BE IT RESOLVED, That the Council of the City of Saint Paul here-
by ratifies and approves the action of the City of Saint Paul Board
of Appeals and Review pertaining to the following listed property
and as shown by the Excerpted Minutes of said Board of Appeals and
Review, dated November 8, 1977, and marked Exhibit A, and attached
hereto and made a part hereof by reference:

SUBJECT: Request waiver of code provision which restricts use of kitchen
acilities in sleeping rooms , so as to allow use of such facilities in
unit occupied by caretaker only. (Original appeal had •been for waiver on
use of kitchen facilities in individual sleeping rooms , sa as to obtain
rooming house license, because of financial hardship of tenants .)
In addition, the Fire Prevention Bureau, in a letter dated Aug. 10 , I977,
ordered the installation of a fire detection alarm system, and had requested
that the subject be discussed at the October ll meeting.
Prior Hearin 10/11/77: Case continued 30 days to allow time for appellant
to o tain estimate on cost of fire alarm system and to contact St. Paul
Health Dept . to learn if communal kitchen was permissible for tenants' use
in place of electric hot plates . If building sold prior to November meet-
int, case would be closed and appellant need not appear.
Prior Hearing 7/12/77: Case continued to October 11 meeting.
Prior Hearing 4/12/77: Case continued to July meeting, at which time
report on progress toward sale of property was to be given.
Prior Hearin Z/8/77: Case continued to April 12 meeting. Owners had
ma e ecis�on to sell property.
Prior Hearin 11/9/76 : Case continued to later Board meeting to allow
time or appellants to investigate feasibility of alternative uses for
property.

PROCEEDINGS: Chairman Wozniak noted that the City Health Department had
written t e Board to confirm their approval of the following: (1) Communal
kitchen facilities for cooking and dishwashing on Floors #2 and #3, and
� (2) Roomers may keep refrigerators in their individual rooms . In regard
to the separate cooking facilities requested by the Millers for Caretaker
Paul Spreeman in his unit, Chairman Wozniak explained that the applicable
waiver should be on the code section pertaining to the requirement of a
bathroom within a unit where cooking facilities were used.
' Mrs . Miller informed the Board that the communal kitchens were near com-
pletion, after which the electric hot plates would be removed from each
of the sleeping rooms . She rec{uested that an exception be made for the
caretaker' s unit, so as to allow continued use of a hot plate . She said
he was a very responsible and careful person, and to make for further
safety in such use, additional electric outlets would be installed and
extension cords eliminated.
James Tucker, of the Fire Prevention Bureau, assured the Board that the
, building now conformed with the Bureau's recommendations on fire s.afety �
• measures and they wauld approve the renewal of the rooming house license.
Mr. Tieso related that he had met the caretaker on a visit to the building
and had gained the impression that he was a reliable man doing a good job .
He advised that the present situation regarding cooking facilities in the
caretaker' s unit be allowed to continue .

Mr. Glassman moved to grant a waiver of St. Paul Legislative Code, Sectian
54.11, pertaining to bathroom facilities within a unit whexe cooking
facilities are provided, so as to allow such cooking accommodations in
the unit occupied by the caretaker, Paul Spreeman, so long as he resides
there and is so employed, and provided that all remaining items in the
letter of August 30, 1976, from the Division of Public Health are taken
care of in a manner apnroved by that agency. Air. Tieso seconded.
MOTION CARRIED AND SO ORDERED.
THE VOTE : Ayes - 4 Nayes - 0 Abstentions - 0
(Mr. Heider was not present for the vote, but arrived at this point in
the meeting. )
The secretary was asked to advise Joseph Carchedi, License Inspector,
of the resolution of this case , so as to facilitate the renewal of the
rooming house license for this building.

APPEARANCE : None
PROCEEDINGS:
Chairman Wozniak called attention to a letter from Mrs. Sanford to the
Board in which she listed the items she would complete and those which
she had thought were waived in 1975 but were now being questioned by the
Housing Code Enforcement Division. Mrs . Sanford had asked that her letter
be considered in lieu of an appearance before the Board.
Alice Bijjani explained that at the April, 1975 , hearing, Mrs. Sanford had
been represented by an attorney. There had been a conference between the
attorney, Mrs . Sanford, and a city building inspector,where each item on
the Survey Letter had been gone over and marked to signify those on which
Mrs . Sanford requested waivers . The marked items were agreed to by Board,
although they were not considered one by one at that time. There h�ad been
errors of omission and commission in marking the items , but these were not
obvious until many months later when a city inspector went to the building
to check on compliance and found the discrepancies. Ms. Bijjani said the
main item on which Mrs . Sanford had originally appealed, asking a waiver
to allow continued use of shared bathroom by Apts . �3 and #5, had not been
crossed off in the letter prepared by the attorney. On the other hand,
several maintenance items , which would not ordinari2y be waived by the
Board, were crossed off the list. Ms. Bijjani asked for clarification.
Chairman Wozniak suggested that in view of Mrs. Sanford' s age, and since
none of the maintenance items were matters of life safety, the waivers
which were technically granted in 1975 be allowed to stand for her life-
time . �
After a general discussio�. of the matter of the share d bathroom for Apts.
#3 and #5 , Mr. Tieso remarked that Mrs . Sanford's original appeal had been
on this particular item and she , as well as the Board, had thought they
were granting a variance on the arrangement in April , 1975.
BOARD ACTION:
Mr. Tieso moved to grant a variance of St. Paul Legislative Code, Section
54. 11, pertaining to shared bathrooms , provided all remaining items , as
designated in appellant's letter of 11/4/77, be comp leted; said variance
to remain in effect for the period of her lifetime or until such time as
property be sold or any other right , title or interest be tranferred, at
which time said variance shall be nullified. Mrs . Peake seconded.

PROCEEDINGS:
Mr. Glassman told the Board that this property had been vacant for some
time, and had been appealed by the previous owner who asked a waiver of
the vacant building fee in the summer of 1977. He said Mr. Stevens had
bought the property and was making rapid progress toward rehabilitation.
Mr. Stevens said he was bringing the building up to code, but there were
four bathrooms which lacked handsinks. The plumber had advised him that
there �,ras too little space to install sinks . In each case, the kitchen
sink i�as located just around the corner from the bathroom and could serve
the same purpose as a handsink in the bathroom. He asked for a variance
of code on this matter.

Mrs . Peake moved to grant a variance of the St. Paul LegisZative Code,
Section 54 . 11, pertaining to handsink facilities in a bathroom. Mr. Tieso
