is hereby amended as follows:

Dear Madam:
This is written in response to a petition by Helen Exner to rezone two lots on the
north side of Jefferson between Victoria and fNilton. This is a short form petition
asking that this property be rezoned from R-4 (Single Family Residential ) to B-3
(General Business District). There are two other petitions requesting a rezoning
to B-3 for this block. When one of these petitions came before the City Council
on August 25, 1977, the Council stated it would like to consider a business rezoning
of this block in a comprehensive manner.
This matter was heard by the Current Planning & Zoning Committee on October 20, 1977
at which time staff recomnended a rezoning to 6-1 (a Local Business District). A
motion was made by Ms. McGinley to recommend a rezoning to B-1 of the entire wedge
of land on the north side of Jefferson between Victoria and Milton. The motion was
seconded by Ms. Sumners and passed unanimously.
On October 28, 1977, the Planning Commission unanimously ratified the recorr�nendation �
of the Current Planning & Zoning Cornrnittee to recomnend rezoning to B-1 , on a motion
made by Mr. Hummer and seconded by Ms. Grittner.
This matter, along with the other outstanding petitions regarding property on this
block, is scheduled to be heard before the St. Paul City Council on NoVember 17, 1977.

HELEN EXNER (#8211 ) : A petition to rezone property on the nor.th side of Jef�erson
betw— een Tlictoria and Milton.
The petitioner was present. There was no opposition.
Mr. Warn read the staff report and showed slides of the subject site.
Mr. Fred Kueppers , attorney for Mrs. Exner, indicated the two lots were zoned commercial
until two years ago and they want to restore that situation by a 6-3 or at least B-2.
The same enterprise would continue. He indicated lots on the west are 6-2 and it would
assist in development of the whole strip to zone these B-2 and let practical develop-
ment take place at this site. In reply to Mr. Hummer's question he said the owner felt
B-2 would not be unacceptable, they were not changing their request but did not want to
close the door.
Decision on the matter was postponed until Jean Berman, the staff person who had
recommended a B-1 rezoning, arrived. She indicated that the rezoning of the other lots
had not yet occurred and the City Council has scheduled the.matter for hearing �to consider
this and the adjacent 1�ots at the same time.

Mrs. McGinley moved to recomnend approval to B-1 . The motion was seconded
by Mrs. Summers and carried by a roll ca 1 vote of 4 to 0.

A. SUFFICIENCY: The petitioner's request was filed on�a short form rezoning petition
subscri'be� and sworn to before a notary public on 8-23-77, and was received by the
City Planning Department on 9-1-77.
B. PROPOSED USE: Unspecified Commercial Activity
C. FRONTAGE & AREA: This site has an 80 ft, frontage on the nortF� sid� of Jefferson,
and is about 2,000 Sq, ft. in area. .
D. SITE CONDITIONS: The site contains two separate uses. The western 20 ft, of Lot 11
be ong to t e single family home immediately to the west. The eastern 20 ft. of Lot
11 and all of Lot 10 are occupied by a garage. The garage provides storage and
office space for an oil recovery business; tf�ey mop up oil spills. There is no oil
stored on the site, only empty barrels and equipment, This is presently an i11ega1
comrnercial use in a residential zone, as it 6egan after October 1975. However, the
business does not seem to be a disturbance. In addition to the single family home
to the west, the site is bounded by 35-E rigfit-of-way to the north and by vacant
property to the east.
E. AREA CONDITIONS: This site is located on a wedge of land between the 35-E right-of-way
to the north and a neighborhood of small , well maintained, single family homes to
the south. Two other zoning petitions are under consideration for this wedge of
land. The petitioner, Helen Exner, has asked that the 7 lots between Milton and
the subject site also be rezoned to a business classification. Clarence Kimmel ,
representing Continental Oil and Naegele Sign Company, has asked that the property
east of the subject site be rezoned to a business classification. The City Council
expressed a desire to consider this wedge of land comprehensi'vely ratF�er than with
piecemeal requests. This wedge of land is vacant except for tF�e single family home
and the storage garage. The Pleasant Avenue Traffic Corridor will i�ave an access
ramp at the corner of Jefferson and Victoria. There is a 6�l aone with an Applebaums
Supermarket two blocks east of the subject site. South of �efferson is a residential
area characterized by small single family f�omes. Monroe Higi� School and �its athletic
field are also in the vicinity. There are several small nonconforming commercial
uses. ,

F- FINDINGS:
1 . With the rear of this property butting up against the Pleasant Avenue
Traffic Corridor, it is unlikely that the property will be developed for
single family purposes.
2. There is no other B-3 property in the vicinity; the nearest commercial
land is zoned B-1 local business.
3. The development of the Pleasant Avenue Traffic Corridor will change the
character of this area as there will be more noise and an access ramp
will put more traffic onto Jefferson.
4. South of Jefferson is predominantly a residential area.
5. Because of its proximity to Linwood Park, billboards could not be
erected on this site.
G• STAFF RECOMMENDATION: Based on Findings #2 and #4 above, it is Staff's
op�nion that t is area is ill suited for a general business district and
should not be rezoned to B-3. Nowever, based on Findings #1 , #2, #3 and #5,
Staff recommends that a rezoning to B-1 be considered.

