In the matter of hazardous buildings being
that two story frame dwelling and garage in the
City of Saint Paul known and described as 767-�9
St. Anthony and situated on those premises legally
described as Lot 15, Block 13, Butterfield Syndicate
Addition No, l, according to the plat thereof on file
and of record in the office of the Register of Deeds
in and for the County of Ramsey, State of Minnesota.
WHEREAS, pursuant to resolution, C. F. No. 268950, approved
April 28, 1977, a public hearing was scheduled for 10: 00 a.m. on
May 5, 1977, before the Council of the City of Saint Paul, said
hearing pertaining to the condition of the structures located at
767-69 St. Anthony, Saint Paul, Minnesota;
WHEREAS, upon facts presented at said hearing consisting of
photographs, inspection reports and the recommendation of the
Division of Housing and Building Code Enforcement it is found and
det�rmined by the City Council that accorc7ing to the records and
� files in the office of the Register of Deeds, the last record
owners of the above described property are Hazel V. Ellis and
James C. Ellis, Fee Owners, 767 St. Anthony Ave. , St. Paul,
Minnesota, 551Q4; that the Board of Water Commossioners, City of
Saint Paul, Minnesota, is a lien holder of rec�ed; and that
Northern States Power Company, 360 Wabasha � St., St. Paul,
Minnesota, is a lien holder of record; and that it is further
determined that the above described buildings constitute hazardous
buildings within the definition of Minnesota Statutes Section
463.15 for the following reasons:

a. The subject property was boarded up by the city on
January 21, 1976 and ,Tuly 13, 1976.
b. This building due to lack of proper maintenance and apparent
abandonment should be condemned and removed.
c. The conditions outlined above constitute a public hazard.
d. The owner has made no attempt to satisfactorily repair the
damage. -
e. The continued vacant and boarded up condition contributes
a blighting influence on the neighborhood;
now, th erefore, be it
RESOLVED, THAT in accordance with Minnesota Statutes Sections
463.15 through 463,26, and based upon the foregoing findings of the
City Council, the Council of the City of Saint Paul does hereby make
the following Order:
ORDER
l. The owners of the above described buildings shall make the
same safe and not detrimental to the public peace, health, safety and
welfare by having the said building and garage razed and the materials
therefrom removed from the premises within thirty (30) days from the
date of the service of this Order;
2. Unless such corrective action is taken to comply with this

Office of the Clerk of the District Court of Ramsey County, Minnesota
within twenty (20) days from the date of the service of this Order,
a Motion for Summary Enforcement of this Order to ra z e and remove the
said buildings will be made to the Ramsey County District Court;
3. In the event that the buildings are to be razed by the
City of Saint Paul pursuant to judgment of the District Court, all
personal property or fixtures of any kind which may unreasonably inter-
fere with the razing and removal of these buildings shall be removed
within ten (10) days from the entry of judgment; and if not so removed,
the City of Saint Paul shall remove and dispose of such personal
property and fixtures as provided by law;
� 4. If the City of Saint Paul is compelled to take any corrective
action herein, all necessary costs expended by the City will be assessed
against the above descri]aed real estate and collected as other taxes;
and be it
FURTHER RESOLVED, That a certified copy of this resolution and
incorporated ORDER herein be served upon the last record owners of the
above described property in the manner provided by law.
