�Ir. Reher said he purchased t�ze five-unit building iaith the knowledge
that a variance previously granted ti�ould no longer be in effect after
the nrevious o��ner sold the building. Basement occupancy had been granted
for the caretaker and his wife , limited to the period of the previous
o��rner ' s interest in the building. The occupant of one of the upstairs
t��o-bedroom apartments had planned to move out, and i+1r. Reher had intended
� to mol�e the caretaker to that apartment . However, the second floor �
� tenant became ill and was not able to leave . Mr. Reher said that Care-
�� taker CFiristopher Stecher was 76 years old and wished to live the rest
� of his life in the building, either �n the basement apartment or in the
� upstairs tiao-bedroom unit if it became available . .

!°� Frank Staffenson stated that his department would have no objection to
granting such a variance on the basement occupancy for Mr. and Mrs .
Stecher.
BOARD ACTION:
Nir. Glassman moved that a waiver of the basement occupancy be granted
as long as Mr. or rirs . Christopher Stecher or both are living or until
the two-bedroom apartment on the second floor becomes availab�e , at which
time the waiver sI-Lall be nullified. Mr. Voigt seconded. T70TION CARRIED

�Q% I�ir. Valentine said he had begun� work on them, and had recently moved the
� hot �rater heater next to a chimney to eliminate a fire hazard. He said
he felt all the other work required was reasonable and had no objection
to complying. He said his tenants were all people of very low incomes
' ��ho could not afford higher rents and there was a need for this type of
rental . All four apartments consisted of just two rooms each, a kitchen
and bed-sitting room. H� expected to have all the work done by the end
oi July on the interior, but would like until October 1 to complete all
�::e exterior worl: required.
��aRD ACT I ON:
Cnairman Wozniak moved that a waiver on the shared bathrooms be granted
on condition that the first floor bathroom be completed and occupancy
of each of the four units be restricted to one person, and he further
moved that an extension of time to August 1 , 1977, be granted for• com-
pletion of the interior �aork, and to October 1, 1977, for �the exterior
work. h�r. Glassman seconded. MOTION CARRIED AND SO ORDERED.

PROCEEDINGS :
Chairman tiVozniak explained that Mr. Mangels had been granted permission
to submit a letter in lieu of a personal appearance because he lived
200 miles away from St . Paul and it would be a hardsI-Lip for fi im to make
the trip. All Board members had been furnished a copy of the letter in
advance , and Chairman ti�Tozniak pointed out that there were three items
;�1r. h4angels had been ordered by the city to correct, two of which had been
taken care of. The kitchen sink was near to the bathroom, and a waiver
was requested of the hand sink requirement in the b athroom, the third item.
I�Sr. Staffenson said that Mr. Mangels had been very cooperative in the past
and his department would have no objection to the granting of the waiver.

I�Ir. Reher said he purchased the five-unit building with the knowledge
that a variance previously granted ��ould no longer be in effect after
the tirevious o��ner sold the buildin�. Basement occupancy had been granted
for the caretaker and his wife , limited to the period of the previous
owner ' s interest in the building. The occupan� of one of the upstairs
two-bedroom apartments had planned to move out, and AZr. Reher had intended
to move the caretaker to tY�at apartment . However, the second floor
tenant became ill and was not able to leave . Mr. Reher said that Care-
taker Christo�her Stecher was 76 years old and wished to live the rest
of his life in the building, either �n the b asement apartment or in the
upstairs tiao-bedroom unit if it became available .
Frank Staffenson stated that his department would have no objection to
granting such a variance on the basement occupancy for Mr. and Mrs .
Stecher.
BOARD ACTION:
hir. Glassman moved that a waiver of the basement occupancy be granted
as long as Mr. or 1�1rs . Christopher Stecher or both are living or until
the two-bedroom apartment on the second floor becomes availab�.e , at which
time the waiver sh.all be nullified. Mr. Voigt seconded. MOTION CARRIED

in the second floor bathroom with the tenants of the two second floor
apartments . He was willing to add a hand lavatory and tub to the water
closet roc:� on the first floor. Each of the four apartments was occupied
by a singl� tenant . He requested that a waiirer be granted to all.ow the
occupants of each floor to share the b athroom facility on that floar .
�ir. Glassman asked if progress was being made on all other items listed
in the 3/28/77 letter from the Code Enforcement Division fo11 owing their
inspection .
'�ir. Valentine said he had begun work on them, and had recently moved the
hot water �eater next to a chimney to eliminate a fire hazard. He said
he felt a11 the other �,rork required was reasonable and had no objection
to complying. He said his tenants were all people of very low incomes
who could not afford higher rents and there was a need for this type af
rental. AI1 four apartments consisted of just two rooms each, a kitchen
a�d bed-sitting room. He expected to have all the work done by the end
oi July on the interior, but would like until October 1 to complete all
�:_e exterior work required.
3��RD ACTION:
Cnairman Wozniak moved that a waiver on the shared b athrooms be granted
on condition that the first floor bathroom be completed and occupancy
of each of the four units be restricted to one person, and he further
moved that an extension of time to August l, 1977, be granted for com-
pletion of the interior work, and to October 1, 1977, for the exterior
work. Mr. Glassman seconded. MOTION CARRIED AND SO ORDERED.

PROCEEDINGS :
P•ir. Scholz explained, usinj rough sketches of the second floor arrange -
ment , that chan�ing the location �f the bathroom door in Apt. #2 would
cause it to open directly to the headof rear stairway, causin g a danoer
to soneone ascending the stair�aay it the door should be opened as he
reached the top . As it was located presently, the tenant had to come
out into a common hall to enter his bathroom, which w as against the code ,.
but lrhich he said the inspector agreed was the safest arrangement . As
for tne bathroom in Apt . #3, there tiaas no space for a hand lavatory, but
the kitchen sink was within four feet of the b athroom and could be used
as well . I�ir. Scholz asked if he would be permitted to do his own plumb-
ing to make a required venting correction if he took out a permit .
�1r. Tieso said that Mr. Scholz would be required ta have a Iicensed
plumber do such work, since he was not � living in the b uilding.

Apt. �Z, pertaining to location of bathroom within the walls of an ap art-

Request Waiver of St. Paul Legislative Code, Section 54. I1 (b) , pertaining
to requirement of a hand lavatory in room with water closet, because of
lack of space and high cost.

PROCEEDINGS :
Chairman ��lozniak explained that Mr. Mangels had been granted permission
to submit a letter in lieu of a personal appearance because he lived
200 miles away from St . Paul and it would be a hardsh.ip for him to make
the trip. All Board members had been furnished a copy of the letter in
advance , and Chairman Wozniak pointed out that there were three items
Mr. Mangels had been ordered by the city to correct, two of which had been
taken care of. The kitchen sink ilas near to the b athroom, and a waiver
was requested of the hand sink requirement in the bathroom, the third item.
Mr. Staffenson said that Mr. Mangels had been very cooperative in the past
and h.is department would have no objection to the granting of the waiver.