This is written in response to the petition of Helen Exner to rezone,
from R-4 to B-3, property located on the north side of Jefferson between
Milton and Victoria. Thia property is further described as follows:
Lots 12 through 18, Block 10, Ridgewood Park Addition.
This matter was heard by the Current Planning Committee on November 20,
1975. The reason for the requested zoning, as stated on the pekition,
is "to sell." Two neighbors appeared in opposition because of the
expected increase of noise and traffic that commercial uses could bring
to the area. After much discussion regarding permitted uses in the
OS-1, B-1 and B-3 districts, a motion was made to recommend denial of
the B-3 zoning, But instead, recommended rezoning to an OS-1 district.
The motion carried by a 4 to 1 vote.
The Planning Commission heard this matter at its meeting on December 19,
1975. The recommendation of the Current Planning �ommittee was approved
by a 17 to 2 vote.

MINUTES OF THE PUBLIC NEARING BEFORE THE CURRENT PLANNING C�IlriITTEE
ON THURSDAY, NOVEMBER 20, 1975, AT 8:00 P.M.
PKESENT: Messrs. Bryan, Hummer, Prifrel, Willits, and Rupp of the
Current Planning Committee; Mr. Sipkins, Assistant City
Attorney; Mr. McGuire and Miss Larson of the Planning
Department Staff.
EXNER, HELEN (7814) : A petition to rezone, from R-4 to B-3, property
located on the north side of Jefferson between Milton and Victoria.
The petitioner was present. There was opposition.
Mr. McGuire showed slides of the site and gave the staff report
recommending a spot zoning, as the relationship of this property with
respect to traffic corridors and access wi11 make it difficult to utilize
this property for any residential use.
Mr. Rupp asked Mr. McGuire to briefly explain what is allowed in a B-3
and in an OS-1 zoning district.
Mr. McGuire stated that a B-3 district is a general commercial category,
which allows restaurants, fast food operations, service stations--
virtually any type of commercial or retail use. He stated that an OS-1
district allows any office facilities for dentists, attorneys, doctors,
architects--any professional offices.
Mr. Fred Kueppers, attorney for the petitioner, came forward. He pointed
out that the petitioners are talking about the land from the home westward.
He stated that the petitioner also owns the home and the garage, as they
have for the last 30 years. He stated that the property from the service
station to Victoria has been zoned co�ercial, and that the request is to
extend that zoning to the freeway.
Mr. Rupp stated that the purpose of the rezoning was "to sell", as stated
in the petition. He asked Mr. Kueppers if he had any idea of who would
be purchasing the property.
Mr. Kueppers stated that he did not. He stated that the property is still
in probate. He stated that the children of Mary Exner, now adults, are
living in the home and are trying to get the property in saleable condition,
and will then seek out a buyer who will meet the standards that will then
affect the property.
Mr. Theodore Berquist, of 1045 Pleasant, came forward in opposition. He
asked if the property is being considered for cornnercial use or for
office use. .

