b BE IT ENACT�D AY THE LEGISLATURE OF TNE STATE OF MINNESOTAs
7 � Section. 1 . IPUBLIC HOUSING AGENCY CREATE�1. ] There is
8 hereby created the public housing agency of the city ot
9 S�int Paul . The agency shall consist of seven com�+issianers
10 who sha11 be residents of the city. fiwo of the
li ����miss�oners shal ) be eubtic housinQ tenants, one
12 re�resenting etderly housing tenants and ane represent9ns7
13 tamity housing tenants. Commissioners sha11 be aDDO'�nted by
lu tht mayar with th� advice and consent of the citv cour+cil ,
15 The mayor sha1 ) consider a list of names submitted by thE
16 senior� execut � ve board in acaointin9 a commissioner to
17 �eoresent elderiy housinq tenants and shatl consider a iist
18 of names subm{ tted by the city—wide resident council in
19 avpointing a co�nmissioner to represent family housin�
20 tcnants, The five non—tenant commissioners initially
21 �ceointed sha11 be aonainted for one, two, three, fou� a�d
22 five—v�ar terms re3pectiveiv. � Thereafter the �on--tenant

1 commissioners shall be appointed far five--Year terms.• 7he
2 commissioner representing elderty housin9 tenants shalt be
3 anaointed for a two—year term. The commissioner
4 representing familY housing tenants shall be acoointed for a
� S three—vear term. Commissio�ers shall hold office ur�til
6 their successors have been avaointed and auatified. A
7 vecancv shail be filled in the same manner in which the
6 o�iginal appointment was made.
9 Sec. Z. [DEFIIvITI0NS.7 Unless the context clearty
1� indicates otherwise, the terms used in sections i to 4 shalt
11 have the meanin�s 91ven them in Minnesota Statutes, Sectjon

13 Sec. 3. IPQwERS AND DUTIES.� Except as vrovided in
14 sectton 4, the pubtic hausing agency shall have th� ppwers
15 necesSary or corrvenient to carry aut the purposes af
16 N; nneaota Statutes, Sections u62.415 to 462.581 and to
1T �rovide and mana9� housing faciiities a�d services for

18 versons of low and moderate incomei �ncludin9 the power :
19 { 1 ) To su� and be sued; to have perpetual successionf
20 an�J to make, amend and reeeat rutes not inconsistent with
21 1aw or city ordinance.
22 (2) To emeloy necessarv offiicers, apents and emp� OV��S�
�3 both permanent and tem�oraryr to aesis��ate their

24 aualifications, duties and compensatian� and to accept
Z5 trans�er of housing emptoyees from the housing and
26 redevetoament authoritY of the city of Saint Paul . Ail such
Z7 employees, except transfer emptoyees; shall be cover�d as
Z8 coordinated ►nembers of the public emcloyees retirement
z9 association,
30 (3) To lease� construct , r�construct , purchase, repair,
3� maintain, administer• and oc�erate existinq and future pubt � c
32 housing facilities, and proqrams providing housinfl and

8 contracts, debts, ooli�ations, existing cotlective '
9 bargaininp agreements and fringe benefit �1an affecting
14 employees transferred from the housin9 and redeyeloRment
11 authority of the citY ot Sain.t Paul � ano other duties
� 1z incurred by the housinq and rec�evelopment authoritY of the
13 city of Sai�t Pavl prior to the effective date of this act
lu relatfng to the authority ' s hausing progra:r shall be aSSUmed
15 and performed by the oubtic housing a�encY and sha11 not be
16 impaired by the adoption of sectians 1 to u.
17 Sec. 4,, Notwithstanding the provisions of any other
18 tawr the agency shall not have the power :
19 ( 1 ) To levy and collect taxes or special assessment�
20 with res�ect to anY existinA or future public housing,
21 t2) To make any final detefmination. bY rule or
22 otherwise, or ta expend any funds or° incur any obligatio�s
23 with rescect to o� for the aurpose of any construction, �
24 reconstruction, purchaser site selection� site dCQU� 51t �On♦
25 ctearance and preparation, or determinat �on of need for
26 public hcusing without approvai bv the city council ,
27 t3� To enact anv rule or regutationr aerfo�m any act �
28 expend any funds or incur any obiigation inconsistent with
29 1aw or city ordinan�e.
30 Sec. 5, fEFFECTIVE DQTE.I This act shall become
31 effective only after its avproval by a meJoritv of the
32 �ove�ning body of the tity of �Saint Pau1 and upon compliance
