Hoelzel for the vacation of the Westerl,y 23 feet of Clark Street lying between the Easterly extension of the PTorth and South lines of Lot 1�+, Block 3, "Van Slyke & Lewis'" rearrangement of Humbi.rds Addition to St. Pa.ul. The petitioner desires the va.cation in order to enlarge the vacant property abutting to the west which is awned by the petitioner for the construction of a duplex. The subject portion of Clark Street is unimproved, 23 feet in width, extends to a length of 121.69 feet, comprising an area of 2,800 square feet. The abutting property is zoned Two Family Residential (RT-1). The Department of Public Works reports that the center 20 feet of the Clark Street right-of-wa�r between East Jessamine Avernze and East Geranium Avenue ha.s been improved as an alley section and the portion of Clark Street described in the proposed vacation adjoins the alley improvement and will have no detri- mental effect on same; also, the department reports the existence of storm and sanitary sewers in Clark Street and request a specific easement be retained, subject to certain restrictions. The Depa.rtment of Public Works ha.s no objections to the vacation subject to the retention of the above rbamed easement. The report from City Planning states that they find no objection to the vacation as petitioned. They advise, however, that the vacation as proposed would not accomplish the objective of the petitioner, name]�y to construct a duplex on the enlarged lot. Section 61.100 (pg. 55) of the Zoning Ord.inance requires a minimum lot size of 3,750 square feet of area and 30 feet in width per unit for the zoning district in which this lot is located. The enlarged lot size would be 6,932.7 square feet in area and 56.97 feet wide. In order to meet the minimum lot size requirements, the enlarged lot would have to be 61.64 feet wide, which would require a vacation width of 27.67 feet. In view of the foregoing, I recommend the vacation be approved. The petitioner, hawever, upon review of the report f`rom City Planning, may prefer to withdraw the petition; revise his development plans to conform to the new Zoning Ordina.nce; or appeal to the Zoning Boa.rd for the required variance permits. Should �the City Council, after formal public hearing on the matter, approve the vacation of the street as petitioned, I recommend that the follawing terms and conditions apply: 1. Hoelzel . as we have discussed, this vacation will not help the petitioner to accomplish his objective of constructing a duplex on the enlarged lot.
