WHEREAS, the Tax Reform Act of 1976 provides tax incentives
for rehabilitation by owners of commercial or income producing
historic structures, tax penalties for those who demolish such
historic structures and replace them with new construction, and
tax benefits for charitable donations of partial property interests
for historic preservation purposes; and
WHEREAS, structures in locally designated districts are
eligible if the enabling statute and historic preservation ordi-
nance are certified by the Department of the Interior; and
WHEREAS, pursuant to Minnesota Statutes § 471.193, the Council
has established the Heritage Preservation Commission and empowered
the Commission to recommend sites to the Council for historic
�lesignation; and
WHEREAS, these tax consequences could stimulate the rehabili-
tation by private concerns of some of Saint Paul' s historic
commercial buildings and such stimulation would be an asset �tn
the City as a whole; now, therefore, be it
RESOLVED, by the Council of the City of Saint Paul that the
appropriate City officers are authorized and directed to submit
application for certification.

This letter is to notify you as the duly authorized representative that
Statute: Ord. � 16006 establishing the Saint Paul Heritage
Preservation Commission (approved May 19, 1976)
, has been certified by the Secretary of the Znterior as containing criteria
which will substantially achieve the purpose of preserving and rehabili-
tating buildings of historic sinnificance to the district or dist:icts
designated by or under the statute. �
This certification is made in accord with section 2I24 of the Tas Refor� Act
� � of �1976 (9G Stat.1519) and the regulatior.s far implemer.ting the sta[ute,
36 CFR 67.9 Certification of •State and Local Statutes. T�zis notification o£
certification in no way constitutes certificat�on of the significar_ce or or the
rehabilitations of individual structures within the district. Such requests
for certificatioris should be made in accord with 36 CFR 67.3 to 67.8.

Dear Sir:
I have reviewed the attached material requesting certificat3.on of
the Heritage Preservation Ordinance for Saint Paul, Minnesota. I - ;
hereby request certification of this ordinance in that it meets
the criteria set for such certification in the Tax Reforne Act of i
1975. This ordinance is in accordance with provisions established
by the Minnesota Legislature. The Saint Paul Ordinance provides
for the establishment of a Heritage Preservation Commission, �
specifies the make-up of that conanission, and outlines criteria �
to be employed in the designation of properties.