Mr. Rupp stated that the request is for a commercial use and that the
staff is recommending a rezoning to office use.
Mr. Berquist stated that since the gas station was removed, it has
quieted down very much, and that since they already have an Applebaum's
grocery store, he would not like to see another grocery store in there,
as it will bring more traffic and noise. He stated that the Exners
used to own more property than is being considered for the xezoning,
which was sold to the Highway Department for the highway. He asked if,
when they sold the property to the Highway Department, they had the
option to sell all of the property, and if they did, why didn't they
sell it at that time.
Mr. Rupp stated that he did not know the answer to tha.t and that it is
not up to the committee to answer that question.
Mr. Willits read the PAC letter from the West Seventh Street Asaociation,
dated October 10, 1975, stating that they voted to support the petition
of Helen Exner.
Mrs. Berquist, of 1045 Pleasant Avenue, came forward in opposition of the
rezoning. She stated that she is not in favor of the petition because
she feels that a rezoning will bring in bad students from Monroe High
School, whom she feels ma.y burglarize their homes.
Mr. Rupp asked her if she was notified of the PAC group meeting.
Mrs. Berquist stated that she was infonned of the meeting, but that
she had not signed the petition beCause she was not in favor of the
rezoning. ,
Mr. Kueppers asked if he was correct in stating that, in a B-3 district,
since a restaurant, drive-in restaurant, or fast-food restaurant would
require a special use permit, tha.t a B-3 zoning would not necessarily
authorize those kinds of uses in that district.
Mr. McGuire stated that these are "special condition uses", and that they
must be approved by the Planning Commission even if the zoning is proper.
Mr. Prifrel asked why the ma.n living adjacent to the property was not
notified of the neighborhood group meeting.
Mr. Rupp stated that he did not know why the ma.n was not notified. He
stated that the neighborhood group may have ,just missed him in notifying
the property owners.
Mr. Hummer stated that this looks like a spot zoning and that where
Applebaums is located to the east, the zoning is B-1. He asked Mr.
McGuire if any consideration had been given to rezoning that whole strip,
all the way over to Applebaums, to B-1.

� Mr. McGuire stated that this could be regarded as a spot zoning. He
stated that in some places, spot zoning is appropriate to economically
utilize the property. He stated that the traffic conditions are such
that no form of residential zoning would be appropriate. .He stated that
he had not considered a B-1 zoning, as that zoning would permit a 7-11
type store with gas pumps, and that there are no controls on those
types of things in a B-1 district. He stated that this site is not
suited to commercial traffic that such use could generate 24 hours a
day.
Mr. Rupp asked James Hart, of HUD, if there hadn't been any suggestions
about building a residence on the edge of the freeway.
Mr. Hart stated that they must meet NEPA and anti-noise act requirements,
and that proximity to the freeway creates a problem, as a freeway
indicated a higher decibal sound levels, but that that has to do with
mortgages and not with co�nunity development.
Mr. Willits stated that if the property owner were to use the property
for a special use, that the public hearing would be a matter of formality.
He asked the City Attorney if the applicant complies with all of the
requirements, if he will be able to use it for a special use no matter
what the committee thinks.
Mr, Sipkins stated that was correct.
Mr. Willits made a motion that the Current Planning Committee deny the
request to rezone to B-3 and recommend a rezoning to OS-1.
Mr. Bryan seconded the motion and asked what the petitioner will have
to do if he does not agree with the committee's reco�nendation.

Mr. Sipkins stated that the petitioner can go befare the City Council
and plea that the committee's recommendation is improper.
Mr. Willits asked if the petitioner can change his petition.
Mr. Sipkins stated that because OS-1 is a more restrictive classification,
that he does not think that any problem would occur.
The motion to deny a B-3 zoning and recommend to the Planning Commission
that the Current Planning Committee recommends an OS-1 zoning was passed
by a vote of four to one, with Mr. Hummer voting in opposition.

A. SUFFICIENCY: In a letter dated September 15, 1975, the Director,
Department of Finance and Management Services, declared the petition
sufficient with the owners of 11 out of 15 eligible parcels having

B. HISTORY: There is no zoning history for the site.
C. PROPOSED USE: The purpose for the rezoning, as stated on the petition,
is "to sell."
D. FRONTAGE AND AREA: The site has a frontage of 305.15 feet on Jefferson
and an average depth of 105 feet, for an area of approximately 32,041
square feet.

E. SITE CONDITIONS: The site contains a single family home in fair condition
and a vacant garage-type structure. The site is bounded on the north by
elevated right-of-way for the proposed Interstate 35E.
F. AREA CONDITIONS: The area to the south is developed predominantly with
single family homes. An income tax service occupies the home directly
across the street from the subject site. A vacant service station site
adjoins the subject parcel to the end.
G. FINDINGS•
1. Due to the unused nature of this specific site, its utilization will
be at best difficult. The amendment proposed does not appear to
relate either to the existing use of the site or the areas i�ediately
adjacent.
2. Plans for future land use at this site called for low density
residential use. Owing to the unique relationship of this property
with respect to traffic corrfdors.and access, it will be difficult
to utilize the property for any residential use whatever.
. •
3. Zoning trends in this area do not appear to be established with
any clarity.
4. Because of the unique circumstances of the property previously
noted, it does not appear that the property will be useable if
some consideration is not given to redesignation of the property.
In our professional judgement, a spot zoning under these circumstances
is legitimate.
5. No development plan has been presented by the petitioner.

