F. 181541, approved February 19, 1957, subject to certain terms anc� conditions including the condition that a conventional shopping center be constructed on property owned by Tobin-Smith, Inc. ; and WHEREAS, The said terms and conditions concerning the con- struction of a conventional shopping center as imposed by the Saint Paul City Council were modified and clarified pursuant to Resolution C. F. 204241, approved October 6, 1961, and as further expressed in that certain rider, Amendatory of Covenant, dated October 9, 1961, by and between Tobin-Smith, Inc. and the City of Saint Paul and recorded in the office of the Ramsey County Register of Deeds as Document #1547998o and WHEREAS, The Council of the City of Saint Paul was reque�ted to extend the time within which the shopping center to be located on Lot l, Block 9 , East View Addition No. 5, except the north 300 feet thereof is to be constructed, from November 1, 1964 to November l, 1935, and the Council is willing to grant such request; now, therefore, be it RESOLVED, That the Council of the City of Saint Paul hereby extends to November l, 1985, the time in which the conventional shopping center covering a land area of at least 25,000 square feet, exclusive of automobile parking area, and including requisite buildings, facilities and appurtenances of the same to said Lot 1, Block 9 , East View Addition No. 5, except the north 300 feet of the same is to be constructed at the expense of Tobin-Smith, Inc. , its successors and assigns in accordance with plans and specifi- cations therefor prepared by registered professional architect and approved by the City Architect of the City not later than said date of November 1, 1985. Mulally, attorney representing Edward D�. Smith and Chester Dt. Tobin. He is recxuest- ing that the City Council adopt a resolution amending a previous resolution adopted February 19, 1957. The original resolution required that as a condition of the City Council vacating Clarence Street between Wilson Avenue and Conway Street that the petitioner construct a conventional shopping center on property owned by them. This resolution was later amended by the City Council so as to require that just a portion of the property be developed as a shopping center immediately and that the balance of the property also be developed as a shopping center no later than November 1, 1964. The owners of this property, Mr. Smith and PRr. Tobin, have requested that the City Council pass another resolution extending the time to construct the second shopping center to November 1, 1985. Apparently Mr. Smith and P�r. Tobin are selling their property and the purchasers require this type of a Council Resolution in order to be assured that the propert� that they are acc�uiring will be marketable and buildable. The enclosed resolution has been reviewed by Mr. Mulally and Mr. David Sellergren, attorney for the purchasers, and they both request that the City Council adopt this resolution. The resoluta.on is in proper legal form and the City Council may wish to consider granting the request of Mr. Mulally.
