WHEREAS, the Council of the City of Saint Paul by its
resolution C. F. 264830, as amended by C. F. 264995, vacated
portions of Aurora Avenue, Fuller Avenue and Kent Street,
said vacation reserving to the City and other public instru-
mentalities the public utility easements contained therein;
and
WHEREAS, the Council of the City of Saint Paul by its
resolution C.F. 264292 vacated portions of Fuller Avenue,
Ma.ckubin Street, Kent Street, Arundel Avenue and public alley
in Blocks 4, 6, 9 and 28, Ma.ckubin and Marshall' s Addition,
said vacation reserving to the City of Saint Paul and other
public instrumentalities the public utility easements contained
therein; and
WHEREAS, the Housing and Redevelopment Authority of the City
of Saint Paul, Minr�esota, has requested that the City Council
waive said retained easements and the affected City departments,
Northern States Power Company and Northwestern Bell Telephone
Company have filed written certificates of intended non-use of
reserved rights and easements, which certificates are on file
in the off ice of the City Clerk; now, therefore, be it
RESOLVED, That the Council of the City of Saint Paul,
pursuant to Section 228.06 of the Saint Paul Legislative Code,
as amended, does hereby waive all the retained easements con-
tained in Resolution C. F. 264830 as amended by resolution
C.F. 264995, and also, such retained easements co�tained in
Resolution C.F. 264�92, in the following described portitms
of streets and public alleys:

c) That the new easements which are to be
granted and the new main which is to be
constructed, all at the expense of the
petitioner, are described as follows :
1. A new 6-inch water main is to be con-
structed from Fu1Zer Avenue to University
Avenue approximately along the aligrunent
of the blue line as shown on the attached
map.
2. The new 6-inch water main must be in-
s�alled before the existing mains within
the vacated streets will be abandoned.
3. The required easement for the new 6-inch �
water mains is to be a minimum of 3Q feet
wide with the new water main centered with-
in the aasement. The approximat�. easement
alignment is shown as the area shaded red
on the attached map. The alignment of the
proposed easement must be determined jointly
between the Water Utility and the petitioner
prior to the granting and recording of the
easement. The easement must be granted and
recorded prior to construction of the new
water main .
d) That the easements which are to be retained in the
vacated streets are described as follows :
1. Aurora Avenue: a 30 foot easerctent centered
