Saint Paul Legislative Code.
THE COUNCIL OF THE CITY OF SAINT PAUL DOES ORDAIN:
Section l.
That the Zoning Map of Saint Paul, Sheet No. 12, as incorpor-
ated by reference in Section 60.401 of the Saint Paul Legislative
Code, is hereby amended as follawss
The property on the Northeast corner of Farrington
and Atwater Streets, more particularly described as
follows:
Lots 7 and 8, Block 4, Alabama Addition No. 21
is rezoned from RT-1 to I-1,
Section 2.
That this ordinance shall take force and effect in thirty (30)
days from and after its passage, approval and publication.

Dear Madam:
This letter is written in response to the petition of Custom Drywall , Inc.
to rezone property located on the northeast corner of Farrington and Atwater
from RT-1 (two-family residential) to I-1 (light industry).
This matter was heard before the Current Planning and Zoning Comnittee on
Decembq^.� la 1977, at which time staff recommended that the petitioner's request
be � Mr. Humner moved to deny the request to rezone I-1 . Ms. Karns
seconded his motion and it was denied on a 6 to 0 roll call vote. F�

On December 2, 1977 the Planning Comnission unanimously confirmed the �
recomrnendation of the Current Planning and Zoning Comnittee.
This matter is scheduled to be heard before the St. Pau1 City Council on
December 29, 1977.

PRESENT: Mmes. Grittner, Karns, McGinley and Summers, and Messrs. Numner,
Pangal and Bryan of the Current Planning & Zoning Conmittee; Mr. Robert
Straughn, Assistant City Attorney; Mr. Richard Amey of the Division of
Housing & Building Code Enforcement; Mnes. McNeally and Fox and Mr. Edward
J. Warn of the Planning Staff.
The meeting was chaired by James Bryan. Chairman.
CUSTOM DRYWALL, INC. (#8251 ): A petition to rezone from RT-1 to I-1 property
ocate on t e northeast corner of Farrington and Atwater.
The petitioner was present. There was no one in opposition present at the meeting.
Mr. Warn read the staff report and showed slides of the subject site.
Albert Carlson, 837 Cheri Lane, Mendota Heights, Minn. said he had just discovered
that the property was zoned residential , that he has been there five years, and
his request is merely to rezone the property back the way it was before the city
was rezoned.
Mr. Hummer asked the petitioner what plans he had for the site, and Mr. Carlson
said he had no plans for the site, that it is a warehouse where they store
materials.

Mr. Hurr�ner remarked that one reason the City had zoned some properties into non- ��
conformance was to have some control , so he was wondering about the plans, and
Mr. Carlson repeated that he had no plans.
Mr. Warn then read into the record a letter he had received via special delivery
from Mr. & Mrs. Roger Germain of 303 Atwater Street, opposing the rezoning.
Mr. Carlson commented on the letter's contents, saying that photos had shown the
entire block, Atwater from Rice to Dale & Como, is indus;rial , and that the north
side of Atwater from Farrington to Rice is zoned residential , but the other
side of Farrington on the north is zoned light industrial . He said the only
portion zoned residential is the north part of Atwater and the part where he is.
He took exception with the letter, saying there had been no fire. As a matter of
fact, he added, at one time when children of the Germains had broken into his
office, he had taken them back to their home. He said he does plan to keep the
property in good condition.
Ms. Grittner asked whether M1^. Carlson could stay as he is, and Mr. Warn said that
he could, but if fire destroyed 60% of the property, it could not be rebuilt under
the present zoning, and that if the property were ever put up for sale, it would
be selling a building not properly zoned wPiich could cause some difficulty.
Mr. Hummer said if the property is made conforming, the City loses control , and the
zoning code's purpose is to elevate the nonconforming use and eventually get rid
of the situation. He then moved to recormnend denial of the rezoning request. His
motion was seconded by Ms. Karns and passed on a 6 to 0 roll call vote.

Mr. Pangal questioned the criteria that the staff uses to make this type of
recomnendation. and said there have been other instances where it would have
been more reasonable to recomnend approval of a rezoning than in this case.
Mr.Bryan ansWered Mr Pangal by saying the staff can make any reconmendation
they want, and the carmittee may overturn it if they choose.

