The City of Saint Paul was issued a Storm Water Dischazge Permit from the Minnesota Po1luUon Control Agency
on December 1, 2000. Under the condi6ons of this pernut, the City is required to conduct a watershed education
program. The attached agreement is for the FMR to coordinate the 2001 and 2002 Storm Drain Stenciling
Education Program. FMR has been successfully coordinating the stenciling program since 1995. The cost of this
two yeaz agreement is $54,500. The annual cost is $21,720 in 2001 and $32,780 in 2002.

AGREEMENT
AN AGREEMENT, dated this of , 2001, by and between the
CITY OF SAINT PAUL, Minnesota, hereinafter called the "CITY" and Friends of the
Mississippi River, 46 East Fourth Street, Suite 606, Saint Paul, MN 55101, hereinafter
called "FMR".
WHEREAS, the CITY is in the process of conducting a Storm Drain Stenciling
Education Program; and
WHEREAS, the CITY desires to engage FMR to perform certain professional
services in accordance with this Agreement; and
WHEREAS, FMR desires to provide such professional services in accordance with
this Agreement;
NOW, THEREFORE, in consideration of the mutual terms and conditions, promises,
covenants, and payments hereinafter set forth, the C1TY and FMR agree as follows:
SECTION 1. Project Objectives The Storm Drain Stenciling Education Program is
designed to meet the following objectives:
— To stencil storm drains with the message "Please Don't Pollute - Drains to River,"
and distribute educational door hangers to residents and businesses in the
stenciled neighborhoods.
— To involve community residents in hands on learning experiences about urban
runoff pollution and ways to prevent it.
— To facilitate school service learning initiatives that include storm drain stenciling as
a key component.
SECTION 2. Scope of Services The CITY does hereby retain FMR to furnish
professional services. Specifically, FMR agrees to perform the following tasks associated
with Saint Paul's Storm Drain Stenciling Education Program:
Task 1. Meet pro�ct ob'�ctives Implement the following activities to meet the
project objectives:
— Identify and organize approximately 1,200 volunteers to stencil at least 2,800
storm drains and distribute 12,000 door hangers within the City of Saint Paul
during each year of the project.
— Provide a 30-minute education orientation to each volunteer group that
participates in the stenciling project.
— Provide an additional one-hour lesson on urban runoff pollution with school
students that participate in storm drain stenciling (approximately 40-50% of the
1,200 volunteers).

- Provide a training workshop for St. Paul teachers on storm drain stenciling and
water qualEty classroorr2 activities that complement the service project.
- Present three community workshops for city residents on urban runoff pollution
and ways to prevent it.
- Develop and implement an evaluation system to determine project effectiveness
- Coordinate the purchase, maintenance and storage of all stenciling supplies and
equipment.
Task 2. Staff Coordination Provide a coordinator to run the day-to-day operations oi
the project. This individual will have a good working knowledge of Saint Paul and the
range of volunteer groups. The FMR coordinator will carry out the project under the
direct supervision of the FMR Outreach Director.
Task 3. Project kick off meetina FMFt will schedule a project kick-off ineeting with
the CITY's project manager.
Task 4. Identify and recruit volunteer groups. Continue to build on the volunteer
base, which has been established in recent years. Outreach to schools,
neighborhood councils, scouts, service groups, summer youth projects, YM/WCA's,
corporations and other groups. Target schools that are interested in building an
educational unit around the stenciling project and/or who participate in teacher
workshops. Maintain a database of organizations and individuals involved in the
stenciling program..
Task 5. Train volunteers and grouo leaders Train volunteers and provide an
educational introduction to the project, including the goals and objectives of the
project, stenciling procedures and safety concerns. In some cases, volunteer
stenciling leaders will be identified and trained to lead stenciling parties throughout
the season.
Task 6. Coordinate stenciling logistics Coordinate organization and logistics for all
stenciling parties. This includes: providing street maps and stenciling kits to all
parties, tracking drains stenciled and door hangers distributed, and ensuring that the
activities are conducted in an efficient and safe manner.
Task 7. Provide service learning for school groups Schools that volunteer for storm
drain stenciling will receive additional classroom time with FMR staff. FMR will work
with approximately 18 Saint Paul classrooms each year and provide each class with
a one-hour lesson that reinforces the concepts of urban runoff pollution and ways to
prevent it. Hands-on education techniques will be employed in these lessons, and
teachers wi{1 be given additional activity ideas to incorporate into their science or
social studies curriculum.

