WHEREAS, The Council of the City of Saint Paul by its
Resolution C. F. 263315 adopted March 29, 1974, did vacate a
portion of Thomas Avenue, said vacation reserving to the City
of Saint Paul and other public instrumentalities public utility
easements contained therein and thereon; and -
WHEREAS, The Housing and Redevelopment Authority of the
City of Saint Paul has requested that the City Council waive the
said retained easements within vacated Thomas Avenue; and the
affected City departments, Northern States Power Company, and
Northwestern Bell Telephone Company have filed written certifi-
cates of intended non use of reserved rights and easements, which
certificates are filed in the office of the City Clerk; now,
therefore, be it •
RESOLVED, That the Council of the City of Saint Paul pursuant
to Section 228. 06 of the St." Paul Legislative Code does hereby
waive the retained easements within vacated Thomas Avenue described
below, contained in Resolution C. F. 263315, adopted March 29, 1974,
in the following described portion of vacated Thomas Avenue:
Thomas Avenue East of the following described line:
Beginning at the intersection of the East line of
Marion Street and the South line of Thomas Avenue;
thence 58. 5 feet Northerly along the East line of
Marion Street; thence bearing right along a circular
arc, tangent to the East line of Marion Street at the
last mentioned point, with a radius of 285 feet, said
curve terminating at the Southwesterly line of Como
Avenue; and that part of Thomas Avenue lying West of
a line drawn parallel with and 40 feet Southwesterly

mentality.
