FURTHER RESOLVED, That Resolution C.F. 270117 be and is
hereby further amended so as to dele te condition number 9 and
insert the following in place thereof :

' 9. That the pe titioner and/or its assigns agree to re-
imburse the Water Utility to abandon the 6-inch main
in Carroll Avenue by plugging the main at a point
about 60 feet west of Kent Street, and also plug the
main at Mackubin Street.
FURTHER RESOLVED, That all the remaining terms and condi-
tions of vacation of Street Resolution C.F. 270117 shall remain
in full force and effect, and that the Petitioner shall file its
written acceptance to these amendments with the Office of City
Clerk within 30 days of the publication of this amending resolu-
tio n.

WHEREAS, The Council of the City of Saint Paul vacated por-
tions of Carroll Avenue, Kent Street ar�d cer tain alleys for the
Housing and Redevelopment Authority of the City of Saint Paul,
pursuant to Resolution C.F. 270117, adopted November 22, 1977;
and
WHEREAS, The City Council now desires to amend the said va-
cation resolution at the request of the Housing Authority so as
to delete condition number 6 requiring the dedication of right-
of-way for the future widening of Dale Street, amend condition
number 7 so as to correct a typographical error contained in the
description of the retained water utility easemen t, and amend
condition number 9 dealing with the agreement to reimburse the
Water Utility for costs incurred by the Utility in abandoning
the existing water pipes; now therefore be it
RESOLVED, That the Council of the City of Saint Paul does
hereby amend vacation of street resolution C.F. 270117, adopted
November 22, 1977, so as to dele te condition number 6 therefrom,
requiring the dedication of right-of-way for widening of
Dale Street; and be it
FURTHER RESOLVED, That Resolution C.F. 270117 be and is
hereby further amended so as to change the description of the
retained water utility easemen t contained in condition number 6
to read as follows:
7. That a specific easement be retained for the Water
Utility, legally described as follaws:
The west 30 feet of Kent Street between the North
right-of-way line of Iglehart Avenue and a line
fifty feet north of and parallel to the north right-
of-way line of Iglehart Avenue.