Dear Madam:
This is written in response to the petition of Helen Exner to rezone,
from R-4 to B-3, property located on the north side of Jefferson between
Milton and Victoria. This property is further described as follows:
Lots 12 through 18, Block 10, Ridgewood Park Addition.
This ma.tter was heard by the Current Planning Committee on November 20,
1975. The reason for the requested zoning, as stated on the petition,
is "to sell," Two neighbors appeared in opposition because of the
expected increase of noise and traffic that commercial uses could bring
to the area. After much discussion regarding permitted uses in the
OS-1, B-1 and B-3 districts, a motion was made to recommend denial of
the B-3 zoning, But instead, recommended rezoning to an OS-1 district.
The motion carried by a 4 to 1 vote.
The Planning Commission heard this matter at its meeting on December 19,
1975. The recommendation of the Current Planning Committee was approved
by a 17 to 2 vote.

8. STAFF INVESTIGATION & REPORT: Date: November 14, 1975 By: •
A. SUFFICIENCY: In a letter dated September 15, 1975, the Director,
Department of Finance and Management Services, declared the petition
sufficient with the owners of 11 out of 15 eligible parcels having
signed the petition.
B. HISTORY: There is no zoning history for the site.
C. PROPOSED USE: The purpose for the rezoning, as stated on the petition,
is "to sell."
D. FRONTAGE AND AREA: The site has a frontage of 305.15 feet on Jefferson
and an average depth of 105 feet, for an area of approximately 32,041
squa.re feet.
E. SITE CONDITIONS: The site contains a single family home in fair condition
and a vacant garage-type structure. The site is bounded on the north by
elevated right-of-way for the proposed Interstate 35E.
F. AREA CONDITIONS: The area to the south is developed predominantly with
single family homes. An incorne tax service occupies the home directly
across the street from the subject site. A vacant service station site
adjoins the subject parcel to the end.
G. FINDINGS•
1. Due to the unused nature of this specific site, its utilization will
be at best difficult. The amendment proposed does not appear to
relate either to the existing use of the site or the areas immediately
adjacent.
2. Plans for future land use at this site called for low density
residential use. Owing to the unique relationship of this property
• with respect to traffic corridors and access, it will be difficult
to utilize the property for any residential use whatever.
3. Zoning trends in this area do not appear to be established with
any clarity.
4. Because of the unique circumstances of the property previously
noted, it does not appear that the property will be useable if .
some considcration is not given to redesignatio� of the property.
In our professfonal judgement, a spot zoning under these circumstances
is legitimate.
5. No development plan has been presented by the petitioner.

MIN[TrES OF THE PUBLIC HEARING BEFORE THE CURRENT PLANNING COrII�IITTEE
ON THURSDAY, NOVEMBER 20, 1975, AT 8:00 P.M.
PRESENT: Messrs. Bryan, Hummer, Prifrel, Willits, and Rupp of the
Current Planning Committee; Mr. Sipkins, Assistant City
Attorney; Mr. McGuire and Miss Larson of the Planning
Department Staff.
EXNER, HELEN (7814) : A petition to rezone, from R-4 to B-3, property�.
located on the north side of Jefferson between Milton and Victoria.
The petitioner was present. There was opposition.
Mr. McGuire showed slides of the site and gave the staff report
recommending a spot zoning, as the relationship of this property with
respect to traffic corridors and access wi11 make it difficult to utilize
this property for any residential use.
Mr. Rupp asked Mr. McGuire to briefly explain what is allowed in a B-3
and in an OS-1 zoning district.
Mr. McGuire stated that a B-3 district is a general commercial category,
which allows res.taurants, fast food operations, service stations--
virtually any type of commercial or retail use. He stated that an OS-1
district allows any office facilities for dentists, attorneys, doctors,
architects--any professional offices.
Mr. Fred Kueppers, attorney for the petitioner, came forward. He pointed
out that the petitioners are talking about the land from the home westward. .
He stated that the petitioner also owns the home and the garage, as they
have for the last 30 years. He stated that the property from the service
station to Victoria has been zoned commercial, and that the request is to
extend that zoning to the freeway.
Mr. Rupp stated that the purpose of the rezoning was "to sell", as stated
in the petition. He asked Mr. Kueppers if he had any idea of who would
be purchasing the property.
Mr. Kueppers stated that he did not. He stated that the property is still
in probate. He stated that the children of Mary Exner, now adults, are
living in the home and are trying to get the property in saleable condition,
and will then seek out a buyer who will meet the standards that will then
affect the property.
. Mr. Theodore Berquist, of 1045 Pleasant, came forward in opposition. He
asked if the property is being considered for commercial use or for
office use.