Task 8. Teacher traininc�and supaort Work with Cairn and Associates to organize
and present a teacher workshop and provide ongoing support to teachers who
participate in the stenciling project in Saint Paul. Teacher training and support is
funded by the Met Councif for 200i and in the project budget 2002. Teacher training
and support includes:
- Revise, assemble and distribute a resource packet for teachers doing storm drain
stenciling to better connect the stenciling activity to classroom curriculum and the
Minnesota Graduation Standards.
- Plan, actively recruit for, promote and facilitate a workshop for 20 to 30 K-12
teachers in Saint Paul (public and private schools) during February of 2002. The
workshop wiil focus on ways to connect storm drain stenciling to curriculum and
Minnesota Graduation Standards. Teachers will receive substitute stipends
enabling them to attend.
- Provide ongoing support by phone, email and regular mail to Saint Paul teachers
interested in better connecting the storm drain stenciling to their classroom
curriculum and/or the Minnesota Graduation Standards.
Task 9. Community Workshops Plan, promote and organize three community
workshops designed to increase understanding by residents about urban runoff
issues. The workshops will focus on understanding the local watershed, non-point
source pollution, and ways to prevent pollution from residential homes and yards
from entering the storm sewer system. These workshops are funded by the Met
Council for 2001 and included in the project budget for 2002.
Task 10. Publicize stenciling events Generate publicity for at least two stenciling
groups or events each year. Metropolitan daily newspapers, TV news, and
community press wi11 be targeted.
Task 11. Proiect evaluation Develop a system to evaluate the effectiveness of
participating in stenciling. A pre and post test will be implement with a variety of
groups and a summary of results will be distributed to the Metro WaterShed Partners
and other interested groups.
Task 12. Equipment and supplies Coordinate the purchase and storage of stenciling
supplies. All supplies will be the property of the City of Saint Paul. A{imited number
of supplies are funded by the Met Council for 2001.
- A two-year supply of 300 stencils will be produced that read: "Please! Don't
Pollute! Drains to River."
- Paint for stenciling storm drains in Saint Paul will be purchased each year.
- Saint Paul currently owns 15 complete stenciling kits. The equivalent of five kits
will be purchased each year for replacement supplies. Each kit contains: 2 traffic
cones, 4 safety vests, 1 brush, 1 broom, 1 bucket, 1 clipboard, 4 pairs of goggles
and a box of disposable plastic gloves.

Task 13. Reports Submit written reports to Public Works on July 25"' and
October 30` of each year. interim reports to detail activities and accomplishments to
date as well as projected activities. Final report to include:
— A summary of stenciling events including group name, contact person and phone
number, location of stenciling, number of volunteers, number of storm drains
stenciled and the number of door hangers distributed.
— Copies of any media coverage and photos of a minimum of two stenciling events.
— An inventory of equipment and supplies.
— Recommendations for changes or improvements.
SECTION 3. Changes in Sco�e of Services The CITY or FMR may request
changes that would increase, decrease, or otherwise modify the "Scope of Services".
SECTION 4. Project Timeline The services to be rendered by FMR shall be
commenced upon execution of this agreement and completed by October 30, 2002.
SECTION 5. Delavs In the event there are delays caused by actions beyond the
control of FMR, which change the completion time, the CITY will grant to FMR reasonable
extensions of the contract time.
SECTION 6. Termination This Agreement may be terminated by the CITY or FMR
for any reason whatsoever, at any time, upon the receipt of written notice of termination by
either parry. Copies of all data, reports, programs and other written information prepared
by FMR prior to said termination shall become the property of the CITY and delivered to
the CITY. Such termination shall not affect any legal right of the CITY or FMR against
either party for any breach of this Agreement.
SECTION 7. Representative of CITY and FMR
(a) The CITY has designated Anne Weber to serve as manager of this Agreement,
who shall be responsible for a11 communications related to the day-to-day conduct of the
Agreement. The designated representative shall have the authority to transmit
instructions, receive information, and interpret and define the CITY'S policy and decisions
pertinent to the work covered by this Agreement.
(b) FMR has designated Irene Jones, FMR's outreach director, as the project
manager, who shall be authorized to act on behalf of FMR regarding all matters involving
the conduct of the performance pursuant to this Agreement.
SECTION 8. Billing and Payment
(a) In consideration for FMR'S faithful performance of this Agreement, the CITY will
reimburse FMR for services performed, as determined by the CITY'S representatives and
based on itemized statements. Statements to be submitted on April 25` and then with the
reports on July 25` and October 30`". Each invoice will be for approximately one-third of
the annual project costs. Payment shall be made within thirry (30) days after submission
of an invoice by FMR. The CITY shall pay FMR an amount not to exceed the lump sum
bid of Fifty-Four Thousand Five Hundred and 00/100 Dollars ($54,500). Annual project
costs are $21,720 in 2001 and $32,780 in 2002.

