THE COUNCIL OF THE CITY OF SAINT PAUL DOES ORDAIN:
Section l.
That the Zoning Map of the City of Saint Paul, Sheet No. 5,
as incorporated by reference in Section 60.401 of the Saint Paul
Legislative Code, is hereby amended as follows:
The property owned by Gerald Berger and Robert Levy
located on the West side of I-35E� between Hyacinth and
Clear Avenue, more particularly describecl on Exhibit A
attached hereto and incorporated herein by reference is
rezoned from B-2 to I-l. �

Dear Mrs. Mix:
This is written in response to the petition of Gerald A, Berger and Robert J.
Levy to rezone from 6-2 corr�nunity business to I-1 industry property on the
west side of I-35E between Hyacinth and Clear (extended). This would abut
the K-Mart and National Food Store development to the south. The property is
further described by the legal description on file.
This matter was first heard by the Current Planning and Zoning Comnittee on
March 24, 1977 at which time staff recommended denial since the petition was
to rezone to I-3 (heavy industry). The Committee, with the applicant's con-
sent, laid the matter over for two weeks to allow time for an amended petition
to be filed. The matter was then heard on Apri1 7, ]977 at which time staff
recorr�nended approval . A motion to recommend approval was made by Mr. Humner,
seconded by Mr. Bryan, and passed unanimously.
On April 8, 1977, the Planning Commission passed unanimously, on a roll call
vote, a motion by Mr. Bryan, seconded by Mr. Sherwood, to recomnend approval
of the petition to rezone from B-2 to I-l .
This matter is scheduled to be heard before the St. Paul City Council on
May 12, 1977.

April 8, 1977, at 9:00 a.m. , in the City Planning Conference Room at 421 Wabasha,
St. Paul , Minnesota.
Present: Mmes. Cochrane, Grittner, Mayne, McGinley, Montgomery, Norton, and
Piccolo; Messrs. Bryan, Grais, Hanggi , Humner, McDonell , Pangal ,
Prifrel , Sherwood, Tobler, and Van Hoef.
Absent: Messrs. Feder, Stegemoeller, and Willits.
Also present: John Rutford and Merrill Robinson, Association o� St. Paul Communities;

The Planning Comnission at its April 8, 1977 meeting tnok the following action:
APPROVED the minutes of the March 25, 1977 meeting. Motion was made by Mr. Pangal ,
seconded by Mrs. Piccolo, and carried unanimously.
�/RPPROVED, by unanimous roll call vote, a motion made by Mr. Bryan, seconded by Mr.
, Sherwood, to recorr�nend the rezoning of the property west of I-35E between Hyacinth
and Clear to I-1 , as requested by Berger and Levy, be granted.
APPROVED, by unanimous roll call vote, a motion by Mr. Bryan, seconded by Mrs.
Mayne, finding the special condition use (requested by the Newgate Education and
Research Center) for property on the south side of Prospect Boulevard between
Bellows and Bidwell is applicable.
APPROVED, by a unanimous voice vote, a motion by Mr. Bryan, seconded by Mrs. Mayne,
setting May 13, 1977 as the date for a public hearing regarding a 40 Acre Study to
amend the Zoning Ordinance text for language clarification.
By RESOLUTION (77-9) adopted a process for reviewing general district plans.
APPROVED, by unanimous voice vote, a motion by Mr. McDonell , seconded by Mrs.
Mayne, establishing April 22, 1977 as the date of a public hearing for the draft
plan �Qmorrow's Framework from Todav's Foundation: Planning for powntown Saint
Paul .
By RESOLUTION (77-10) recorrr�nnended to the Mayor and City Council the temporary
closing of Lexington Parkway through Como Park to evaluate the impact on the
area.
Ken Ford of staff reported that the Metro Systems Statement had been received and
was being evaluated by staff.

PRESENT: Messrs. Hummer and Bryan of the Current Planning & Zoning Corrpnittee;

