Referred To Committee: Date Out of Committee By Date � WHEREAS,the City of Saint Paul and the Metropolitan Transit Commission have jointly agreed to the preparation of a preliminary engineering study for a Downtown People Mover system, and �i�tEREAS, a Joint Powers Agreement has been executed by the City of Saint Paul pursuant to Council File No. 268932, and WHEREAS, the Legislature for the State of Minnesota has ' approved funding for the Downtown People Mover study by the Metro- politan Transit Commission upon the conditon that the Joint Powers Agreementfpreviously approved�,be amended, and WHEREAS, the Council has reviewed the amended Joint Powers Agreement attached hereto, NOW,THEREFORE,BE IT RESOLVED that this Council does approve the c�anges made in the Joint Powers Agreems�t and does authorize the proper City officials to execute� the amended Agreement between the City of Saint Paul and the Metropolitan Transit Commission. Councilman Leonard Levine � 718 City Hall City Re: Downtown People Mover Dear Mr. Levine: It is my understanding that the Joint Powers Agreement is scheduled for consideration by the Economic Develop- ment Committee of the Council for Friday, June 10, 1977. According to House File No. 1610, dated May 20, 1977, the Legislature has mandated a change in the previously approved Joint Powers Agreement between the Metropolitan Transit Commission and the City of Saint Paul. Accord- ingly, I have attached a Resolution for Council considera- tion adopting an amended version of the Joint Powers Agreement. The changes that have been made are those included in the b ill passed by the Legislature which appropriated monies for use by the Metropolitan Transit Commission. The changes in abbreviated form are basically as follows: l. Paragraph 1 has been changed to reflect a new termination date, that of June 30, 1978. 2 . Paragraph 2 has been changed adopting the wording of the statute expanding the scope of work. 3. Paragraph 4 has been altered to delete the Administrator of the Metropolitan Transit Commission and substituting therefor the Commissioner of the Department of Transporta- tion, the Chairman of the Transportation Advisory Board of the Metropolitan Council, a member of the State Senate, and a member of the State House of Representatives. Paragraph 12 has been changed deleting what was veto power on the part of the Mayor for third party contracts. Instead, these third party contracts are to be approved by a majority of the Steering Committee. 5. Paragraph 14 specifies the Metropolitan Council as another reviewing agency of progress in the preliminary engineering study. It further provides the Metropolitan Council will submit an independent report of the study to the State Legislature and the Steering Committee. Mr. Schnarr, Downtown People Mover project manager, has informed me that copies of the �oint Powers Agreement will be provided to the members of your committee by his office.