(b) In the event that conditions arise during the course of this Project that would alter
the scope of services described in this Agreement for which the C1TY would request
additional professional services, FMR must make a request for extra compensation for the
additional professional services. Upon Agreement between the CITY and FMR as to the
amount of such extra compensation when it has been determined that such an amount
exceeds the maximum amount mentioned above, a supplemental to this Agreement will
be entered into establishing the scope and extent of the additional professional services.
SECTION 9. Records and Dissemination of Information FMR agrees to maintain all
books, documents, papers, account records, and other evidences pertaining to work
performed under this Agreement in such a manner as will readily conform to the terms of
this Agreement and to make such material available at its office at all reasonable times
during the Agreement period and for five (5) years from the date of the final payment
under the contract for audit or inspection by the CITY or other duly authorized
representatives.
SECTION 10. Ownership of Documents All deliverable plans and reports that result
from FMR'S services under this Agreement shall become the property of the CITY after
final payment is made to FMR with no right, title, or interest in said plans or reports vesting
in FMR.
SECT{ON 11. Indegendent Contractor It is agreed by the parties that, at all times
and for all purposes with the scope of the Agreement, the relationship of FMR to the CITY
is that of independent contractor and not that of employee. No statement contained in this
Agreement shall be construed so as to find FMR an employee of the C{TY, and FMR shall
be entitled to none of the rights, privileges, or benefits of Saint Paul employees.
SECTION 12. Equal Opportunity Employment FMR agrees that it will abide by
Chapter 183 of the Saint Paul Legislative Code.
SECTION 13. Services Not Provided For No claim for services provided by FMR not
specifically provided for in this agreement will be honored by the CITY.
SECTION 14. Entire Agreement It is understood and agreed that the entire
Agreement supersedes all oral agreements and negotiations between the parties relating
to the subject matters hereof.

- Revise, assemble and distribute a resource packet for teachers doing storm drain
stenciling to better connect the stenciling activity to classroom curriculum and the
Minnesota Graduation Standards.
- Plan, actively recruit for, promote and facilitate a workshop for 20 to 30 K-12
teachers in Saint Paul (public and private schools) during February of 2002. The
workshop wiil focus on ways to connect storm drain stenciling to curriculum and
Minnesota Graduation Standards. Teachers will receive substitute stipends
enabling them to attend.
- Provide ongoing support by phone, email and regular mail to Saint Paul teachers
interested in better connecting the storm drain stenciling to their classroom
curriculum and/or the Minnesota Graduation Standards.
Task 9. Community Workshops Plan, promote and organize three community
workshops designed to increase understanding by residents about urban runoff
issues. The workshops will focus on understanding the local watershed, non-point
source pollution, and ways to prevent pollution from residential homes and yards
from entering the storm sewer system. These workshops are funded by the Met
Council for 2001 and included in the project budget for 2002.
Task 10. Publicize stenciling events Generate publicity for at least two stenciling
groups or events each year. Metropolitan daily newspapers, TV news, and
community press wi11 be targeted.
Task 11. Proiect evaluation Develop a system to evaluate the effectiveness of
participating in stenciling. A pre and post test will be implement with a variety of
groups and a summary of results will be distributed to the Metro WaterShed Partners
and other interested groups.
Task 12. Equipment and supplies Coordinate the purchase and storage of stenciling
supplies. All supplies will be the property of the City of Saint Paul. A{imited number
of supplies are funded by the Met Council for 2001.
- A two-year supply of 300 stencils will be produced that read: "Please! Don't
Pollute! Drains to River."
- Paint for stenciling storm drains in Saint Paul will be purchased each year.
- Saint Paul currently owns 15 complete stenciling kits. The equivalent of five kits
will be purchased each year for replacement supplies. Each kit contains: 2 traffic
cones, 4 safety vests, 1 brush, 1 broom, 1 bucket, 1 clipboard, 4 pairs of goggles
and a box of disposable plastic gloves.

