Zoning Ordinance, Chapters 60 through 64
of the Saint Paul Legislative Code.
THE COUNCIL OF THE CITY OF SAINT PAUL DOES ORDAIN:
Section l.
That the Zoning Map of Saint Paul, Sheet No. 13, as incor-
porated by reference in Section 60.401 of the Saint Paul Legisla-
tive Code, is hereby amended as follows:
The property on the Northeast corner of Case and
Agate Street, more particularly described as follows:
"Soo Line Plat Number 5, Lot C and vacated alley
adjacent thereto, " ' ,
is rezoned from RT-1 to I-l.
Section 2.
That this ordinance shall take force and effect in thirty (30)
days from and after its passage, approval and publication.

Dear Madam: alley adjacent and Lot C
This letter is written in response to the petition of St. Paul Structural Steel
Co. to rezone property located on the northeast corner of Case Avenue and Agate
Street from RT-1 (two-family residential ) to I-1 (light industry).
This matter was heard before the Current Planning & Zoning Comnittee on October
6, 1977 at which time staff recommended that the petitioner's request be granted.
Mr. Humner moved to recommend approval of the request to rezone to I-1 . Ms.
Grittner seconded his motion and it passed on a 6 to 0 roll call vote.
On October 28, 1977 the Planning Commission unanimously confirmed the recommendation
of the Current Planning & Zoning Committee.
This matter is scheduled to be heard before the St. Paul City Council on December
1 , 1977.

The meeting was chaired by Mr. James Bryan.
ST. PAUL STRUCTURAL STEEL C0. (#82101• A petition to rezone property on the northeast
corner of Case an Agate.
The petitioner was present. There was no opposition.
Mr. Warn read the staff report and showed slides of the sub�ect site.
Mr. �essie Rodrigues, 983 Agate Street, wanted to make a statement about the petition in
general , saying traffic gets heavy around the subject site at noon and at quitting time.
He said a stop sign would be nice because sometimes it is difficult to even get around the
corner because of parking in the middle of the street, etc.
Mr. Hummer said the P-1 parking decision will help the parking situation.
Mr. James Comfort, President of St. Paul Structural Steel Company, 162 York Avenue, said
that, in view of Mr. Rodrigues' statement, most of his employees are off at 3:30 so
are not the ones racing up and down Agate Street. He said the amount of property owned
by St. Paul Structural Steel had not been mentioned in the staff report, but it consisted
of about 4 blocks stretching to Cayuga to the north. He said the subject site was picked
up by the company as a single lot, and at that time was zoned industrial . In 1972 the
lot was rezoned to residential , perhaps because of residences adjacent to it at that time.
Since then Modernistic Die Cutting, Inc, had purchased all the homes and had removed them
leaving a single lot zoned residential in the middle of an industrial area. Mr. Comfort
said that probably there had been a nonconforming use all that time that St Paul Structural
Steel had been using the subject site for storage for steel bridge girders. He said no
manufacturing is done there, but just storage, and he would like to continue to use it
the same way as it has been used in the past:.
Mr.Hummer moved to recomnend approval of the rezoning to I-l . His motion was seconded by
Ms. Grittner and carried on a 6 to 0 roll call vote.

A. SUFFICIENCY• The petition for rezoning was filed on a short form petition,
subscri�ed& sworn to before a notary.:public on 8-23-77, and received by the
City Planning Office on 9-1-77.
B. PROPOSAL: The request is to rezone this property from RT-1 to I-1 .
C. FRONTAGE & AR��1: The lot has 42.5 ft. frontage on Agate Street and 120 ft. frontage
on vacate Case Avenue.
D. SITE CONDITIONS: This vacant, undeveloped site is fenced and currently is used
as a storage yard for fabricated structural steel bridge girders. Industrial
land surrounds the site on the east side of Agate.
E. AREA CONDITIONS: Agate Street generally divides the area between industry on the
east an resi ential on the west. The industrial area contains the St. Paul
Structural Steel plant, Modernistic Die Cutting, and railroad yards. The residential
area contains many older, well kept homes.
F. FINDINGS:
l . The site has industrial land on all 3 sides.
2. The site is not conducive for the construction of a residential structure.
3. Modernistic Die, owner of the adjacent property on the north, has a request
pending for a setback variance for parking because of the existing RT-1 zoning.
G. STAFF RECOMMENDATION: Based on Findings #1 and #2 above, Staff recomnends that the
petitioner s request e granted.
