PROPERTY APPELLANT 36=77-B 354 Fuller Ma,y Goldberg (9 units - vacant) SUBJECT: Request Waiver of fees payable under Vacant Building egl�'istration Ordinance of St. Paul Legislative Code, because of financial hardship. APPEARANCE: May Goldberg P1tOCEEDINGS: Mrs. Goldberg explained that she had sold the ui � ing on contract for deed sometime ago, and that buyer in turn had sold it on contract to a third person. In the summer of 1976 the payments stopped and the building was turned back to her, condemned by the city. In the past her husband had always looked after their property, but she was now a widow, unfamiliar with the details of property management. She said she had con- tacted various real estate agencies to list the building for sale, but there had been little interest. One agent had called and said he had a buyer who would pay $6,000 and she had agreed to that price, but the deal later fell thraugh. The building was boarded up,.and the city was now billing her $45 in quarterly fees. She felt she could not continue with the financial drain ownership of the pro rty was causing, but did r�.ot know what to do about it excep�to file an appeal for some relief, and to keep trying to sell the building. Frank Staffenson commented that extensive work was required to , bring the building up to code. Ch�irman Tieso asked if there was some way the fees could be waived un�il such time as the building should be sold. Steve Roy �aid the Board had two options, either the fees could be waived or the period of time before payments must begin could be extended. He said Mrs. Goldberg owed $45 for the three-month period of April l, 1977 through June 30, plus $5 per month delinquent fees, and the quarterly payment for July 1 through September 30 was now due, for a total amount due of $105. .. _ ` � �j1�1►3�� Mrs. Goldberg pointed out that the notice for the quarterly fees due for April through June had been sent to the address of another person of the same name, who had been gone from the city for several months and had found the letter on her return. There had been a long delay between the time the bill was sent out to the time Mrs. Goldberg actually had received it. Mr. Roy said if there had been a mistake on the city' s part, they would be willing to forget the late fees of $5 per month for that quarter. BOARD ACTION: Mr. Heider moved that a waiver of the fees due or t e period of April through September, 1977, be granted, to give Mrs. Goldberg more time to sell the property. If it is not sold during that time, payment of the quarterly fees should begin October l, 1977, and Mrs. Goldberg should appear at the October meeting to report what progress had been made. PROPERTY APPELLANT 32-77-B 173 Prescott (single family) William Slettom SUBJECT: Request Waiver of payment of fees required under Vacant ui ing Registration Ordinance, because building is in early stages of rehabilitation. Fees are a financial hardship. APPEARANCE: William Slettom PROCEEDINGS: Mr. Glassman asked Mr. Slettom if he had taken out a ui ing permit. Mr. Slettom said that he had not, as the type of work he was doing at present did not require one. He had been removing debris and generally cleaning up the place. He said he had purchased it in the fall of 1976 as a condemned building, ma.inly because it was just 12 ft. from his home. He related that it was under consideration by the Heritage Preserva- tion Commission as a building to be designated as having historical „ ,. . ��M.l�� / significance. He called HRA, thinking they might have an interest because they had advertised for vacant buildings for the pur- pose of placing them in a city lottery, to be homesteaded and rehabilitated by winners of sueh a lottery, but HRA had said it would be three or four months before there would be any action on this plan. He had had difficulty also in trying to obtain loan money, so he could not afford to do any work on the property that required a large outlay of money, and the payment of fees was just an extra burden. He had been summoned to court for non-payment of the fees and was to appear in August, but he understood that the judge' s decision would be based to some extent on the outcome of the hearing before the Board of Appeals. Mr. Heider said the Board had a policy of waiving the fees where work was under way and where a building permit ha.d been taken out. He suggested that Mr. Slettom take out a permit and proceed to do as much as he could in the way of repairs relating to the permit issued. Mr. Roy asked to clarify a statement made at the June meeting by Dan Person, a senior building inspector. Mr. Person had said that an owner had three months after the issuance of a building permit to complete the work, whereas he should have said that an owner has three months to be in work under the permit. Even if just one nail was driven i� first three months, he would then have a year' s time to drive another nail--it would be possible to stretch out the validity of the building permit for ten years or more. However, his department had ma.de the decision to refrain from b�:lling vacant building fees where a building permit was taken out, trusting in the good faith of the owner to ma.ke an honest effort to rehabilitate. BOARD ACTION: Mr. Heider moved that payment of fees due as of u y , , be waived, and that fees due for the six-month period frpm July l, 1977, through December 31, 1977, be waived, on condition that the appellant obtain a building permit prior to the August 9, 1977, meeting. Mr. Glassman seconded. MOTION CARRIED AND 80 ORDERED. THE VOTE: Ayes - 5 Nayes - 0 Abstentions - 0 Mr. Heider suggested that the city should inspect at the end of the next six-month period to evaluate progress.
