RESOLVED, That the Council of the City of Saint Paul does
hereby approve and authorize the execution on behalf of the City
of Saint Paul by the proper City officers of an agreement between
the City, the County of Ramsey and Harold P. and Genevieve P�i.
Freitag, the agreement providing that the City of 5aint Paul will
convey to Ramsey County for highway purposes and for the purpose
of conveying a portion thereof by Ramsey County to Harold P. and
Genevieve M. Freitag of a part of the East 5 acres of the West 25
acres of Lot 2 , Section l6, Township 29, Range 22, lying north of
East Shore Drive and Parkway, this property no longer being needed
by the City for municipal purposes and the property being needed
by Ramsey County for the purpose of constructing a public highway
thereon, and the proper City officers are further authorized and
directed to execute the Quit Claim Deed of Conveyance from the
City of Saint Paul to Ramsey County as provided in said agreement.

Dear Mr. Donovan:
I have reviewed the draft agreement transmitted by Thomas
Quayle to the City Council pertaining to the Frost Avenue
relocation. The agreement appears in proper legal form
and subject to the review and approval by the administration
and the City Council, the City may convey its interest to
the County based upon the terms of said agreement.
I have prepared a resolution whereby the City Council would
approve the agreement and conveyance to Ramsey County.
The resolution is predicated upon a finding by the City
Council that this property is not needed now or in the
future for City municipal purposes. I recommend that your
report to the City Council contain statements explaining
why this property is no longer needed for City municipal
purposes.

Sub�ect: New Frost Avenue Connectian between East Shore Drive
and Frost Avenue (North side of Lake Phalen).
Proposed three party agreement between City of St. Paul,
County of Ramsey, and Harold and Genevieve Freitag
At the center of this proposal is a four acre tract of land located in
the City of Maplewood but owned in fee by the City of St. Paul, and which
is located on the North shore of Lake Phalen. The City acquired title to
this tract of land by Warranty Deed dated pctober 14, 1908. The property
has never been used for a public purpose, and City agencies foresee no
need in the future fflr public purposes. In recent years, an a.d�oining
trailer court has �radually encroached ont� the tract and at present the
trailer court occupies most of the tract.
The County of Ramsey plans to construct a new connection road between
Frost Avenue and East Shore Drive on this tract and on portions of land
owned by the operator of the trailer court, Harold Freitag, but to do so,
needs jurisdiction of the City land involved. When the new road and other
incidental roadwork is completed, the County plans to close the existing
Keller Parkway from East Shore Drive to Highway �51.
The primary benefit to the City will result from the closing of the Keller
Parkway connection. The Department of Community Services recommends
execution of the agreement which will allow them to utilize land for park
development between Lake Phalen and Keller Lake which was previously used
for auto.mobile traffic.
In view of these circumstances, I recommend the City Council convey its
intexest to the County based upon the terms contained in the agreement.

At a meetir_g between officials of the City of Saint Paul, the
C�unty of Ramsey, aZd Mr. Freitag, a landowner, the ur!dersig�2d
participated in a discussion of the above-referenced situation.
Brie�ly, the proposal involves construction of a hignway con-
nection to Frost Avenue from Lake Phalen over a tract of land
ocvned by the City of Saint Paul. The land is in the City of
3�Ianlewood.
�x,�inion was generally expressed that the City o� Saint Paul had
nQ present need �or the land and that it was surplus to the Ci�y's .
requirements. The County ;�as ready, willing and able to construct
the necessary roadway but had no funds im�ediately available for
the acquisition of the rig'nt-of-way from the City ar from Mr.
rreitag, the private owner of certain necessary lands at the
iri�ersection proposed. Both the Ramsey County Highway Engineer
and the City highway Department seemed t� agree that it was
necessary in the public interest that the hig'nway be constructed
as planned over the lar_d of the City and Freit�g accordir_g to t.ne

