Levy to rezone from 6-2 corr�nunity business to I-1 industry property on the west side of I-35E between Hyacinth and Clear (extended). This would abut the K-Mart and National Food Store development to the south. The property is further described by the legal description on file. This matter was first heard by the Current Planning and Zoning Comnittee on March 24, 1977 at which time staff recommended denial since the petition was to rezone to I-3 (heavy industry). The Committee, with the applicant's con- sent, laid the matter over for two weeks to allow time for an amended petition to be filed. The matter was then heard on Apri1 7, ]977 at which time staff recorr�nended approval . A motion to recommend approval was made by Mr. Humner, seconded by Mr. Bryan, and passed unanimously. On April 8, 1977, the Planning Commission passed unanimously, on a roll call vote, a motion by Mr. Bryan, seconded by Mr. Sherwood, to recomnend approval of the petition to rezone from B-2 to I-l . Hummer and Bryan of the Current Planning & Zoning Corrpnittee; r(�. R�icFiard Amey of the Division of Housing & Building Code Enforcement; Mr. Laurence Jung and Ms. Fox of the Planning Staff. GERALD BERGER-ROBERT LEVY (#8094) : A petition to rezone to I-1 properties west of I-35E between Hyacint and C`i�ear. The appellant was present. There was opposition. Mr. Jung read the staff report. Mr. Bryan asked the applicant if it were true that he had changed his request to I-1 and the answer was in the affirmative. Mr. Charles Johnson, representing Mailand Construction Company, said he had also appeared at the previous hearing. He noted that the change to I-1 still contains some business uses. He said his client's concern is maintenance of the access road. He said truck traffic is the big problem because of their effect on the bridge as it crosses the sewer line and driveway. He said his client's position , depends upon the use to which the property will be put and he asked that any recor�nendation for rezoning be conditioned on maintenance of the roadway. Mr. Bryan asked if the roadway were actually owned by Mr. Johnson's client, and the answer was in the affirmative. Mr. Johnson said they obtained the property from the applicants and at that time an easement was reserved over the roadway. Technically, the fee title for the roadway is in the name of his client, but ingress and egress is controlled by the applicants. He said the maintenance factor would change if truck traffic becomes heavy. Mr. Hummer said he did not believe the Committee could zone conditionally but he did think the matter of the access road would be a concern of the two parties and would not be a zoning question. Mr. Johnson said he would concur in that. He said it would not be proper to zone conditionally, but he asked that if the rezoning were to be allowed, some time schedule be put on it to work out a maintenance agreement. Mr. Gerald Berger of 2535 South Shore Blvd. , White Bear Lake, Minnesota said he too had been at the last meeting. He mentioned that when the property was sold to him, the surrounding land was I-3 or heavy industrial , and there was no access to this parcel . He said they have a private agreement for easement. He did not think it was appropriate for the Planning Commission to insert into a rezoning any stipulation that two individuals have to reach some new agreement in order to get a rezoning, because that is outside of the rezoning request. He said he wants to cooperate, but they went through considerable negotiation to reach the contracts and agreement they have. He said that the contract had limitations for access, since competition with K-Mart was the reason for the contract. � '� t . 1 � Gerald Berger-Robert Levy page 2 Mr. Bryan said Mr. Humner's remark was correct and the statement about the problem being between two parties is probably true. Mr. Bryan suggested that the solution might be to sell the property. Mr. Berger said they are open to a variety of possibilities. PURPOSE: The applicant proposes to rezone the site from B-2, Corrrnnnunity Business, to I-3, Industry, to allow for future industrial development. C. FRONTAGE & AREA: The site is on the west side of 35E. It is in two sections. he smaller western parcel is about 2.1 acres and the eastern parcel is about 8.8 acres. D. SITE CONDITIONS: Both tracts of land are undeveloped. The western site is evel and ow lying, while the eastern site is more hilly. The site does not have adequate road access. It is "landlocked", and its only access is via the shopping center's service drive from Maryland. Both parcels would re- quire extensive site preparations before any development could proceed. As there is rail access, a rail siding could serve the properties. E. AREA CONDITIONS: Primarily, the area west of the freeway in this area is low- lying industria land. K-Mart's commercial development is an exception. Zoned "heavy industry", the extensive industrial operations in this area have large open storage areas. F. FINDINGS: 1 . The property under consideration is vacant. 2. The requested rezoning is intended to allow for relatively unrestricted development of the site. 3.
