WHEREAS, James A. Watson III, d/b/a Club Scorpio, is the
holder of an On Sale Non-Intoxicating Liquor License, an
Off Sale Non-IntoYicating Liquor License, a Tavern License,
a Class C-2 Restaurant License, a Dance Hall License, and a
Cigarette License, all for the premises at 1175 W. 7th Street,
in the City of Saint Paul; and
WHEREAS, the licensee had made application for the renewal
of all such licenses to the License Inspector; and
WHEREAS, the License Inspector recommended to the License
Committee that none of the licenses be renewed or granted on the
following grounds:
"1. Permitting dancers or performers on the licensed
premises to expose their pubic hair, vaginas, anuses,
and genitals to customers without having any covering.
Such violations occurred on Augu st 27, 1977; August 4,
1977; July 29, 1977; Ma.y 17, 1976; and January 5, 1976.
2. Permitting dancers or performers on the licensed
premises to expose their pubic hair, vaginas, anuse�,
genitals and breasts to customers. Such violations
occurred September 1, 1977; September 9, 1977;
September 13, 1977; and September 15, 1977.
3. Permitting dancers and customers to come into
physical contact by customers touching or fondling
the pubic hair, vaginas, or genitals of the dancers
on the licensed premises. �uch violations occurred
September 1, 1977; and July 29, 1977."

WHEREAS, a hearing was scheduled before the License
Committee on October 5, 1977, and continued to October 12, 1977,
at which hearing the licensee appeared and voluntarily proceeded
without counsel; and
WHEREAS, the hearing was on the record, with all testimony
taken under oath, taken by a shorthand court reporter, and the
licensee was permitted to examine all witnesses and present
testimony and evidence in his own behalf;, and
WHEREAS, the Committee heard testimony from Sgts. Mark
Jessen, John Voita, Gary Bohn, and Michael Markuson; from Officers
Francis Zaruba, Thomas Fabio, Robert Paskett, and Keith Mortenson,
all of the Saint Paul Police Department; from Joseph F. Carchedi,
License Inspector; from the licensee James A. Watson, and an
employee of the licensee, Daniel Ziemann; and received documentary
evidence consisting of Exhibits 1 through 10; and
WHEREAS, the evidence received by the Committee established
that on nine separate occasions over a period from January 5,
1976, to September 15, 1977, gross violations of the liquor li-
censing regulations pertaining to sexual conduct in bars occurred;
that the licensee acknowledged that such violations had occurred,
and the testimony of the officers was truthful; that it could
be reasonably inferred that such violations were a continuous
and accepted course of conduct by dancers and performers on the
premises; tha.t the actions done by the dancers and performers
violated both the ordinance prior to August 29, 1977 and the
ordinance as amended after that date; and that the management
and licensee did not exercise any effective control over the
actions of such dancers and performers so as to eliminate the
` violations ; and
WHEREAS, the License Committee considered all of the evi-
dence, taking into account the demeanor and credibilit y of the
witnesses, together with the documentary evidence introduced,
and thereupon voted 2-0 to recommend to the Council of the City
of Saint Paul that all licenses applied `for by the licensee, and
which the licensee had held in the past, be denied and revoked;
and

WHEREAS, a copy of this Resolution as proposed by the License
Committee has been mailed to the licensee before its considera-
tion by the Council; now, therefore, be it
RESOLVED, that the applications by James A. Watson III for
the renewal of licenses held by him for the premises at 1175
W. 7th Street in Saint Paul are hereby denied, and any existing
licenses revoked.
