from time to time" or "as necessary. " I will change this if you wish. � The Committe� also asked me to change the fine from $50 to $100. I However, this fine is not set by ordinance but by the fine sched- ule set by the municipal judges. Under the law, the judges can fine a violator up to $300 since violation of any ordinance is a misdemeanor, pursuant to Section 500.05 of the Saint Paul Legis- lative Code. If you wish to change the fine schedule, you will have to request such change from the judges. The ordinance also allows the License Inspector to seize plates prior to a hearing if there is a serious problem involving the health or safety of the public.
