November 5, 1974i presently encoded as Section 25.09 (1) of the
Saint Paul Legislative Code, be and the same is hereby amended as
follows:

1. Height of Fences. No fence shall be erected exceeding six

grade of any lot in a residence district or on any lot occupied for
residential��* purposes. Fences and all supporting structures shall

Ordinance �16020, June 18, 1976, contains the fence regulations for the city. .
There is a �referencc to Legislative Code Section 62.02 of the then zoning code �
which controlled fences, loca�ed between the front building line arrd front
property line. Th� section' in re�erence was repealed at the tirpe of adoption
of the present zoning code, October 25, 1975.

Thank you for your letter of March 3, 1977. . Based on the
information set forth in that letter, it would appear that the
construction of the fence c7oes in fact violate the provisions
, of the new zoning code.
A fence has been held to be a "building" or an enclosing
"structure. " 35 Am.Jur.2d, Fences, S1• As a rule of
construction, the word "building" includes under the new
zoning code a "structure" or any part thereof. C;ty of St.
Paul Zonin Ordinance, '��60.3QO.e, 60.385. Also, � e new
zoning co e e nes accessory use" as a use which is clearly
incidental to, customarily found in connection witl�, and
located on the same zoning lot as. the principal use to which
it is related. Id. , 160.302o The definition of "accessory
use" is not exclus�ve, but by aay of example includes a number
of items. Id. , x60.302.a-60.302.� . At �60.313, a building
line is defined as the ].ine formed by the face of the building
ana for the purpvse of this ordinance, a minimum building Iine
is the same as � front setbeck line.

Additionally, we have been informally advfsed that a permit
applicatfon €or the construction of a swimmi�g pool for . this
property has been denied on the ground that there is no rear
yard to this property, it consisting of two front ya�rds facing
on Portland and 5ummit Avenues. In light of this ruling, we
question whether the owners of this property have the right to
construct the chain-link fence so that it abuts the sidewalk.

We request that your' office, in conjunction Mith the City
Attorney's office, review this matter again to determine
whether or not the fence complies with all the general
provisions relating to buildings and structures. At the very
least, the fence constitutes an a�cessory use, also subject to
setback requirements along the street as well as side
setbacks:

either our clients or the owners, we request that your offfce
instruct the owners not to proceed further with construction
of the fence until this matter has been fully reviewed by your
office and a ruling on the above obtained. ,

Dear Mr. Browns
Fence regulations for the City of Saint Paul aro contained in
Ordinance No. 15730, effective December 18, 1974, which is titled
"Building Code - Perntits and Tnspections. " This r�guZation refers
to Legislative code Section 62.02 concerning fences between the
front building lfne and the front property lin� which was repealed
by Ordinance No. 15881, August 29, 1975.
The action is taken as removing special restriction on fences in
� this area. ,
The Zoning Coae Section 64.203 gives any person affected by the
decision of the Zoning Administrator the right to any proc�dure for
appealing such decisions. A form is enclosed for your canvenience.
A fee of $50.00 for appeal� is required by Council File No. 26625,
October 24, 1975.