Laurence Jung and Ms. Fox of the Planning Staff.
GERALD BERGER-ROBERT LEVY (#8094) : A petition to rezone to I-1 properties west
of I-35E between Hyacint and C`i�ear.
The appellant was present. There was opposition.
Mr. Jung read the staff report.
Mr. Bryan asked the applicant if it were true that he had changed his request
to I-1 and the answer was in the affirmative.
Mr. Charles Johnson, representing Mailand Construction Company, said he had also
appeared at the previous hearing. He noted that the change to I-1 still contains
some business uses. He said his client's concern is maintenance of the access
road. He said truck traffic is the big problem because of their effect on the
bridge as it crosses the sewer line and driveway. He said his client's position
, depends upon the use to which the property will be put and he asked that any
recor�nendation for rezoning be conditioned on maintenance of the roadway.
Mr. Bryan asked if the roadway were actually owned by Mr. Johnson's client,
and the answer was in the affirmative. Mr. Johnson said they obtained the
property from the applicants and at that time an easement was reserved over
the roadway. Technically, the fee title for the roadway is in the name of his
client, but ingress and egress is controlled by the applicants. He said the
maintenance factor would change if truck traffic becomes heavy.
Mr. Hummer said he did not believe the Committee could zone conditionally but he
did think the matter of the access road would be a concern of the two parties
and would not be a zoning question.
Mr. Johnson said he would concur in that. He said it would not be proper to
zone conditionally, but he asked that if the rezoning were to be allowed, some
time schedule be put on it to work out a maintenance agreement.
Mr. Gerald Berger of 2535 South Shore Blvd. , White Bear Lake, Minnesota said
he too had been at the last meeting. He mentioned that when the property was
sold to him, the surrounding land was I-3 or heavy industrial , and there was
no access to this parcel . He said they have a private agreement for easement.
He did not think it was appropriate for the Planning Commission to insert into
a rezoning any stipulation that two individuals have to reach some new
agreement in order to get a rezoning, because that is outside of the rezoning
request. He said he wants to cooperate, but they went through considerable
negotiation to reach the contracts and agreement they have. He said that the
contract had limitations for access, since competition with K-Mart was the
reason for the contract.

Mr. Bryan said Mr. Humner's remark was correct and the statement about the
problem being between two parties is probably true. Mr. Bryan suggested that
the solution might be to sell the property.
Mr. Berger said they are open to a variety of possibilities.
Mr. Bryan said the Current Planning & Zoning Committee would recommend to the
full Planning Comnission a rezoning to I-1 . He said the matter will come up
before the Planning Cor�nission the next day, April 8, and that the Planning
Comnission's recarrnendation will be passed on to the City Council for final
approval .

A. SUFFICIENCY: The applicant's request for rezoning was filed on a short form
rezoning petition that was notarized on February 15, 1977 dnd received by
the City Planning Office on February 28, 1977.
B. PURPOSE: The applicant proposes to rezone the site from B-2, Corrrnnnunity Business,
to I-3, Industry, to allow for future industrial development.
C. FRONTAGE & AREA: The site is on the west side of 35E. It is in two sections.
he smaller western parcel is about 2.1 acres and the eastern parcel is about
8.8 acres.
D. SITE CONDITIONS: Both tracts of land are undeveloped. The western site is
evel and ow lying, while the eastern site is more hilly. The site does
not have adequate road access. It is "landlocked", and its only access is
via the shopping center's service drive from Maryland. Both parcels would re-
quire extensive site preparations before any development could proceed.
As there is rail access, a rail siding could serve the properties.
E. AREA CONDITIONS: Primarily, the area west of the freeway in this area is low-
lying industria land. K-Mart's commercial development is an exception.
Zoned "heavy industry", the extensive industrial operations in this area have
large open storage areas.
F. FINDINGS:
1 . The property under consideration is vacant.
2. The requested rezoning is intended to allow for relatively unrestricted
development of the site.
3. Use types more appropriate to the site could be accommodated under the
I-1 zoning classification.

4. Road access to the site presents a problem. Agreements with
adjoining owners will probably be necessary prior to development
of the site.
5. Intensive development of this site may compound traffic problems
at the East Maryland I-35E Interchange.
G. STAFF RECOMMENDATIONS: Staff recommends denial of the petition to
rezone to I-3.

about a public hearing which may affect you. '�
The Council of the City of St, paul will hold a public hearing in the ,
Council Chambers of the City Hall and Court House (third floor) at ,
10;00 a.m. on May 12, I977 on the;
Application of Gerald A. Berger and Robert J. Levy to
REZONE from B-2 to I-1 the property west of I-35E between
Hyacinth and Clear Avenues extended. The propexty is
described as follaws: Tract C, Registered Land Survey '
�267 and all that part of the following described tract:
Lots 17 and 18, J. W. Bass Garden Lots, except wat�er �
works and railroad right of way; which lies NEly of a
line run parallel with and distant 1 foot NEly of the
St. Paul Water Works right of way; and SEIy of a line run
parallel with and distance I foot SBly of the Wisconain
Central Railroad Company right of way; containing 8.85
acres, more or less, in addition to the existing highway;
together with all right of access, being the right of
ingress Co and egress from ali that portioa of the above
described tract not acqeiired hereip, to Trunk Highway
No. 10 and other parcels.