Mr. Rupp stated that the request is for a commercial use and that the
staff is recommending a rezoning to office use. .
Mr. Berquist stated that since the gas station was removed, it has
quieted down very much, and that since they already have an Applebaum's
grocery store, he would not like to see another grocery store in there,
as it will bring more traffic and noise. He stated that the Exners
used to own more property than is being considered for the rezoning,
which was sold to the Highway Department for the highway. He asked if,
when they sold the property to the Highway Department, they had the
option to sell all of the property, and if they did, why �idn't they
sell it at that ti.me.
Mr. Rupp stated that he did not know the answer to that and that it is
not up to the co�nittee to answer that question.
Mr. Willits read the PAC letter from the West Seventh Street Association,
dated October 10, 1975, stating that they voted to support the petition
of Helen Exner.
Mrs. Berquist, of 1045 Pleasant Avenue, came forward in opposition of the
rezoning. She stated that she is not in favor of the petition because
she feels that a rezoning will bring in bad students from Monroe High
School, whom she feels may burglarize their homes.
Mr. Rupp asked her if she was notified of the PAC group meeting.
Mrs. Berquist stated that she was informed of the meeting, but that
she had not signed the petition because she was not in favor of the
rezoning.
Mr. Kueppers asked if he was correct in stating that, in a B-3 district,
since a restaurant, drive-in restaurant, or fast-food restaurant would
require a special use permit, that a B-3 zoning would not necessarily
authorize those kinds of uses in that district.
Mr. McGuire stated that these are "special condition uses" and that they
must be approved by the Planning Cbmmission even if the zoning is proper.
Mr. Prifrel asked why the man living adjacent to the property was not
notified of the neighborhood group meeting.
Mr. Rupp stated that he did not know why the man was not notified. He
� stated that the neighborhood group may have just missed him in notifying
the property owners.
Mr. Hummer stated that this looks like a spot zoning and that where
, Applebaums is located to the east, the zoning is B-1. He asked Mr.
McGuire if any consideration had been given to rezoning that whole.strip,
all the way over to Applebaums, to B-1.

Mr. McGuire stated that this could be regarded as a spot zoning. He
stated that in some places, spot zoning is appropriate to economically
utilize the property. He stated that the traffic conditions are such
that no form of residential zoning would be appropriate. He stated that
he had not considered a B-1 zoning, as that zoning would permit a 7-11 .
type store with gas pumps, and that there are no controls on those
types of things in a B-1 district. He stated that this site is not
suited to co�nercial traffic that such use could generate 24 hours a
day.
Mr. Rupp asked James Hart, of HUD, if there hadn't been any suggestions
about building a residence on the edge of the freeway.
Mr. Hart stated that they must meet NEPA and anti-noise act requirements,
and that proximity to the freeway creates a problem, as a freeway
indicated a higher decibal sound levels, but that that has to do with
mortgages and not with community development.
Mr. Willits stated that if the property owner were to use the property
for a special use, that the public hearing would be a matter of formality.
He asked the City Attorney if the applicant complies with all of the
requirements, if he will be able to use it for a special use no matter
what the committee thinks.
Mr. Sipkins stated that was correct.
Mr. Willits made a motion that the Current Planning Committee deny the
request to rezone to B-3 and recommend a rezoning to OS-1.
Mr. Bryan seconded the motion and asked what the petitioner will have
to do if he does not agree with the committee's recommendation.
Mr. Sipkins stated that the petitioner can go before the City Council
and plea that the committee's recommendation is improper.
Mr. Willits asked if the petitioner can change his petition.
Mr. Sipkins stated that because OS-1 is a more restrictive classification,
that he does not think that any problem would occur.
The motion to deny a B-3 zoning and recommend to the Planning Commission
that the Current Planning Committee recommends an OS-1 zoning was passed
by a vote of four to one, with Mr. Humcner voting in opposition.

Dear Madam:
This is written in response to the petition of Helen Exner to rezone property
located on the north side of Jefferson between Milton and Victoria from R-4
to B-3. This is a long form rezoning petition which was first heard by the
City Council in January 1976. At that time the Council voted to lay the matter
over about 2 months allowing the petitioner time to develop a more specific
proposal for the land.
On August 11 , 1977 the City Council heard a petition to rezone the corner
property two lots to the east of the Exners. At that time Council voted
to lay the matter over two weeks so these two petitions could be considered
in a comprehensive manner.
The Exners' petition, along with the petition for the corner property, is
scheduled to be heard before the St. Paul City Council on August 25, 1977.

