An ordinance to amend Section 2.01
of the Charter of the City of Saint Paul by

THE COUNCIL OF THE CITY OF SAINT PAUL DOES ORDAIN:
Section l.
Section 2.01 of the Charter of the City of Saint Paul is
hereby amended to read as follows:
"Sec. 2.01. Elective Officials. There
shall be a ma.yor and seven councilmen, elected�'' �

Dear Mr. Sylvester :
In September of 1976 , the Council referred to the Charter
Commission a legal opinion of the city attorney relating to the
office of the constable in Saint Paul . As you know, there are
two at large constables , and one provided for the Sixth Ward,
the latter being vacant at the present time.
After hearing the views of the constables , the Ramsey
County Bar Association, Chief Rowan, Sheriff Hedman, and
Chief Judge William J. Fleming, and receiving information on
the statutory powers and duties involved in the office of
constable, it is the recommendation of the Charter Commission
that that office be abolished. This recommendation is formally
expressed in e ar er ommission Resolution attached hereto .
An ordinance is also attached hereto, prepared by the
office of the city attorney, which will effectuate this recom-
mendation in the event the Council concurs . It requires a
unanimous vote of the Council after a public hearing, which has
been preceded by two weeks ' published notice. It is the view
of the Commission that this is not .such a major matter as would
best be decided by the electorate.

RESOLUTION
OF THE
SAINT PAUL CHARTER COMMISSION
WHEREAS, the Council of the City of Saint Paul referred
for the consideration of the Charter Commission a legal opinion
relating to the office of constable; and
WHEREAS, the Charter Commission established a subcommittee
which heard testimony and views, received informa.tion from the
office of the city attorney, and sought the advice of various
public groups and police agencies ; and
WHEREAS, the subcommittee met on several occasions, in-
cluding November 24, 1976, February 9, 1977 and April 19, 1977,
and the Charter Commission considered the report of the sub-
committee on September 22, 1977 ; and
WHEREAS, it appears that the Ramsey County Bar Association,
the Ramsey County Sheriff, the Saint Paul Chief of Police, and
the Chief Judge of the Ramsey County Municipal Court concur in
the recommendation of the subcommittee, which is that the position
of constable is an anachronism and should be abolished; and
WHEREAS, the Charter Commission has fully and carefully
considered the report, and the views and testimony received in
connection with the subaommittee' s proceedings; and
WHEREAS, it appears to the Charter Commission that the
office of constable no longer serves a useful public function,
that interest in the position by the electorate is minima.l,
that every power confzerred' on the office of constable is per-
formed by other public officers more efficiently and capably,
and that there is no reason for the ma.intenance of that office;
now, therefore, be it

RESOLVED, that the Saint Paul Charter Commission recommends
that the Council of the City of Saint Paul adopt by ordinance
the amendment to the Charter contained in the ordinance attached
to this Resolution, pursuant to Minn. Stat. � 410.12, Subd. 7,
which amendment will abolish the office of constable within the
City of Saint Paul.

NOTICE OF PUBLIC HEARING
Notice is hereby given that the City Council of the City of Saint
Paul, Minnesota, will hold a public hearing on November 8, 1977 at 10:00
A.M, in the Council Chamber in the City Hall and Court House to consider
the approval of an ordinance being C.F. 269922 amending the Charter of the
City of Saint Paul by abolishing the office of constable for the Sixth Ward
and at large.
The text of the ordinance is as follows:
