WHEREAS, the Department of Housing and Urban Development has notified
the City of Saint Paul that they intend to withhold between 1.8 and 2. 6
million dollars from the City's Community Development Year III Block Grant
entitlement to pay part of the principal and interest due on the NDP land
inventory; and .
WHEREAS, the extensive citizen participation and planning process which
has been developed in Saint Paul has resulted in the identification of the
need for many new programs, projects, and services in an amount far in excess
of the 18. 8 million dollars which is available; and
WHEREAS, it is also necessary to complete the many projects an� programs
started unc�er various HUD programs (Urban Renewal, NDP, Model Cities, and CD)
in Saii3t Paul; and
C�TsaL�EAS, the current Mayor and City Council (which is now also the HRA
Board) nave made a major commitment to development and rehabilitation programs,
with primary emphasis on the sale and development of the existing NDP land
inventory; and
W�iE��15, given the proven needs of the City for Community Development
funds and the strorig commitment of the Mayor and City Council to develop;nent
programs, including land disposition; and
WHEREAS, the withholding of the 1. 8 million dollars to 2.6 million
dollars at this time would severely jeopardize previous commitments made by
the Mayor and City Council and seriously disrupt the completion of citizen
planning efforts throughout the City; and
WHEREAS, a delay in withholding the 1. 8 to 2.6 million dollars until
Community Development Year IV would allow the City to maintain its commitments
and the integrity of the District Planning process; and

WHEREAS, the City of Saint Paul previously submitted a request for
Urgent Needs funding to HUD which was approved by the Area and Regional Office
of HUD, but was rejected by the HUD Washington Office for what we consider to
be invalid reasons; and
WHEREAS, the Urgent Needs funding, if granted, would have substantially
reduced the outstanding loan due HUD for the NDP land inventory.
NOW THEREFORE BE IT RESOLVED that the Council of the City of Saint Paul
does hereby direct and authorize the Mayor of the City of Saint Paul to
prepare an updated Urgent Needs application to be submitted to the Department
of Housing and Urban Development.
FURTHER RESOLVED, that the City of Saint Paul hereby strongly and
urgently requests the Department of Housing and Urban Development to delay
the final decision on withholding the amount of 1.8 to 2.6 million dollars
from the City's Community Development Block Grant Year III entitlement until
a fina� dEt�rmination on the City' s latest Urgent Needs request is received
from said Department.
FURTHER RESOLVED, that a copy of this Resolution shall be forwarded to
the appropriate officials of the United States Department of Housing and
Urban Development and the State of Minnesota United States Congressional
Delegation.

Secretary Harris has asked me to respond to your letter of
January 19 , 1977 , in which you attached a certified copy
of a resolution unanimously approved by the St . Paul ,
Minnesota City Council on January 13 , 1g77 . This resolution
requested a delay to the proposed withholding of 1 .8 to
2 .6 million dollars from the City ' s third year entitlement
until a final determination in the City ' s future urgent
needs request is made .
Pursuant to Section 570 .802 ( b ) of the Community Development
Block Grant regulations , the Secr�tary may after consultation
with the chief executive of the unit of general 1oca1
government and the local public agency , deduct up to twenty
percent of the funds made available under the program in
any fiscal year for application to the repayment of temporary
loans if the Secretary determines that the Federal financial
interest will not otherwise be sufficiently protected .
Accordingly , since July 3 , 1975 , the St . Paul Area Office has
been discussing with the appropriate local officials the
possibility that some type of arrangement would have to be
made to assure the repayment of the City ' s outstanding urban
renewal loan through either land sales , urgent needs or
Section 112 deductions from the City' s entitlement . In
fact , on May 11 , 1976 , former Mayor Cohen was notified by
the St . Paul Area Office that as the City' s second year
entitlement application was already prepared , without provision
for the repayment of the outstanding loan , the Area Office
would wait until the third year to request a minimum of 1 .8
million dollars from the City' s entitlement , in the absence
of land sales or urgent needs funds .

On June 4 , 1g76 , Mayor Lattimer was informed that because
it did not meet the criteria for funding established in
Section 570 .401( b ) ( 1) of the Regulations , the City' s Fiscal
Year 1976 urgent needs r�quest had been denied and restated
the position that 1 .8 to 2 .6 million dollars would , therefore ,
be required from . the City' s third year entitlement . Since
that time the St . Paul Area Office has been in contact with
the Housing and Redevelopment Authority on several occasions
regardin� this deduction which is authorized under Section
112 of the Housing and Community Development Act of 1974 .
I am further advised by the St . Paul Area Office that as a
result of all of the communication since May 11 , 1976 , the
only area of discussion remainin� between the Area Office
and the City' s Housin� and Redevelopment Authority regardin�
the deduction is the exact . amount from within the range of
1 .8 to 2 .6 million dollars . And on February 1 , 1977 ,
Mr . Patton , Director of the Redevelopment Authority , was
requested to meet with the Area Office immediately to determine
the specific amount which would be deducted .
Unfortunately , the timin� of the proposed deduction is beyond
the control of the Department for the most part . The deduction
is reflected on the program budget for each fiscal year which
is a part of the Block Grant application . The submission
of the application is determined . statutorily from the approval
of the City' s first program year . Additionally , it is not
likely that the Department ' s position on an earlier urgent
needs request will change regarding a new request as the
City' s 18 million dollar entitlement is more than adequate
to cover the alle�ed 2 .5 million dollar urgent need over
the three year base period . Therefore , the Department
cannot delay its proposed reduction for the reasons cited
in the City ' s resolution .