This is written in response to the petition of Helen Exner to rezone,
from R-4 to B-3, property located on the north side of Jefferson between
Milton and Victoria. This property is further deacribed as follows;
Lots 12 through 18, Block 10, Ridgewood Park Addition.
This matter was heard by the Current Planning Committee on November 20,
1975. The reason for the requested zoning, as stated on the petition,
is "to sell." Two neighbors appeared in opposition because of the
expected increase of noise and traffic that commercial uses could bring
to the area. After much discussion regarding permitted uses in the
OS-1, B-1 and B-3 districts, a motion was made to recommend denial of
the B-3 zoning, But instead, recommended rezoning to an OS-1 district.
The motion carried by a 4 to 1 vote.
The Planning Commission heard this matter at its meeting on December 19,
1975. The recommendation of the Current Planning Committee was approved
by a 17 to 2 vote.

MINUTES OF THE PUBLIC HEARING BEFORE THE CURRENT PLANNING COMMITTEE
ON THURSDAY, NOVEMBER 20, 1975, AT 8:00 P.M.
PRESENT: Messrs. Bryan, Hummer, Prifrel, Willits, and Rupp of the
Current Planning Committee; Mr. Sipkins, Assistant City
Attorney; Mr. McGuire and Miss Larson of the Planning
Department Staff.
EXNER, I�LEN (7814) : A petition to rezone, from R-4 to B-3, property
located on the north side of Jefferson between Milton and Victoria.
The petitioner was present. There was opposition.
Mr. McGuire showed slides of the site and gave the staff report
recommending a spot zoning, as the relationship of this property with
respect to traffic corridors and access wi11 make it difficult to utilize
this property for any residential use.
Mr. Rupp asked Mr. McGuire to briefly explain what is allowed in a B-3
and in an OS-1 zoning district.
Mr. McGuire stated that a B-3 district is a general com�nercial category,
which allows restaurants, fast food operations, service stations--
virtually any type of commercial or retail use. He stated that an QS-1
district allows any office facilities for dentists, attorneys, doctors,
architects--any professional offices.
Mr. Fred Kueppers, attorney for the petitioner, came forward. He pointed
out that the petitioners are talking about the land from the home westward.
He stated that the petitioner also owns the home and the garage, as they
have for the last 30 years. He stated that the property from the service
station to Victoria has been zoned commercial, and that the request is to
extend that zoning to the freeway.
Mr. Rupp stated that the purpose of the rezoning was "to sell", as stated
in the petition. He asked Mr. Kueppers if he had any idea of who would
be purchasing the property.
Mr. Kueppers stated that he did not. He stated that the property is still
in probate. He stated that the children of Mary Exner, now adults, are
living in the home and are trying to get the property in saleable condition,
and will then seek out a buyer who will meet the standards that will then
affect the property.
Mr. Theodore Berquist, of 1045 Pleasant, came forward in opposition. He
asked if the property is being considered for comnercial use or for
office use. .

Mr. Rupp stated that the request is for a commercial use and that the
staff is recommending a rezoning to office use.
Mr. Berquist stated that since the gas station was removed, it has
quieted down very much, and that since they already have an Applebaum's
grocery store, he would not like to see another grocery store in there,
as it will bring more traffic and noise. He stated that the Exners
used to own more property than is being considered for the rezoning,
which was sold to the Highway Department for the highway. He asked if,
when they sold the property to the Highway Department, they had the
option to sell all of the property, and if they did, why didn't they
sell it at that ti.me.
Mr. Rupp stated that he did not know the answer to that and that it is
not up to the committee to answer that question.
Mr. Willits read the PAC letter from the West Seventh Street Association,
dated October 10, 1975, stating that they voted to support the petition
of Helen Exner.
Mrs. Berquist, of 1045 Pleasant Avenue, came forward in opposition of the
rezoning. She stated that she is not in favor of the petition because
she feels that a rezoning will bring in bad students from Monroe High
School, whom she feels ma.y burglarize their homes.
Mr. Rupp asked her if she was notified of the PAC group meeting.
Mrs. Berquist stated that she was informed of the meeting, but that
she had not signed the petition beCause she was not in favor of the
rezoning. .
Mr. Kueppers asked if he was correct in stating tha.t, in a B-3 district,
since a restaurant, drive-in restaurant, or fast-food restaurant would
require a special use permit, that a B-3 zoning would not necessarily
authorize those kinds of uses in that district.
Mr. McGuire stated that these are "special condition uses". and that they
must be approved by the Planning Commission even if the zoning is proper.
Mr. Prifrel asked why the man living adjacent to the property was not
notified of the neighborhood group meeting.
Mr. Rupp stated that he did not know why the ma.n was not notified. He
stated that the neighborhood group may have just missed him in notifying
the property owners.
Mr. Hunnner stated that this looks like a spot zoning and that where
Applebaums is located to the east, the zoning is B-1. He asked Mr.
McGuire if any consideration had been given to rezoning that whole strip,
all the way over to Applebaums, to B-1.