Task 13. Reports Submit written reports to Public Works on July 25"' and
October 30` of each year. interim reports to detail activities and accomplishments to
date as well as projected activities. Final report to include:
— A summary of stenciling events including group name, contact person and phone
number, location of stenciling, number of volunteers, number of storm drains
stenciled and the number of door hangers distributed.
— Copies of any media coverage and photos of a minimum of two stenciling events.
— An inventory of equipment and supplies.
— Recommendations for changes or improvements.
SECTION 3. Changes in Sco�e of Services The CITY or FMR may request
changes that would increase, decrease, or otherwise modify the "Scope of Services".
SECTION 4. Project Timeline The services to be rendered by FMR shall be
commenced upon execution of this agreement and completed by October 30, 2002.
SECTION 5. Delavs In the event there are delays caused by actions beyond the
control of FMR, which change the completion time, the CITY will grant to FMR reasonable
extensions of the contract time.
SECTION 6. Termination This Agreement may be terminated by the CITY or FMR
for any reason whatsoever, at any time, upon the receipt of written notice of termination by
either parry. Copies of all data, reports, programs and other written information prepared
by FMR prior to said termination shall become the property of the CITY and delivered to
the CITY. Such termination shall not affect any legal right of the CITY or FMR against
either party for any breach of this Agreement.
SECTION 7. Representative of CITY and FMR
(a) The CITY has designated Anne Weber to serve as manager of this Agreement,
who shall be responsible for a11 communications related to the day-to-day conduct of the
Agreement. The designated representative shall have the authority to transmit
instructions, receive information, and interpret and define the CITY'S policy and decisions
pertinent to the work covered by this Agreement.
(b) FMR has designated Irene Jones, FMR's outreach director, as the project
manager, who shall be authorized to act on behalf of FMR regarding all matters involving
the conduct of the performance pursuant to this Agreement.
SECTION 8. Billing and Payment
(a) In consideration for FMR'S faithful performance of this Agreement, the CITY will
reimburse FMR for services performed, as determined by the CITY'S representatives and
based on itemized statements. Statements to be submitted on April 25` and then with the
reports on July 25` and October 30`". Each invoice will be for approximately one-third of
the annual project costs. Payment shall be made within thirry (30) days after submission
of an invoice by FMR. The CITY shall pay FMR an amount not to exceed the lump sum
bid of Fifty-Four Thousand Five Hundred and 00/100 Dollars ($54,500). Annual project
costs are $21,720 in 2001 and $32,780 in 2002.

(b) In the event that conditions arise during the course of this Project that would alter
the scope of services described in this Agreement for which the C1TY would request
additional professional services, FMR must make a request for extra compensation for the
additional professional services. Upon Agreement between the CITY and FMR as to the
amount of such extra compensation when it has been determined that such an amount
exceeds the maximum amount mentioned above, a supplemental to this Agreement will
be entered into establishing the scope and extent of the additional professional services.
SECTION 9. Records and Dissemination of Information FMR agrees to maintain all
books, documents, papers, account records, and other evidences pertaining to work
performed under this Agreement in such a manner as will readily conform to the terms of
this Agreement and to make such material available at its office at all reasonable times
during the Agreement period and for five (5) years from the date of the final payment
under the contract for audit or inspection by the CITY or other duly authorized
representatives.
SECTION 10. Ownership of Documents All deliverable plans and reports that result
from FMR'S services under this Agreement shall become the property of the CITY after
final payment is made to FMR with no right, title, or interest in said plans or reports vesting
in FMR.
SECT{ON 11. Indegendent Contractor It is agreed by the parties that, at all times
and for all purposes with the scope of the Agreement, the relationship of FMR to the CITY
is that of independent contractor and not that of employee. No statement contained in this
Agreement shall be construed so as to find FMR an employee of the C{TY, and FMR shall
be entitled to none of the rights, privileges, or benefits of Saint Paul employees.
SECTION 12. Equal Opportunity Employment FMR agrees that it will abide by
Chapter 183 of the Saint Paul Legislative Code.
SECTION 13. Services Not Provided For No claim for services provided by FMR not
specifically provided for in this agreement will be honored by the CITY.
SECTION 14. Entire Agreement It is understood and agreed that the entire
Agreement supersedes all oral agreements and negotiations between the parties relating
to the subject matters hereof.