A. SUFFICIENCY: The applicant's request was filed on a long form rezoning petition,
subscribed & sworn to before a notary public on 9-22-77, found sufficient by the
Dept. of Finance & Management Services on 10-27-77, and received by the Planning
Division on 11-7-77.
B. PROPOSAL: The proposal is to rezone from RT-1 to I-1 .
C. FRONTAGE & AREA: The site has 77 ft. frontage on Atwater and 124.27 ft. frontage
on Farrington, for a total area of approximately 9,550 sq. ft. , or 0.2 acres.
D. SITE CONDITIONS: A large steel warehouse structure currently occupies most of the
site. Single family residences abut the site on the east, across the alley to the
north and across Farrington to the west. Another industrial site facility is
across Atwater to the south.
E. AREA CONDITIONS: The area is a mixture of single family homes, apartments, commercial
an in ustria uses.
F. FINDINGS:
1 ) The rezoning involves extending the existing T-1 zoning district to include an
existing use more appropriate to I-1 rather than RT-1 .
2) The existing use or most permissible uses in an I-1 zoning district on this
. site would not be detrimental to the mixed use neighborhood.
G. STAFF RECOMMENDATION: Based on the above findings, staff recommends that the
app icant s request e granted.

Dear Madam:
This letter is written in response to the petition of Custom Drywall , Inc.
to rezone property located on the northeast corner of Farrington and Atwater
from RT-1 (two-family residential ) to I-1 (light industry).
This matter was heard before the Current Planning and Zoning Comnittee on
December 1 1977, at wleich time staff recommended that the petitioner's request
be r � . Mr. Humner moved to deny the request to rezone I-1 . Ms. Karns
seconded his motion and it was denied on a 6 to 0 roll call vote.
On December 2, 1977 the Planning Convnission unanimously confirmed the
recommendation of the Current Planning and Zoning Committee.
This matter is scheduled to be heard before the St. Paul City Council on
December 29, 1977.

The petitioner was present. There was no one in opposition present at the meeting. '
� Mr. Warn read the staff report and showed slides of the subject site.
Albert Carlson, 837 Cheri Lane, Mendota Hei hts, j i
g Minn. said he had ust discovered
that the property was zoned residential , that he has been there five years, and j
his request is merely to rezone the property back the way it was before the city �
was rezoned.
Mr. Humner asked the petitioner what plans he had for the site, and Mr. Carlson �
said he had no plans for the site, that it is a warehouse where they store ;
materials.
Mr. Humner remarked that one reason the City had zoned some properties into non-
conformance was to have some control , so he was wondering about the plans, and
Mr. Carlson repeated that he had no plans.
Mr. Warn then read into the record a letter he had received via special delivery
from Mr. & Mrs. Roger Germain of 303 Atwater Street, opposing the rezoning.
Mr. Carlson comment?d on the letter's �ontents, saying that photos had shown the ,
entire block, Atwater from Rice to Dale & Como, is industrial , and that the north
side of Atwater from Farrington to Rice is zoned residential , but the other
side of Farrington on the north is zoned light industrial . He said the only
portion zoned residential is the north part of Atwater and the part where he is.
He took exception with the letter, saying there had been no fire. As a matter of
fact, he added, at one time when children of the Germains had broken into his
office, he had taken them back to their home. He said he does plan to keep the
property in good condition. �

Ms. Grittner asked whether Mr. Carlson cou]d stay as he is, and Mr. Warn said that
he could, but if fire destroyed 60� of the property, it could not be rebuilt under ;
the present zoning, and that if the property were ever put up for sale, it would i
be selling a building not properly zoned wiiich could cause some difficulty. �
Mr. Hummer said if the property is made conforming, the City loses control , and the �
zoning code's purpose is to elevate the nonconforming use and eventually get rid !
of the situation. He then moved to recorronend denial of the rezoning request. His �
motion was seconded by Ms. Karns and passed on a 6 to 0 roll call vote. ;

Mr. Pangal questioned the criteria that the staff uses to make this type of �;
recommendation. and said there have been other instances where it would have '
been more reasonable to recomnend approval of a rezoning than in this case. !

they want, and the committee may overturn it if they choose.

A. SUFFICIENCY: The applicant's request was filed on a long form rezoning petition,
subscribed & sworn to before a notary public on 9-22-77, found sufficient by the
Dept. of Finance & Management Services on 10-27-77, and received by the Planning
Division on 11-7-77.
B. PROPOSAL: The proposal is to rezone from RT-1 to I-1 .
C. FRONTAGE & AREA: The site has 77 ft. frontage on Atwater and 124.27 ft. frontage
on Farrington, for a total area of approximately 9,550 sq. ft. , or 0.2 acres.
D. SITE CONDITIONS: A large steel warehouse structure currently occupies most of the
site. Single family residences abut the site on the east, across the alley to the
north and across Farrington to the west. Another industrial site facility is
across Atwater to the south.
E. AREA CONDITIONS: The area is a mixture of single family homes, apartments, commercial
an in ustrial uses.
F. FINDINGS:
1 ) The rezoning involves extending the existing T-1 zoning district to include an
existing use more appropriate to I-1 rather than RT-1 .
2) The existing use or most permissible uses in an I-1 zoning district on this
. site would not be detrimental to the mixed use neighborhood.
G. STAFF RECOMMENDATION: Based on the above findings, staff recomnends that the
app icant s request be granted. .