Mr. McGuire stated that this could be regarded as a spot zoning. He
stated that in some places, spot zoning is appropriate to economically
utilize the property. He stated that the traffic conditions are such
that no form of residential zoning would be appropriate. .He stated that
he had not considered a B-1 zoning, as that zoning would permit a 7-11
type store with gas pumps, and that there are no controls on those
types of things in a B-1 district. He 5tated that this site is not
suited to commercial traffic that such use could generate 24 hours a
day.
Mr. Rupp asked James Hart, of HUD, if there hadn't been any suggestions
about building a residence on the edge of the freeway.
Mr. Hart stated that they must meet NEPA and anti-noise act requirements,
and that proximity to the freeway creates a problem, as a freeway
indicated a higher decibal sound levels, but that tha.t has to do with
mortgages and not with comnunity development.
Mr. Willits stated that if the property owner were to use the property
for a special use, that the public hearing would be a matter of formiality.
He asked the City Attorney if the applicant complies with all of the
requirements, if he will be able to use it for a special use no matter
what the committee thinks.
Mr. Sipkins stated that was correct.
Mr. Willits made a motion that the Current Planning Committee deny the
request to rezone to B-3 and recommend a rezoning to OS-1.
Mr. Bryan seconded the motion and asked what the petitioner will have
to do if he does not agree with the committee's recott�nendation.

Mr. Sipkins stated that the petitioner can go before the City Council
and plea that the committee's recommendation is improper.
Mr. Willits asked if the petitioner can change his petition.
Mr. Sipkins stated that because OS-1 is a more restrictive classification,
that he does not think that any problem would occur.
The motion to deny a B-3 zoning and recommend to the Planning Commission
that the Current Planning Committee recommends an OS-1 zoning was passed
by a vote of four to one, with Mr. Hummer voting in opposition.

A. SUFFICIENCY: In a letter dated September 15, 1975, the Director,
Department of Finance and Management Services, declared the petition
sufficient with the owners of 11 out of 15 eligible parcels having
signed the petition.
B. HISTORY: There is no zoning history for the site.
C. PROPOSED USE: The purpose for the rezoning, as stated on the petition,
is "to sell."
D. FRONTAGE AND AREA: The site has a frontage of 305.15 feet on Jefferson
and an average depth of 105 feet, for an area of approximately 32,041
square feet.
E. SITE CONDITIONS: The site contains a single family home in fair condition
and a vacant garage-type structure. The site is bounded on the north by
elevated right-of-way for the proposed Interstate 35E.
F. AREA CONDITIONS: The area to the south is developed predominantly with
single family homes. An income tax service occupies the home directly
across the street from the subject site. A vacant service station site
adjoins the subject parcel to the end.
G. FINDINGS•
1. Due to the unused nature of this specific site, its utilization will
be at best difficult. The amendment proposed does not appear to
relate either to the existing use of the site or the areas immediately
adjacent.
2. Plans for future land use at this site called for low density
residential use. Owing to the unique relationship of this property
with respect to traffic corridors and access, it will be difficult
to utilize the property for any residential use whatever.

- 3. Zoning trends in this area do not appear to be established with
any clarity.
4. Because of the unique circumstances of the property previously
noted, it does not appear that the property will be useable if
some consideration is not given to redesignation of the property.
In our professional judgement, a spot zoning under these circumstances
is legitimate.

Dear Madam:
This is written in response to the petition of Continental Oil Company and
Naegele Advertising to rezone property on the northwest corner of Victoria
and Jefferson from R-4 (Single Family Residential ) to B-3 (General Business) .
This property is described as Lots 9 and 10, Block 1 , Slayton's Linwood
Park Addition. Naegele Advertising owns part of Lot 7 and all of Lot 8,
Block 1 , Slayton's Linwood Park Addition. Continental Oil owns Lots 9 and 10
of the same block and subdivision.
This matter was heard by the Current Planning and Zoning Committee on June 16,
1977 at which time Staff recommended that the petitioner's request be denied.
Staff further recommended that a rezoning to 6-1 be considered. However, the
petitioner did not consent to this. A motion to recommend denial of the
request for a rezoning to B-3 was made by Mr. Willits, seconded by Ms. Grittner,
and passed unanimously.
On June 24, 1977 the Planning Commission passed unanimously a motion made
by Mr. Hummer and seconded by Mr. Willits to recommend denial of this petition.
This matter is scheduled to be heard before the St. Paul City Council on
August 11 , 1977.

