' WHEREAS, the Council, pursuant to the provisions of Section 12. 09 of the Sai.nt Paul City Charter and the Public Employment Labor Relations Act of 1971 , as amended, recognizes that for the purpose of ineeting and negotiating the terms and conditions of employment, Bricklayers Local � No. 1 is the exclusive representative for City employees falling within the units as certified by the Bureau of Mediation Services under case number: 73-PR-537-A and WHEREAS, the City through designated representatives and exclusive representatives have met in good faith, negotiated conditions and terms of employment for the period through April 30, 1978, for such personnel as are set forth in the agreement between the City and the exclusive representatives, now, therefore, THE COUNCIL OF THE CITY OF SAINT PAUL DOES ORDAIN: Section 1. That the wage schedules indicated in the Agreement with the above-described representatives shall take force and effect retroactively to the dates set forth in the Memorand.um of Agreement and in accordance with the expressed intent of the agreement of this Council contained in Council File Number 268207. Section 3. That any other ordinance, rule or regulation in force when said Agreement takeseffect, inconsistent with any provisions of the terms or cond.itions of said Agreement, is hereby repealed. Section 4. This ordinance shall take effect and be in force thirty (30) days after its passage, approval, and publication. In ftiill settlement for the Period May l, 1g77, thru April 30, 1978, the parties hereto have agreed as follows: (1) Except as herein modified, the Agreement between the parties entered into July 1, 1976, shall be the basis of the forth- coming Labor Agreement. (2) Appendix C and Appendix D of said Agreement shall be replaced with Appendix C and Appendi.x D which are attached hereto and made a part hereof. (3) The 1977 Agreement shall become effective May l, 1977. (4) It is also agreed that the duration of the lgj7 Agreement shall be through April 30, 1978, and that said termination date shall be set forth in Section 30.1 of the new collective bargaining Agreement. (2) contribute $ .53 per hour for all hours worked by participating employees as defined in Articles 12.3, 12.4 and 12.5 covered by this AG�MEIVT, to a Pension Fund. (3) contribute $ .56 per hour from which payroll deduction has been made for all hours worked by participating employees as defined in Articles 12.3, 12.4 and 12,5 covered by this AGREEMENT, to a Vacation �nd. All contributions made in accordance with this Appendix shall be forwarded to� depositories as directed by the UIJION. The ENlPIA7�R shall establish WorlQnan's Compensation and Unemployment Compensation programs as required by Minnesota Statutes. Participating employees as defined in prticles 12.3, 12,4 and 12.5 covered by this AGREF.'MENT, shall not be eligible for, governed by, or accumulate vacation, sick leave, holiday, fluieral leave, �ury duty, or insurance fringe benefits that are or may be established by Personnel Rules, Council Ordinance, or Council - ftesolutions.
