An administrative Resolution a;pproving the terms and
conditions of a 1978-1979 Memiorandum of Understanding
applying to Unclassified Emplayees holding the title of
Assistant Fire Chief.
WHEREAS, the City, through its de ignated representatives,
has met and conferred in order to establis� the terms and conditions
of employment for the calendar years of 1�78-1979 for such personnel
as are set forth in the "Memorandum of Ur�derstanding"; now, therefore,
be it
RE50LVED, that the "Memorandum iof Understanding" cited above,
dated as of the effective date of this Resol�.tion, on file i.n the office of
the City Clerk, is hereby approved, and the authorized administrative
officials of the City are hereby authorized�and directed to execute said
"Memorandum of Understanding" on behal of the City.

MEMORANDUM OF UNDERSTANDING
This Memorandum of Understanding shall apply to the employees holding the title
of Assistant Fire Chief. `
1. Salaries applicable to the title of Assistant Fire Chief shall be +
increased by five and one-half (52) percent for 1978 and five and
one-half (5�) percent for 1979. The 1978 and 1979 salaries are
shown below:

2. Employees employed in the title of Assistant Fire Chief shall be covered
by the vacation schedule shown below:
Years of Service Vacation Days
Less than 8 years 15 days
After 8 yrs thru 15 yrs 20 days
After 15 yrs and thereafter 25 days
3. For employees employed in the aforementioned title of Assistant Fire
Chief the City agrees to contribute the cost of Hospitalization and
Medical Coverage or $36.85 per month, whichever amount is less, for
each employee who is eligible for such coverage. In addition, for
each eligible employee who selects Dependent's Coverage, the City will
contribute one-half (�) of the cost of such Dependent's Coverage or
$42.43 per month whichever amount is less. These contributians shall
be paid to the City's Group Health and Welfare Plan.
4. For employees employed in the aforementioned title of Assistant Fire
Chief the City agrees to contribute the cost for $5,000 of Life Insurance
Coverage for each employee who is eligible for such coverage or $3.05 per
month, whichever amount is less. This contribution shall be paid to the
City's Group Health and Welfare Plan. Any increase in this cost shall be
paid by the employee.
5. In addition to the $5,000 Life Insurance Coverage in 4 above, the City
agrees to contribute the cost of additional Life Insurance Coverage or $ .97
per thousand dollars of coverage per month, whichever amount is less. The
total amount of Life Insurance Coverage provided under this section and
Section 4, above, for each employee shall be equal to the employee's annual
salary to the nearest full thousand dollars. For the purpose of this section,
the employee's annual salary shall be based on the salary as of the beginr.ing
of a contract Period. This contribution shall be paid to the City's Grou�
Health and Welfare plan.

6. The employer will continue for the period of this AGREEMEI3T to provide
for employees such health and life insurance benefits as are provided
by employer at the time of the execution of this AGREEMENT.
The employer will €or the period o€ this AGREEMENT provide for employees
who retire after the time of execution of this AGREEMENT and until such
employees reach sixty-five (65) years of age such heaZth and life insurance
benefits as are provided by the employer. In order to be eligible for
the benefits under this early retiree provision, the employee must:
6.1 Be receiving benefits from a Public Employee Retirement
Act.
6.2 Have severed his relationship with the City of Saint Paul
under one of the early retiree plans.
7. In the event of the death of an active employee or an early retiree, the
dependent of such employee or retiree shall have the option within thirty
(30) days to continue or begin the current hospitalization and medical
benefits, including such improvement as may be made from time to time,
which said dependents previously had, or be eligible for at the premium
applicable to dependents of active employees. It is further understood
that coverage shall cease in the event of:
7.1 Subsequent remarriage of the surviving spouse of the deceased
employee or retiree.
7.2 The employment of the surviving spouse where hospitalization
and medical insurance coverage is obtained through a group
program by said employer. It is further understood, however,
that in said event, the surviving spouse shall have the right
to maintain City hospitalization and medical insurance coverage
for the first ninety (90) days of said employment.
8.1 Employees shall be bona fide residents of the following areas:
Ramsey County, Washington County, Anoka County, Dakota
County, that part of Hennepin County which lies east of
Highway 101 and that part of Chisago County lying south
of Highway 95.
8.2 Every employee appointed prior to June 16, 1977, holding a position covered
by this Memorandum of Und�erstanding who lives in the City of Saint Paul
must maintain residence in the City limits of the City of Saint Paul as
long as he is an employee of the City.
8.3 Every employee appointed prior to June 16, 1977, holding a position covered
by this Memorandum of Understanding, who lives outside of the City of Saint
Paul and who changes his residence must move into the City of Saint Paul at
the time of such change of residence.

8.4 Exemptions to the above resideney requirements may be granted upon
application by an emplcyee to the Civil Service Commission and the
Commission's finding, after the taking of testimony, that:
8.41 The employee is handicapped and cannot find a suitable
residence within the City.
8.42 The employee has actually entered into a contract to
purchase a home outside the City or has actually entered
into a contract for the construction of a residence prior
to the date that this Article becomes effective.
8.43 The employee inherits a residence outside of the City and
subsequently resides in that residence.
8.44 The employee will suffer extreme and severe financial
hardship if he or she is required to take residence in the
City.
8.45 The employee has lived outside of the City and is changing
residence, but has two or less years remaining until mandatory
retirement.
8.46 The employee, because of unforeseen or extenuating circumstances,
will sustain a severe hardship if required to become a resident
of the City.
8.5 Any employee failing to meet the residency requirements as herein stated
aad who fails to obtain an exemption from such requirements by approval
of the Civil Service Commission shall be deemed to be insubordinate and
guilty of misconduct resulting in automatic forfeiture of employment.
8.6 This Article does not apply to employees occupying a temporary summer
residence outside of the areas stated in Paragraph 8.1 above during
the period of rlay 15 through September 15 of any calendar year.
8.7 Items 8.2, 8.3 and 8.4 shall not take effect and be in force until
December 15, 1979.