The Planning Comnission at its June 24 meeting took the following action:
AFPROVED the minutes of the June 10, 1977 meeting. Motion was made by
Mr. Prifrel . seconded by Mrs. Mayne and carried unanimously.
DENIED similar use determination requested by Marsha Skelton for property
located on the north side of Front Street between Chatsworth and Argyle.
Motion was made by Mr. Hummer, seconded by Mr. Prifrel and carried by a
roll call vote of 13 to 0.
DENIED to reconmend the rezoning of property on the northwest corner of
Victoria and Jefferson requested by the Continental Oil Company, and on
� the southv�st corner of Victoria Street and I-35E right-of-way requested
by Naegele Outdoor Advertising. Motion wa�s made by Mr. Hummer, seconded
by Mr. Willits and carried by a roll call vote of 13 to 0.
APPROVED, by a roll call vote of 12 to 0, a motion made by Mr. Humner,
seconded by Mr. Prifrel , recommending the rezoning requested by Clapp-
Thomssen Company on property located on the southwest corner of McKnight
Road and I-94.
APPROVED a special condition use permit for a fast food restaurant with.
parking for 50 cars on the northwest corner of Prosperity and E. Geranium
requested by Construction 70, Inc. Motion made by Mr. Hummer, seconded
by Mr. Sherwood and carried by a roll call vote of 13 to 0.
APPROVED, by a roll call vote of 13 to 1 , a motion made by Mrs. McGinley,
seconded by Mr. Pangal . to recomnend the rezoning of property located on
the north and south sides of Selby Avenue between Snelling and Fry
to a P-1 designation on the rezoning petition of Frank Horner Properties.

for denial , recommending that the applicant apply for B-3 rezoning on a
short form petition. The motion was seconded by Mr. Willits and passed on

2. SPIEGLER BROS. CONSTRUCTION C0. - Zonin File No. 8163: A request for
eterm�nation of par ing, requ�rements or an n oor comnercial tennis court
on the southwest corner of Homer & West 7th Street. A motion was made by
Mr. Nummer and seconded by Ms. Grittner to table the matter until the City
Attorney drafts an ordinance with a reasonable recommendation as to parking
requirements for public tennis courts. The mot9on passed on a unanimous
voice vote.
3. CONTINENTAL OIL COMPANY - Zoning File No. 8151 )
NAEGELE OUTOOOR ADVERTISING - Zoning File No. 8150 ) The petitions are for
rezoning from R-4 to B-3 the northwest corner of Victoria & Jefferson. A
motion for denial was made by Mr. Willits and seconded by Ms. Grittner. The
motion passed on a 6 to 0 roll call vote.
4. CLAPP-THOMSSEN COMPANY - Zonin File No. 8146: The petition is to rezone the
sout west corner o c nig t oa an - . motion to recommend denial by
Mr. Willits died for lack of a second. Mr. Humner then made a motion to
recommend approval . The motion was seconded by Mr. Sherwood and passed on
a 5 to 1 roll call vote, with Mr. Willits dissenting.
5. CONSTRUCTION 70, INC. - Zonin File No. 8149: The petition is for a special
con it�on use permit for a ast foo restaurant at the northwest corner of
Prosperity and Geranium. Mr. Hummer made a motion to recommend approval
of the special condition use permit providing the petitioner complies with

Ms. Berman showed slides of the sub�ect si�te and read the staff report.
Mr. Clarence Kimmel of C.P. Kimmel Company, representing Continental 011 and Naegele
Outdoor Advertising, said that each of the two companies owns a.:portion of the
property. He did not know how staff researched this property, but he did know they
did not go into it enough. He said 11 ft. of peat must be dealt with before anything
can be done. Mr. Kimmel said Naegele will not put any sign there as they have that as a
stipulation of the sale, and no petrol�um products will be sold there. No individual
� owners are interested in this land, Mr. Kimnel said, because they cannot afford the land
and the building. He said he needs an� investor who can build to suit a tenant,
and therefore he needs rezoning to B-3. He told of Monroe Migh School going to Junior
High next year, and said there is a saloon within � block, as well as Applebaums within
a block and also Exner. He said the other side is �ommercial , such as a woman there
who sells flowers.
Mr. Willits made a motion to recoanmend denial of the rezoning to B-3 as it would be a
spot zoning, inasmuch as there is no B-3 in that area. The motion was seconded by
Ms. Grittner and passed on a 6 �0 0 roll call vote.
