ARTICI.E 5• The Tenant does hereby release, discharge and a�ree to i
indemnify, protect, defend and save h�rmless the lessor and the City of (
Saint Paul� Minnesota, from liability for ar�y co�t, dama�e, expense, in3ury, �
ox other casualty to ar�y person rrhomsoever or property whatsoever caused
- by or arising out of the Tenant's use and occup�.ncy of said premises; and
in addition, the Tenant shall flirnish a puUlic liabilii;y insurance policy
. to the Lessor in the amount of $300,000.00 bodily in�ury and $100,000
property da,mage, namin� the City of Saint Paul, Alinnesota, insured, prior
to the delivery of possession to the Tenr�nt.
ARTICLE 6. The Tenant sha11 not a11cn•r said premises to be occupied j
in whole, or in part, by any other party, and stiaLl not sublet the same
in whole or in part, nor assign this lease wii:hout, in each case, the
written consent of the Lessor; and the Tenant sYs�ll not permit any transfer
by operation of law of the Tenant's interesi; created hereby. The Tenant i
shall not permit ar�y mechanic's lien or encumbrances to be placed upon the ;
premises or ar�y pa,rt thereof.
ARTICLE 7. The Lessor shall have the right without notice to sell, S i
destroy, or othercaise dispose of ar�y personal property left on the premises �
by the Tenant after he has vacated or abandoned the leased premises, or
been evicted therei'rom.
ARTICT,E 8. The Tenant sha,ll be responsible fox the prompt payment
of all charges for public utilities and semi-public or private services
such as water, gas, electricity, sevrerage disposal, reflzse or ash removal,
snow removal, grass or weed cutting and any special service, including
- assessments and real property t�aces which are levied during the term of
this lease.
�� ARTICLE 9. The Tenant a,�rees to permit the Lessor or the Lessor's
employees, agents or contractors to enter said premises at all re�.sonable
time to inspect them or the adjacent I,essor's property to the west, or to
make repairs, alterations or improvements, or demolition of adjacent
building, or for ar�y such other purposes as may be deemed necessary by the
Lessor, the Tenant hereby vraiving any and a11 claims and demands for loss !'
- or damage, or dimution of rent on account thereaf, or on account of ar�y �
obstruction to sidewalks, entrances or windows.
ARTICLE 10. The Tena,nt agrees to xemove ar{y improvements including
but not limitecl to fencing and other improvements authorized pursuant to
ARTTCL�' 4 and leave the premises backfilled and rou�h�raded upon ninety
(90) days z•rritten notice by the Lessor to vacate the premises. However,
Lessor may at its option, retain such improvements and Tenant will not be
� required to backfill the premises upon vacation. Tenant hereby �raives a11
claims for relocation benefits of ar�y kind as a result of this ter�ancy.
This lease and a11 covenants and agreements herein contained shall be
binding upon and inure to the respective heirs, administrators, successors
and assigns of all the parties to this lease.

LEASE �
By this lease made this day of , 1977, by
and between the City of Saint Paul, a municipa]. c-orpor�ztian of the State �

� The Lessor, for and in consideration of the covenants and agreements here-
inafter made on the part of the Tenant, does hereby lease to the Tenant the �
� premises in the City of Saint Pa.ul, County of Ramsey, St;ate of Nlinnesota, ,

to be used sole�y for the purpose of paxking of vehicles owned or operated
by Tenant or its employees and, agents.
To have and to hold the sa�e for the term comnencin� on the

provided, that the Lessor or the Tenant ma.y terminate this lease upon ninety l

the sum of Three Hundred Dollars ($300.00) per month. The rental amount �

ARTICLE 2. The Tenant admits that no representation as to the condition
of the premises has been made by �:he Lessor which is not endorsed hereon,
and agrees that the Tenant will not alter, repa.ir or improve said prer�ises :
except for surf`a.cing and security fencing.
� ARTICLE 3. The Lessor and its A�ents shall. not be liable to the Tenant �
for arLy damage or injury to the Tenant or the Tenant's property occasioned
by the failure of the Lessor to keep said premises in repair, nor sha11 the �
Lessor be liable for any darr�.ges or injury arising f'rom any act, ommission �
or negligence of the Lessor's agents, servants or employees, all c].aims for ��
any such damage or injury bein� hereby expressly waived by the Tenant. j
� ARTICLE 4. The Tenant shal]. not make alterations in, or alterations �
to the leased premises without the written consent of the Lessor. The Tenant � �
shall keep the premises together with adjoining areas, alleys and sidewalks, �
in a clean and healthful condition and all sidewalks in front of, and along ;
said premises shall be cleared of ice and snow, and the Tenant shall comply '
with all Federal, State and Local Le.ws rrii:h regard to the use and condition ' E
