WHEREAS, Mr. James P. LaBosco, d/b/a "Racquel' s Rap",
is the holder of Motion Picture Theatre License No. 8293,
expiring Ma.rch 22, 1977, under Saint Paul Legislative Code
�@ 372.01- .09, for the premises located at 489 W. Seventh
Street in Saint Paul; and
WHEREAS, upon the recommendation of the License Inspector
that the license should be revoked, the licensee was notified
by letters dated December 15, 1976 and December 21, 1976 that
he would be entitled to a hearing before the License Committee
on January 5, 1977, at 9:00 a.m. in Room 707 of the City Hall,
at which hearing he could appear and be represented by counsel,
and present evidence; and
WHEREAS, such letters, containing detailed notice of the
grounds upon which the License Inspector based his recommen-
dation, were addressed to the licensed place of business at
489 �,1. Seventh Street, by certified mail with return receipts
acknowledging receipt at the premises; arid
WHEREAS, the grounds for the recommendation of revocation
were given in the two letters, as follows:
(1) April 20, 1976 - Failure to properly and/or
completely answer questions 9 and 11 of your
application for movie theatre license.
(2) April 21, 1976 - September 18, 1976 - and
December 9, 1976 - Allowing and/or permitting
fema.le employees of Racquel' s to use the
premises at 489 West 7th Street to engage in ���

solicitation and/or acts of prostitution.

(3) April 23, 1976 - Causing and/or permitting to
be caused an incident on the premises at 489 West
7th Street which resulted in your (James LaBosco)
arrest and conviction for disorderly conduct.
(4) August 11, 1976 - Lack of truthfulness on the
part of the licensee (James LaBosco) in his
testimony before the License Committee.
(5) November 8, 1976 - Police officer observed a nude
man sitting in a movie viewing room next to a
fema.le employee clothed only in panties and a
see-through top.
(6) November 10, 1976 - Police officers seeking to
ma.ke a routine investigation of the licensed
premises were refused p�rmission.
(7) December 15, 1976 - Allowin� and/or permitting
female employees of Racquel s to use the premises
at 489 West 7th Street to engage in solicitation
and/or acts of prostitution. ,
(8) December 16, 1976 - Allowin� and/or permitting
female employees of Racquel s to use the premises
at 489 West 7th Street to engage in solicitation
and/or acts of prostitution; and
WHEREAS, the licensee did not appear at the hearing, nor
did counsel ma.ke any appearance in the licensee' s behalf; and
WHEREAS, testimony, exhibits and police reports were
presented to the License Committee, under oath, and taken
down by a l�censed court reporter, from Joseph F. Carchedi,
License Inspector; Sgt. James Feckey, Officer Charles Anderson,
Sgt. Mark Jessen, Officer Joseph Fehr, Officer James Lundholm,
all of the Saint Paul Police Department; as well as certified
copies of the convictions of Lucy Alvarez Odenbreit and Annetta
Kuehnel; copies of police reports made by the above officers,
together with the reports of Officer Gerald Brown, Officer
A. Johnson, Officers Singer and Bonsack, all of the Saint Paul
Police Departmen t; and the minutes of the License Committee
hearing August 11, 1976, at which the application of James P.
LaBosco for a "conversation parlor" license was denied after
an evidentiary hearing before the License Committee; and

WHEREAS, the evidence received established to the clear
satisfaction of the Committee that the licensee had permitted
female employees over a long period of time to engage in and
solicit ma.le customers for acts of prostitution for money,
that these activities had in recent month5 increased rather than
decreased; that the licensee has omitted to respond completely
and truthfully to the questions in the motion pictu�e theatre
license application, that in particular the licensee failed to
disclose that imcnediately prior to opening the establishment
at �a89 W. Seventh Street he had been the ma.nager of a sauna-
massage parlor in Rochester, Minnesota, which had its license
revoked for misconduct in the operation, that he had personally
applied for a sauna-ma.ssage parlor in Rochester which had been
denied on the basis of his involvement with it as manager;
that the 1'icensee assaulted and was engaged in dzsorderly con-
duct involving persons picketing the establishment in April of
1976; , that the licensee did not testify truthfully regarding
his involvement and actions in; that incident when testifying
under oath before the License Coaa�nittee on August 11, 1976;
- � that on the instructions of the licensee, police officers were
refused admission to the premises during business hours, con-
trary to ordinance; that undercover officers of the Saint Paul
Police Department were solicited to engage in ttnlawful sexual
actions by female employees on April 21, December 9, December
15 and December 16, 1976; that on September 18, 1976 and November
8, 1976, officers either observed or were participants in sit-
uations corroborating the inference that unlawful sexual activity
was carried on in the licensed premises with the knowledge and
consent of the licensee; and
WHEREAS, it was the conclusion of the License Committee
that the above evidence clearly and overwhelmingly established
the truth of the allegation of the License Inspector as to
each ground; and that the operations of the licensed establish-
ment constituted a continuing clear and present danger to the
health, safety, welfare and morals of the legitima.te patrons
of the establishment and the citizens of the City of Saint Paul;
and that the lack of integrity and responsibility of the li-
censee to follow and observe the requirements of the 1aw was
clearly established; and that the licensee knew and condoned
the illicit sexual activity carried on in the licensed premises;

WHEREAS, the License Committee voted unanimously by a
vote of 2-0 to recommend that the City Council revoke the
motion picture theatre license held by James P. LaBosco; and
WHEREAS, a copy of this Resolution as proposed by the
License Committee has been ma.iled to the licensee at his
licensed premises; now, therefore, be it
RESOLVED, that the Motion Picture Theatre License held
by the licensee is hereby revoked.
