THE COUNCIL OF THE CITY OF SAINT PAUL DOES ORDAIN:
Section l.
That the Zoning Map of the City of Saint Paul, Sheet No. 20,
as incorporated by reference in Section 60.401 of the Saint Paul
Legislative Code, is hereby amended as follows:
The property owned by the Housing and .Redevelopment
Authority of the City of Saint Paul located in the vicin-
ity of Kent Street and Aurora Avenue, more particularly
described in the Exhibit A attached hereto and incorporated
by reference herein, is rezoned from RM-1 to B-3.
Section 2.
This ordinance shall take force and effect in thirty (30) days
from and after its passage, approval and publication.

Dear Councilman Levine:
Attached hereto is a recommendation by the Planning Com-
mission to the City Council to rezone certain property,
owned by the H.R.A. , from RM-2 to B-3. Although the parcels
to be rezoned are quite small in area, a 40-acre study was
required because of the extensive H.R.A. ownership in the
surrounding area, the so-called "contiguous property" rule
of Minnesota Statutes, Section 462.357, and consequent im-
practicalaty of obtaining "consents. "
As I understand it, the H.R.A. has been awaiting this rezon-
ing prior to beginning work on the Unidale Center project,
of which this is a part.
Please forward this material to the City Clerk for the set-
ting of a public hearing on the proposed rezoning, and I
will prepare the necessary ordinance upon your request. If
you have any questions, please do not hesitate to call.

Attached, per our conversation of last week, is a copy of the
Certificate of Survey furnished by the Housing & Redevelopment
Authority to describe that portion of the property which was
the subject of a 40 acre study recommended for approval by the
Planning Commission at their regular meeting on December 17,
1976. We have also included copies of the Planning Commission
resolution, the legal notices and hearing procedures pursuant
to the 40 acre study.
We would request that you prepare an ordinance to change the
zoning in accordance with the 40 acre study and submit it to
Councilman Leonard Levine, Chairman of the City Development

WHEREAS, the Planning Commission of the City of Saint Paul has caused legal
notice of a public hearing to be published on November 26, December 3, and
December 10, 1976 pursuant to Minnesota Statutes 462.357 Subdivision 5, for
the purpose of amending the zoning boundary on certain property in the
vicinity of Kent Street and Aurora Avenue, and
WHEREAS, the Planning Commission has found that:
1 . An area of not less than forty acres, being the northeast quadrant
of the old Summit-University District, has been surveyed by the
Planning Commission within which the proposed area to be rezoned
is located;
2. That the number of real estate descriptions being affected by
such change, owing to the contiguous property provisions of the
Laws of Minnesota 1973, totals 852 parcels. Under the provisions
of Minnesota Statutes, signatures for 2/3, or 568 of these parcels
would be required and thus it is impractical to obtain written
consent for the requested rezoning;
3. That the Planning Commission finds the proposed rezoning related
to existing uses and to a plan for future land use in the area in
that it is a minor expansion of a commercial zone consistent with
the approved Neighborhood Development Program plan for the
Summit-University area (now Planning District #8);
NOW, THEREFORE, BE IT RESOLVED that the Planning Commission recomnends approval
of the requested rezoning of part of Lots 10, 11 , 12, 13, and 14, Block 4,
MacKubin and Marshall 's Addition to Saint Paul , from RM-2 Multi Family Residential
to B-3 General Commercial for the purpose of providing service access and loading
area for the proposed retail food outlet in the Uni-Dale Center project, in
accordance with the site plans on file in the Planning Department, and
BE IT FURTHER RESOLVED that the Planning Comnission hereby directs the Planning

A. History: Council File #265314 and Ordinance #15819 adopted May 1 , 1975 changed
the zoning in the northeast quadrant of the Summit University area to make it
consistent with the adopted Neighborhood Development Program (NDP) plan. At
that time the exact needs of the commercial lands for the Uni-Dale Center were
not established. Subsequent lease negotiation and development contracts make
it appear necessary to adjust the boundary slightly- in order to provide adequate
access to the commercial property for service of the Uni-Dale Center.
Because of the contiguous property law and the scattered ownership pattern of
the H.R.A. in the Summit University area, it has been determined that obtaining
consent petition signatures would be burdensome in that owners of 852 parcels
would be eligible. Owners of 568 of these parcels would have to sign the
petitions to make them valid. Some of the eligible parcels are nearly 3/4 of
a mile .from the subject site.
B. Area: The parcel to be rezoned has an area of 11 ,880 square feet and is
trapezoid shaped.
C. Pro osed Use: The area to be �rezoned is proposed for use as a service access
point to t e facilities of a major tenant of the shopping center.
D. Site Conditions: The site is currently vacant awaiting construction.
E. Area Conditions: The general area has been cleared except for a parsonage and
c urc es an is awaiting redevelopment. To the north along University Avenue
the land is zoned and used commercially.
F. Findin s Re uired Subse uent To Public Hearin :
1 . T e Plann�ng Commission s ould consider whether a survey of the whole area
of the City of Saint Paul or of an area not less than forty acres had
been conducted by the Commission within which the proposed area to be
rezoned was located.
2. Consideration must have been given as to whether the number of descriptions
of real estate affected by such changes and alterations render the
obtaining of written consent impractical .

Public hearing opened on the 40 Acre Study for the Unidale Shopping Center.
There being no one present in opposition to this matter, the public hearing
closed on a motion made by Mr. Pangal , seconded by Mrs. McGinley and
carried unanimously.
By RESOLUTION (76-78) recomnended approval of the requested rezoning of
parts of Lots 10, 11 , 12, 13 and 14, Block 4, Mackubin and Marshall 's
Addition to Saint Paul , from RM-2 to B-3 for the purpose of providing
service access and loading area for the proposed retail food outlet in
the Uni-Dale Center project, and forwarded to the Mayor and Council .
Motion made by Mr. Prifrel , seconded by Mr. Hanggi and carried by a roll
call vote of 15 to 1 .
APPROVED a motion made by Mrs. Mayne, seconded by Mr. Hanggi and carried
by a vote of 15 to 1 , to add an addendum to the resolution stating that
Aurora Street should be signed to prohibit movement of trucks to the
east of the proposed cul-de-sac when entering or leaving the designated
loading area.