AGREEMENT
THIS AGREEMENT, made and entered into by and between the County
of Ramsey, a political subdivision of the State of I�iinnesota; the
City of Saint Paul, a municipal corporation of the State of Minnesota;
and Harold P. and Genevieve M. Freitag, husband and wife, of the
County of Ramsey, State of Minnesota.
WI�NESSETH:
WHEREAS, the County of Ramsey, acting by and through its Board

of County Commissioners, has and hereby determines that the public
interest in highway travel and safety and convenience and necessity
therefor requires the establishment of a public highway upon, through
and over the following described tracts of land situated in the
County of Ramsey, State of Minnesota, to-wit:
That portion of the West l0 a�:�es of the East
15 acres of the West 25 acres of Lot 2, Section l6, �
Township 29, Range 22, described as follows :
Commencing at the center of said Section 16, thence
West along quarter section line a distance ot' 61g.17

point is on the South side of Frost Avenue as now
located, thence continuing on said line Southerly

WHEREAS, the County o� Ramsey has prepared plans and specifica-
tions relating to the construction, operation, maintenance, and
control of a public highway as aforesaid, and which plans are presently
an file in the office of the Ramsey County Highway Engineer, denominated
as 78-118; and
WHEREAS, the City of Saint Paul is the owner of the following
described tract of land situated in Ramsey County, Minnesota, to-wit:

Beginning at the intersection of the east line of
said Government Lot 2, at the south line of Frost
Avenue as now laid out and established; thence
westerly along the south line of said Frost Avenue
200 feet to the true point of beginning �f this

at right angles 506 feet more or less to the south
boundary of the Freitag property being the centerline
of a formerly travelled road, now abandoned; thence

WHEREAS, said land is a part of the land described above required
for said public highway as described above; and
WHEREAS, said Harold P. and Genevieve M. Freitag are ready, willing
and able to convey an easement for public highway purposes t� the County

of Ramsey over, upon and through the land described above f�r said
highway in consideration of the construction thereon of a public
highway and the transfer to them o� a certain part of the land being
hereby conveyed to the County of Ramsey for highway purposes by the
City of Saint Paul; and
WHEREAS, the County and the City both agree to close to automobi�
traffic the portion of existing Keller Parkway from East Shore Drive to �
Highvaay ,#6l. The closing of Keller Parkway is not to occur until the
New Frost Avenue Connection and reconstruction of the intersection at
T.H. ,#61 and Parkway Drive are completed and placed in operation.
NOW, THEREFORE, BE IT RESOLVED:
l. That the City of Saint Paul, acting through its Council, hereby
authorizes the conveyance of the following described land, to-wit:
That part of the east five (5) acres of the west
twenty-five (25) acres of Lot tw� (2), Section Sixteen
(16), Township Twenty-nine (29), Range Twenty-two (22),
aecording to the Government Survey thereof, lying North
�f East Shore Drive and Parkway as described in Document
No. 358161 recorded in Book 532 Deeds 377.
to the County of Ramsey for the purpose of constructing upon a part
of said land a public highway in accordance with the plans and specifica-
tions referred to herein and for the additional purpose of the conveyance
of a part of said land by Ramsey County to Harold P. and Genevieve M.
b�reitag as cons�deration for tY�e transfer to Ramse;� County for highway
purposes of certain lands owned by Harold P. and Genevieve M. Freitag.
The appropriate City officials are authorized to execute a deed in the
form attached hereto as Exhibit A f or the purpose of completing this
transaction, and to deliver said deed to the County of Ramsey upon
approval thereof by the City Attorney.
2. The County of Ramsey hereby authorizes and directs its
Chairman and Executive Secretary �f the County Board to execute and
deliver a deed to Harold P. and Genevieve N. Freitag in �he form as
attached hereto as Exhibit B, said deed to b� delivered upon approval
by the County Attorney.
3. Harold P. and Genevieve M. Freitag, husband and wife, parties
heret�, agree to execute and deliver to the County of Ramsey a deed
for public highway purposes in the f orm at�ached hereto as Exhibit C

and Exhibit D, delivery flf said deed to be made upon approval of
Frederick P. Nemmer, �heir attorney.

HIGHWAY EASETnENT
Harold P. Freitag and Genevieve NI. Freitag, husband and wife,
�rantors, of RaMSey County, AZinnesota, for and in consideration of
One Dollar ($1.00) and other good and valuable consideration, hereby
convey and warrant to the County of Ramsey, a political subdivision
of the State of Minnesota� grantee, for highway purposes, free and
clear of a1l encumbrances, the following described real estate in
the County of Ramsey, in the State of Ninnesota:
