PETER STREET TO WABASHA STREET AND WABASHA STREET FROM KELLOGG BOULEVARD TO 120 FEET SOUTH OF THE CENTERLINE OF KELLOGG BOULEVARD IN ACCORDANCE WITH PLANS AND SPECIFI- CATIONS Sl16MITTED BY THE COUNTY AND APPROVED BY THE CITY OF SAI NT PAUL. THE COUNCIL OF THE CITY OF SAINT PAUL DOES ORDAIN: Section 1 That permission and authority are hereby granted to the County of Ramsey, Minnesota to construct, operate, and maintain porttons of the Ramsey County Adult Detention Center which encroaches into portions of City rights-of-v� of Kellogg Boulevard from St. Peter Street to Wabasha Street and Wabasha Street from Kellogg Boulevard to 120 feet south of the centerline of Kellogg Boulevard in accordance with Plans and Specifications submitted by the County and approved by the City of Saint Paul . The various types of encroachments are detailed and located as follows : a. Parking ramp beneath Kellogg Boulevard viaduct between St. Peter Street and pedestrian tunnel connecting Adult Detention Center and City Hall - Court House; b. Curtain wall to be located along the southerty edge of sidewatk as located under "b" above and to extend from approximately ele- vation 97 feet 8 inches City Datum to intersection of bluff at approximately elevation 50 feet 8 inches City Datum; d. Transformer and transformer pad located in Wabasha Street right- of-way at base of bluff approximately 17 feet east of Adult De- tention Center Building and centered approximately 116 feet south of the centerline of Kellogg Boulevard. Sect i on 2 That the Department of Public Works is hereby authorized to issue a permit to the County of Ramsey for the construction , operation , and maintenance of said Adult Detention Center upon and subJect to the following terms and conditions : a. That said permittee shall construct said Adult Detention Center entirely at its own expense, and those portions of said items to be constructed within City rights-of-vray shalt be constructed under the inspection and to the satisfactPon of the Department of Public Works in accordance with City approved Plans and Speci- fications on file in the Department of Public Works and identified as Pu61ic Works Project No. E-126Z ; b. That said permittee shall pay the costs of administration , engi- neering and inspection incurred by the Departnent of Public Works because of this undertaking; said costs are estimated as a sum of $300. 00 and shall be accounted for under Department of Public Works Project No. E-1262 ; c. That said permittee shall pay the cost of publication of this Ordinance and all resolutions passed in relation to said Ordinance; d. That said permittee expressly agrees and undertakes to fully in- demnify, hold harmless , and defend the City of Saint Paul , its agents , officers and employees from any and all damages , ctaims for damages , costs , charges , judgements , and expenses of every kind and nature arising and in qrowing out of the construction , operation, maintenance, presence , or removal of said Adult De- tention Center, and by the permissior� and authority granted herein; e. That said permittee shall remove said encroachments in a manner satisfactory to the Department of Public Works whenever, in the opinion of the City Council , the public necessities or the public interests requires such removal ; , �� . c3� ICQ 18� f. That said permittee shall not proceed with the construction unless and until said permittee shall have fully complied with the provisions regarding insurance and indemnification contained in the Department of Public Works , City of Saint Paui , "Standard Supplemental Specifications for Highway Con- struction" dated September 1 , 1976, Section Number 1305.2. For the purpose of this Ordinance, the aforesaid section of said Specifications shall be read as though the word "per- mittee" was substituted for the word "contractor," wherever the same appears therein. Section 1305.2 of the Department of Public Works , City of Sa�tnt Paul , "Standard Supplemental Specifications for Highway Construction" dated September 1 , 1976 is hereby incorporated herein by reference as fully and as completely as if set forth herein verbatim, with the ex- ception that "Proof of Insurance" shall be furnished the De- partment of Public Works ; g. That said permtttee expressly agrees to comply wPth Chapter 216 of the Saint Paul Legislative Code as amended pertaining to Street Obstructions ; h. That said permittee shall notify the Traffic Bureau of the Department of Public Works if the construction or maintenance of said Adult Detention Center shall make necessary the closing of Kellogg Qoulevard or Wabasha Street or any part thereof. All expenses incurred by the Traffic Bureau in furnishing, in- stalling, or removing barricades , signs and other traffic con- trol devices shall be paid by the permittee; i . That said permittee shall make no changes within City right-of- way from said plans on file in the Department of Public Works without the written permission of the Director of the Depart- ment of Public Works ; j. That said permittee shall furnish the Department of Public Works "As Built" Plans for all work carried out within the City rights- of-way or which affects structures located within City rights-of- way, as well as , a complete set of "As Built" Plans for the entire structure; k. That said permittee shall , prior to carrying out any structural repairs or major maintenance, on portions of the Adult Detention Center constructed by permission of this Ordinance or affect structures located within City rights-of-way, submit Plans and Specifications to the Department of Public Works for review and approval of such work. Upon completion of such structural re- pairs or maintenance work, plans showing "As Built" changes shall be furnished the Department of Public Works ; 1. That the Department af Publ i c Works retains the right of access through the parking ramp for the purpose of, but not limited to, the tnspection, maintenance, or construction of the Kellogg Boulevard viaduct and retaining wall beneath the Kellogg Boulevard; n. That said permittee shall coordinate all work involving existing utility installations, private or public, with the affected utility company or agency; o. That said permittee shall , within the period of 20 days after the publication of this Ordinance, file with the City Clerk its written acceptance of this Ordinance and agreement to be bound by all the provisions , te rms , and conditions thereof without limitation which written instruments of acceptance and agreement shalt be in a form approved by the City Attorney.
