An administrative Resolution approving the terms and
conditions of a 1977 Memorandum of Agreement between
the City of 5t. Paul, Independent School District No. 625,
and the United 51ate and Tile and Composition Roofers,
Damp and Waterproof Workers Association, Local 96.
WHEREAS, t,he Council, pursuant to t,he provisions of Section 12. 09
of the 5t. Paul City Charter and the Public Employees Labor Relations Act
of 1971, as amended, recognizes the United Slate and Tile and Composition
Roofers, Damp and Waterproof Workers Association, Local 96, as exclusive
representative for those classes of positions within the City of St. Paul cer-
tified by the Bureau of Mediation Services under Case No. 73-PR-511-A for
the purpose of ineeting and negotiating the terms and conditions of employment
for all full-time personnel in the classes of positions as set forth in the
Agreement between t,he City and the exclusive representatives hereinabove
referenced; and
WHEREAS, the City, through designated representatives, and the
exclusive repre sentative s have met in good faith and have negotiated the
terms and conditions of employment for the period May 1, 1977, through
Apri.l 30, 1978, for such personnel as are set forth in the Agreement between
the City of St. Paul, Independent School District No. 625, and the exclusive
representatives; and
WHEREAS, a 197? Agreement has been reached which includes a
wage adjustment retroactive to May 1, 1977; now, therefore, be it

RESOLVED, that the Memorandum of Agreement, cited above,
dated as of the effective d.ate of this . Resolution, between the City of St.
Paul, Independent School District No. 625, and the United Sl ate and Tile
and Composition Roofers, Damp and Waterproof Workers Association,
Local 96, on file in the office of the City Clerk, is hereby approved,
and the authorized administrative officials of the City are hereby authorized
and directed to execute said Agreement on behalf of the City.

1�77 MED;pRA1�IDU:�i OF AGREEMENT
This Memorandwn of Agreement by and between the City of Saint Paul, Independer.t
School District No. 625 and the United Slate and Tile and Composition Roofers,
Damp and Waterproof Workers Association, Local 96.
In flall �ettlement of 1977 negotiations, the parties hereto have agreed as follows;
(1) �ccept as herein modified, the Agreement between the parties,
entered into July 8, lgj6, shall be the basis of the forthcoming
I,ebor Agreement.
(2) Appendix C of said Agreement shall be replaced with Appendix C
which is attached hereto and made a part hereof.
(3) Appendix D of said Agreement shall be replaced with Appendix D
which is attached hereto and made a part hereof.
(4) The 1977 Agreement shsll become effective May 1, 1977.
(5) It is also agreed that the duration of the 1977 Agreement shall
be through April 30, lgj8, and that said termination date shall
be set forth in Section 30.1 of the new collective bargaining
agreement.
(6) Changes in Articles 9.1 and 23.6 and the addition of 16.6 as shown on
Attachment No. 3.
It is understood that the above settlement shall be recommended by the City
Negotiator, but is sub�ect to approval by the City Administration and adoption by
the City Council and the Civil Service Commission.

Effective I�y I, 1977, the EMPLOYER shall:
(1) contrib ute $ .69 pen c�ur for all hours worked by participating
employees as defined in Articles 12.3, 12.4 and 12.5 covered by
this AGREEMENT, to a UNION designated Welfare Fund.
(2) contribute $ .35 per hour for all hours worked by participating
employees as defined in Articles 12,3, 12.4 and 12.5 covered by
this AGREEMENT, to a Pension �.ind.
(3) contribute �1.00 per hour from which payroll deduction has been
made for aZl hours worked by participating employees as defined
in Articles 12.3, 12.4 and 12.5 covered by this AGREEMENT, to a
Vacation Ftand.
(4) contribute $ .03 per hour for all hours worked by participating
employees as defined in Articles 12.3, 12.4 and 12.5 covered by
this AGREEMENT, to a Apprenticeship Training �nd.
Al1 contributions msde in accordance with this Appendix shall be forwardeci to
depositories as directed by the UNION.
The E[�+IPIAYER shall estsblish Workman's Compensation and Unemployment Compensation
programs as required by Minnesota Statutes.
Participating employees as defined in Articles 12.3, 12.�+ and 12.5 covered by this
AG�NT, shall not be eligible for, governed by, or accumulate vacation, sick
leave, holiday, Puneral leave, jury duty, or insurance fringe benefits that are or
may be established by personnel Rules, Council Ordinance, or Council Resolutions.
The EMFLOYER`S fringe benefit obligation to participating employees as defined in
Articles 12,3, 12,4 and 12.5 is limited ta the contributions and�or deductions
established by this AGRF�MENT. The actual level of benefits provided to employees
shall be the responsibility of the Trustees of the various fluids to which the
EMPLOYER has forwarded contributions and�or deductions.

Delete Section 9. 1 and add ne��v Section 9. 1 as follows:
9. 1 Overtime. Time on the payroll in excess of the normal hours set forth �
above shall be "overtime work" and shall be done only by order of the
head of the department. An employee shall be recompensed for «v rk
done in excess of the normal hours by being granted compensatory
time on a time-and-one-half basis or by being paid on a time-and-one-
half basis for such overtime work. The basis on which such overtime
shall be paid shall be determined solely by the Employer.

16. 6 In the case of Board of Education employees, if Presidents' Day, Columbus
Day, or Veterans' Day fall on a day when school is in session, the em-
ployees shall work that day at straight time and another day shall be
designated as the holiday. This designated holiday shall be a day on
�Thich school is not in session and shall be determined by agreenlent
between the employee and his supervisor.
