2 WHEREAS, the Council of the City of Saint on 11-1-00, adopted C.F. No. 00-1041 to
3 immediately impose prohibitions on the development of any parcel of land or part thereof within
4 the areas of the White Bear Avenue Study Area pending the formal adoption of a moratorium
5 ordinance pursuant to City Charter Sec. 6.05; and
6
7 WFIEREAS, the Council of the City of Saint Paul on November 22, 2000 duly adopted
8 the said interim ordinance which prohibited the issuance or approvai of zoning and building
9 permits, plat approvals or lot splits, until the expiration of twelve months as provided in Minn.
1Q Stat. § 462.355, Subd.(4), or until such earlier time as the Council of the City of Saint Paul had

taken action on the recommendations contained in the study; and
WHEREAS, the Council of the City of Saint Paul is advised that Semper Development,
Ltd., on behalf of Walgreens Drug Stores, desires to develop a neighborhood drug store at the
southeast corner of White Bear Avenue and Hudson Road on a parcei of land presently occupied
by a fast food resturaunt. Construction of a drug store will requires the approval of zoning and
building permits; and
WHEREAS, a neighborhood drug store is a desirable commerciai use which wili serve
the White Bear Avenue community. Such a use should be allowed where the use is consistent
with the present needs and future vision of the White Bear Avenue Comdor; NOW
THEREFORE, BE IT RESOLVED, that pending the amendment of C.F. 00-1043 under .-
separate ordinance, the provisions of C.F. 00-1043 shali not prevent Semper Development, Ltd.
from applying for or receiving any zoning or building permit necessary to undertake the
construction of a neighborhood drugstore; AND ,�

BE IT FINA.LLY RESOLVED, that in the event C.F. QQ-1043 is not amended to rovide
the means necessary to obtain the appropriate approvals and permits, that Semper Development °�- y Y �
Ltd. acknowledge that it proceeds with its affairs in this matter at its own risk.
