WHEREAS, The Burlington Northern, Inc. has agreed to convey
certain temporary easements to lands necessary for the Dale
Street widening from Minnehaha Avenue to Simon Avenue, to the
City of Saint Paul for the sum of $855.00, said sum to be paid
from P.I.R. Fund 60000-711-000 (L-7835) , to be reimbursed from
�Z.S.A. Funds; now, therefore, be it
RESOLVED, That the Council of the City of Saint Paul does
hereby accept the Temporary Easement to those lands more fully
shown on the attached map, hereto and made a part hereof by
reference, and the proper City officials are authorized to
record said easements in the proper office of recordation and
to pay to the Burlington Northern, Inc, the sum of $855.00.

tain, use, operate, relocate, reconstruct and renew such tracks and facilities
as it may at any tine, and from ti.me to time, desire within the limits af the

The foregoing easement is made subject to and upon the following expr�ss

line or lines, if any.

the removal, relocation or reconstruction of which may be made necessary by reason

:; 3. The Grantee shall, at its own cost and expense, make adjustment with
i industries or other lesse�s of Grantor for buildings or improvenents that may

z�° have to be relocated, reconstructed or destroyed by reason of the construction and
maintenance of said work area on said premises. �
}-; 4. All contracts between the Grantee and its contractors shall require the

contractors to protect the Grantor and any other railroad company including National
� Railroad Passenger Corporation (AI�iTRAK) occupying or using the Graxttor's right of

way or line of railroad against all loss and damages arising fram activities of the
contractors, their forces, or any of their subcontractors or agents; and shall fur-
ther provide that the contractors shall:
: A. Furnish ta the Grantor a railroad protective policy in the form pro-
�� vided by the FHPA4 6-6-2-2 dated October 25 1974 and an other
� , y pertinent instruc-
�- ` tions issued by the Federal Highway Administration, Department of Transportation.
� The limits of said policy shall not be less than Five Hundred Thousand Dollars

policy executed by a corporation qualified to wxite the same in the state in which
the work is to be performed shall be in form and substance satisfactory to the
Grantor, and shall be delivered to and approved by the Grantor prior to the entr}�
upon or use of its property by the contractors.
