01-48601 - �t�i'i'!. �21G`���- RESOLUTION CITY OF SAfNT PAUL, MINNESOTA Preaented By � Referred to Comanittee: Date 2 3 4 0 WiIEREAS, The City of Saint Pavl, Division of Parks & Recreation, provides a variety of special events for youth including track & field meets; and WHEREAS, Saint Paui Pazks & Recreation is in need of space for its growing uack & field program; and WHEREAS, Macalester College of Saint Paul own land at 1600 Grand Avenue which includes an athletic track; and ? WI�REAS, Macalester College is willing to give pernussion for Pazks & Recreation to 8 use their field space for the period from Aprii 1, 2001 to August 1, 2001, Monday througl� Friday 9 from 7:00 p.m. to 9:00 p.m., but wishes to have the City indemnify and hold the College harmless 10 from claims related to the City's use of the facilities; and 11 12 13 14 15 WF�REAS, provision of track & 8eld opportunities serve a legitimate public purpose by serving the youth of the City; and WHEREAS, the e�enditure of public funds, which includes the promise of indemnificafion and defense, for such a purpose will facilitate and allow the City to provide such opportunities, now therefore, be it 16 RESOLVED, that the City Council of the City of Saint Paul on behalf of the City of 5aint 17 Paul hereby agrees to defend, indemnify and hold Macalester College harrriless from any and all 18 damages it may be requited to pay as a result of suits, claims, actions, or judgments arising out of 19 the use of Macalester's athletic track at 1600 Crrand Avenue which are attributable to the 20 negligent act or omission by the City of Saint Paul, its employees, agents or contractors. Furthermore, nothing in the foregoing provisions shall he construed as a waiver of the municipal tort liability limits and defenses set forth in Minn. Stat. 466.01 et. seq.
