PROPERTY APPELLANT 03- 77-H 360-362 Fuller Avenue Oscar Valar (9 units) by Pierre Regnier, Attorney SUBJECT: Request Waiver of St. Paul Legislatiti-e Code requirement pertaining to shared bathrooms, and Extension of Time to complete remaining items as designated in Survey Letter of 1/19/77, so as to obtain Certificate of Occupancy, because of financial hardship. APPEARANCE: Oscar Valar Pierre Regnier PROCEEDINGS: Mr. Regnier stated he had met with city inspectors during the previous week to go over the list of violations to determine which items needed immediate attention. He said it had been agreed that all illegal open wiring would be taken care of by Mr. Valar at once, and the remaining electrical work completed within three months . In regard to the plumbing items, it was agreed that Vos . 39 and 42 would be corrected immediately and the remainder within one year. On the heating items , Nos . 71, 73, 78, and 79 had already been done, an d it was agreed that Mr. Valar would make the required repairs designated in Nos . 72, 74, 75, and 77 without delay. Mr. Valar indicated that some of the work on the heating system could not be done until the weather improtiTed enough so the heat could be shut down. Alice Bijjani said such a delay would not be acceptable to the city, particularly on the problem of combustion spillage, which was hazardous, and she advised Mr. Valar to have a professional do the work. �h�� ,. Cassette Tape No. 139 PROCEEDINGS (continued) Mr. Regnier suggested that a city inspector meet with Mr. Valar at his building and explain exactly what was required. Mr. Tieso stated that he felt Mr. Valar should also consult with the city electrical inspector to be certain of the particular items nee dino immediate correction . Mr. Regnier said the other part of Mr. Valar' s appeal concerned the matter of shared bathrooms. He distributed snapshots of some of the rooms in question. He explained that the five two-room units on the second floor shared two large bathrooms , ti,rhich were cleaned daily by Mr. Valar's daughter who occupied one of the two-room apartments . Mr. Regnier pointed out that, if the kitchen facilities had to be removed to comply with the code and the five units converted to sleeping rooms, there would then be 12 sleeping rooms, with 12 people sharing two baths instead of the five people now sharing them. He said that if the Board should grant a waiver on the shared bathrooms , Mr. Valar would be willing to accept a restriction limiting the waiver to the duration of his ownership. BOARD ACTION: Mr. Tieso moved that a waiver of St. Paul Legislative Code provision pertaining to shared bathrooms be granted until such time as the property might be sold or any other right, title, or interest be transferred, on condition that all work designated in the Survey Letter of 1/19/77 be completed on a time schedule approved by the Code Enforcement Division. APPEARANCE: Ray McIntyre PROCEEDINGS: . Mr. McIntyre explained that he and his sister had been keeping up their mother' s property. The mother was 87 years old and no longer able to care for the b uilding, although she was still resident of one of the units . He said the buiiding had originally been constructed as a duplex but had later been converted into a rooming house . In order to add one bathroom, it was necessary to place �e b ath and sink in one room and the water closet in an adj acent claset space where there was no raom for a handsink. Chairman Wozniak asked Mr. McIntyre if he inten ded to comply with all other requirements listed in the Survey Letter of l/26/76. Mr. McIntyre replied in the affirmative, stating that the matter of the handsink was the only item on which he was requesting a waiver. Busse � (3 units) SUBJECT: Request Waiver of St. Paul Legislative Code, Section 54. 11 , pertaining to hand sinks in bathrooms of two units , because of lack of space and high cost. APPEARANCE: Alvin E . Busse PROCEEDINGS: Mr. Busse explained that his building contained one full a�artment unit and two efficiencies . His appeal involved only the efficiencies , each of which lacked a hand sink in the bathroom. Each efficiency had one occupant only. He said there was no space in the present bathroom arrangement for a hand sink unless a wall was knocked out to enlarge the room, which would be very costly. Mr. Glassman asl:ed if there were handsinks nearby that could be used, and Mr. Busse replied that the kitchen sinks were about 8 feet from the bathroom and could be used for sanitary purposes . � Chairman Wozniak asked about the other items listed in the Survey Letter. Mr. Busse said all of these had been taken care of. BOARD ACTION• Mrs . Peake moved that a waiver of the requirement of a hand sink in the same room with the water closet be granted.