AN AGREEMENT, dated this of , 2001, by and between the
CITY OF SAINT PAUL, Minnesota, hereinafter called the "CITY" and Friends of the
Mississippi River, 46 East Fourth Street, Suite 606, Saint Paul, MN 55101, hereinafter
called "FMR".
WHEREAS, the CITY is in the process of conducting a Storm Drain Stenciling
Education Program; and
WHEREAS, the CITY desires to engage FMR to perform certain professional
services in accordance with this Agreement; and
WHEREAS, FMR desires to provide such professional services in accordance with
this Agreement;
NOW, THEREFORE, in consideration of the mutual terms and conditions, promises,
covenants, and payments hereinafter set forth, the C1TY and FMR agree as follows:
SECTION 1. Project Objectives The Storm Drain Stenciling Education Program is
designed to meet the following objectives:
— To stencil storm drains with the message "Please Don't Pollute - Drains to River,"
and distribute educational door hangers to residents and businesses in the
stenciled neighborhoods.
— To involve community residents in hands on learning experiences about urban
runoff pollution and ways to prevent it.
— To facilitate school service learning initiatives that include storm drain stenciling as
a key component.
SECTION 2. Scope of Services The CITY does hereby retain FMR to furnish
professional services. Specifically, FMR agrees to perform the following tasks associated
with Saint Paul's Storm Drain Stenciling Education Program:
Task 1. Meet pro�ct ob'�ctives Implement the following activities to meet the
project objectives:
— Identify and organize approximately 1,200 volunteers to stencil at least 2,800
storm drains and distribute 12,000 door hangers within the City of Saint Paul
during each year of the project.
— Provide a 30-minute education orientation to each volunteer group that
participates in the stenciling project.
— Provide an additional one-hour lesson on urban runoff pollution with school
students that participate in storm drain stenciling (approximately 40-50% of the
1,200 volunteers).

- Provide a training workshop for St. Paul teachers on storm drain stenciling and
water qualEty classroorr2 activities that complement the service project.
- Present three community workshops for city residents on urban runoff pollution
and ways to prevent it.
- Develop and implement an evaluation system to determine project effectiveness
- Coordinate the purchase, maintenance and storage of all stenciling supplies and
equipment.
Task 2. Staff Coordination Provide a coordinator to run the day-to-day operations oi
the project. This individual will have a good working knowledge of Saint Paul and the
range of volunteer groups. The FMR coordinator will carry out the project under the
direct supervision of the FMR Outreach Director.
Task 3. Project kick off meetina FMFt will schedule a project kick-off ineeting with
the CITY's project manager.
Task 4. Identify and recruit volunteer groups. Continue to build on the volunteer
base, which has been established in recent years. Outreach to schools,
neighborhood councils, scouts, service groups, summer youth projects, YM/WCA's,
corporations and other groups. Target schools that are interested in building an
educational unit around the stenciling project and/or who participate in teacher
workshops. Maintain a database of organizations and individuals involved in the
stenciling program..
Task 5. Train volunteers and grouo leaders Train volunteers and provide an
educational introduction to the project, including the goals and objectives of the
project, stenciling procedures and safety concerns. In some cases, volunteer
stenciling leaders will be identified and trained to lead stenciling parties throughout
the season.
Task 6. Coordinate stenciling logistics Coordinate organization and logistics for all
stenciling parties. This includes: providing street maps and stenciling kits to all
parties, tracking drains stenciled and door hangers distributed, and ensuring that the
activities are conducted in an efficient and safe manner.
Task 7. Provide service learning for school groups Schools that volunteer for storm
drain stenciling will receive additional classroom time with FMR staff. FMR will work
with approximately 18 Saint Paul classrooms each year and provide each class with
a one-hour lesson that reinforces the concepts of urban runoff pollution and ways to
prevent it. Hands-on education techniques will be employed in these lessons, and
teachers wi{1 be given additional activity ideas to incorporate into their science or
social studies curriculum.
