LEASE AGREEMENT � - - - - - - - - - - - - - - THIS AGREEMENT, Dated this day of , 1977, by and between the City of Saint au , innesota, ere�na ter ca ed the "City," and the Saint Paul Yacht Club, hereinafter called the "Club"; WITNESSETH: THE CITY AND CLUB MUTUALLY AGREE AS FOLLOWS: 1 . That for the sum of One Thousand Eight Hundred Dollars ($1 ,800.00) and other good and valuable consideration, the City hereby leases to the Club a portion of Harriet Island, 1ocated in and owned by the City, for the , purpose of maintaining a docking facility for rivercraft on the Mississippi River. The leased portion, referred to as the Upper or Small Boat Harbor, is ou�lined in red on the attached map which is made a part hereof and noted as Exhibit A. 2. That the term of this lease shall commence January 1 , 1977, and expire on December 31 , 1977. 3. That the Club agrees to keep the area in a clean and orderly condition free from debris, and as part of this .responsibility, shall : a. cut grass and maintain banks on south side of marina from Nagasaki . Road to waterline of boat harbor, b. provide adequate number of trash receptacles to accommodate debris generated by boat owners and visitors to the area and be responsible for the removal o:f trash, and, c. maintain the steps and access to the boat harbor .in a safe condition. 4. That the Club shall provide adequate lighting for the boat harbor area. 5. That the Club shall be allowed to install a water supply at its own expense provided that plans for such work shall be approved and coordinated with the Department of Community Services. Said approval shall be in writing with no work to commence before written approval is received. 6. That the Club shall cause to be installed and provide access to public telephones to users and visitors to the boat harbor. 7. That the City shall have the right to inspect the books and records of Club during usual business hours. 8. That the C1ub agrees to save and hold harmless the City from any and a11 claims arising out of the Club's use hereunder; and in order to give this indemnification form and effect, Club shall provide, at its own expense, public liability insurance naming the City as co-insured; said insurance to be in the sum of $500,000. -1- � ' • .;�'�'�i� ,--z.- `�� 9. That no improvements, construction, or alterations of any kind will be undertaken by the Club as to the leased premises without the prior review � and approval by the Department of Community Services. 10. That in the event the City determine that another use is appropriate for the leased premises, the City agrees to furnish the Club written notice of a period consistent with the City's overall development schedule of the City's intent to terminate this Agreement. Said notice shall be sent during the period of May 1 through September 30 to allow the Club ample time to dispose of slips. � 11 . This Agreement may be terminated by the City upon 30 days' written notice for violation of terms of the Agreement.
