PINK - FINANCE t CANARV - DEPARTMENT GITY OF SAINT PAUL 1 BLUE - MAVOR Flle NO• � uncil Resolution Presented By Referred To Committee: Date Out of Committee By Date RESOLVED, By the Council of the City of Saint Paul pursuant to the provisions of Ordinance No. 15006, and pursuant to the provisions of Minnesota Session Laws . 1975, Chapter 261, and pursuant to the provisions of applicable City labor contracts that in respect to each item of severance pay provided to be paid by said provisions • on account of separation from employment with the City which occurred in the years of 1972, 1973, 1974, 1975 and 1976, save any such separation which may have occurred in any of the said years by reason of death of any eligible employee, the same may be paid either in full or paid upon a deferred annual installment payment p1an, and that the determination of the manner of payment of such severance pay shall be at the election of the separated employee; �nd, be it FURTHER RESOLVED, That should the separated employee elect to receive the severance pay by deferred payment, such deferred payments shall be made annually in the amount of $800.00 or one.�fifth of the total amount of severance pay granted under the provisions of Ordinance No. 15006, as amended, whichever is less; and, be it FINALLY RESOLVED, That auch payments be made on or after February 7, 1977, or as soon thereafter as it may be convenient for the proper City officials to make such payments thereon, and in the case of the deferred payment method the successive annual installments not in excess of $800.00 sha11 become due and payable on or after the 3rd day of February in each succeeding year to the extent, and only to the extent, that it shall be necessary to effect the payment of the total severance pay amounts in each particular case without interest. Mattson SUBJ : Severance Pay Procedure and Enabling Council Resolution Pursuant to Minnesota Statutes , City of Saint Paul Ordinance No. 15006 and the provisions of applicable labor contracts , we annually submit a Resolution to the City Council to pro- vide for payment of severance pay to persons who have separated from City employment. In the past, such a Resolution would provide for the severance payment in five annual (deferred) installments in the amount for which the employee qualified. One of the reasons for such installment payments was that the City did not have the resources to fully fund the total payment for severance pay. This year we do have an appropriation which is adequate to provide for total payment of severance pay and for that reason, did prepare a Council Resolution to permit such action rather than the previously used installment plan. However, after analysis and discussion, we have determined that the person who has been separated from City employment should have the option to select either the installment plan or the total pay- ment plan for distribution of severance pay. In this way, the separated employee can determine which plan is most appropriate for his or her particular economic circumstances . Attached is a Council Resolution which will permit the payment of severance pay by either the installment (deferred) payment plan or total payment plan, at the option of each separated employee.
