The meeting was called to order at 10:31 a.m.
STAFF PRESENT: Lany Lueth, Public Works; A1 Czaia, Public Works
(Dana Rose presented photographs to Mr. Strathxnan, they were rehuned at the end of the
meeting.)
Dana Rose appeazed and stated he is appealing the assessment for the replacement of four
sidewalk panels at 504 Mississippi Boulevard. Mr. Rose said he does not recall receiving
notification from the City. If a notification letter was sent, Mr. Rose would have contacted the
Public Works department to discuss the repairs. Mr. Rose feels the work was unnecessary. The
repairs to the sidewalk do not match the e�sting sidewalk. The corner house has a five foot
sidewalk and the repairs were done to six feet. There aze other cracked sidewalk panels on the
block that were not repaired. The construction crew left tire tracks across the lawn and broke
branches off of the tree in the front yard. The lawn has since been repaired. There is not a
sidewalk in front of the last two houses on the block, unfortunately Mr. Rose did sign a petition
stating he supported not installing a sidewalk there. In 1999 the neighbors got together and
requested a full alley, with sewers. The outcome was a heavy assessment.
Mr. Strathman asked Mr. Rose, the main reason far the appeal is a possible notification enor and
some sidewalk panels on the block that were in need of repair were not repaired. Mr. Rose
responded that is correct.
A1 Czaia appeazed and stated in October 1998, a petition was signed by a neighbor at 570
Mississippi, requesting sidewalk repairs and the completion of the sidewalk at the end of the
block. In the Spring of 1999, an inspection of the block was completed and problematic panels
were discovered. A proposal was developed to complete the sidewalk at the end of the block,
however this was not completed because a petition was signed by numerous neighbors stating
their support against the construction. Some houses did nof receive notifica6on of sidewalk
repairs because there was not any work proposed in front of their home. Most of the work was
completed in front of 507 Mississippi Boulevard and 504 Mississippi Boulevard. The sidewalk
panels that were replaced in front of 504 Mississippi Boulevazd, were low, seitled and cracked.
Mr. Czaia said there are different things to look at when assessing cracked panels. Sidewalk
panels are not replaced only because they are cracked. The sidewalk panels in front of 504
Mississippi showed evidence of settlement, which relates to potential water ponding, ice build-up,
and improper drainage. A public hearing was held on June 23, 1999. Notification of sidewalk
reconshuction was sent out, by the Finance Department, to the proper homeowners.

In response to Mr. Strathman asked if there aze records that indicate a norice was sent. Mr. Czaia
responded the Finance Department maintains the records. However, Public Works does not
receive any copies. Mr. Czaia said typically the public heariiig notices are mailed two weeks prior
to the hearing. Nofices aze sent only to the houses that need sidewalk repairs. The sidewalk
work was completed in September, 1999. Mr. Czaia stated the sod damage was repaired by the
City, however, the broken tree branches aze the responsibility of the concrete company.
Approximately 27 feet of work was completed in front of 504 Mississippi Boulevazd, there is a
charge of $1038 per foot. The actual cost is shazed with the City. The homeowner is responsible
for half of the cost.
Mr. Strathman stated he questioned that proper notificafion was sent. However, the wark was
completed. If proper notification was sent, the home owner is responsible for the assessment. Mr.
Strathman requested that staff contact the finance department to confirm that notification was
sent. If there is evidence of improper notification Mr. Strathman will recommend deleting the
assessment.
The meeting was adjourned at 10:50 a.m., the recommendarion of the Legislative Hearing Officer
is pending until evidence of notification can be verified, the properiy owner will be contacted with
the final recommendation.
Mr. Strathman received verification from the Finance Department that proper noticed was mailed
to the appellant on June 4, 1999. Mr. Rose was contacted and informed of the recommendafion of
the Legislative Heazing Officer.
Gerry Strathman recommended approval of the assessment.

block that were not repaired. The construction crew left tire tracks across the lawn and broke
branches off of the tree in the front yard. The lawn has since been repaired. There is not a
sidewalk in front of the last two houses on the block, unfortunately Mr. Rose did sign a petition
stating he supported not installing a sidewalk there. In 1999 the neighbors got together and
requested a full alley, with sewers. The outcome was a heavy assessment.
Mr. Strathman asked Mr. Rose, the main reason far the appeal is a possible notification enor and
some sidewalk panels on the block that were in need of repair were not repaired. Mr. Rose
responded that is correct.
A1 Czaia appeazed and stated in October 1998, a petition was signed by a neighbor at 570
Mississippi, requesting sidewalk repairs and the completion of the sidewalk at the end of the
block. In the Spring of 1999, an inspection of the block was completed and problematic panels
were discovered. A proposal was developed to complete the sidewalk at the end of the block,
however this was not completed because a petition was signed by numerous neighbors stating
their support against the construction. Some houses did nof receive notifica6on of sidewalk
repairs because there was not any work proposed in front of their home. Most of the work was
completed in front of 507 Mississippi Boulevard and 504 Mississippi Boulevard. The sidewalk
panels that were replaced in front of 504 Mississippi Boulevazd, were low, seitled and cracked.
Mr. Czaia said there are different things to look at when assessing cracked panels. Sidewalk
panels are not replaced only because they are cracked. The sidewalk panels in front of 504
Mississippi showed evidence of settlement, which relates to potential water ponding, ice build-up,
and improper drainage. A public hearing was held on June 23, 1999. Notification of sidewalk
reconshuction was sent out, by the Finance Department, to the proper homeowners.

In response to Mr. Strathman asked if there aze records that indicate a norice was sent. Mr. Czaia
responded the Finance Department maintains the records. However, Public Works does not
receive any copies. Mr. Czaia said typically the public heariiig notices are mailed two weeks prior
to the hearing. Nofices aze sent only to the houses that need sidewalk repairs. The sidewalk
work was completed in September, 1999. Mr. Czaia stated the sod damage was repaired by the
City, however, the broken tree branches aze the responsibility of the concrete company.
Approximately 27 feet of work was completed in front of 504 Mississippi Boulevazd, there is a
charge of $1038 per foot. The actual cost is shazed with the City. The homeowner is responsible
for half of the cost.
Mr. Strathman stated he questioned that proper notificafion was sent. However, the wark was
completed. If proper notification was sent, the home owner is responsible for the assessment. Mr.
Strathman requested that staff contact the finance department to confirm that notification was
sent. If there is evidence of improper notification Mr. Strathman will recommend deleting the
assessment.
The meeting was adjourned at 10:50 a.m., the recommendarion of the Legislative Hearing Officer
is pending until evidence of notification can be verified, the properiy owner will be contacted with
the final recommendation.
Mr. Strathman received verification from the Finance Department that proper noticed was mailed
to the appellant on June 4, 1999. Mr. Rose was contacted and informed of the recommendafion of
the Legislative Heazing Officer.
