WHEREAS, City Council Resolution No . 268203 was adopted by
the City Council on December 7 , 1976, and published in the official
newspaper of the City of Saint Paul on December 18 , 1976, the said
resolution vacating portions of Sixth Street and Neill Street; and
WHEREAS, Section 228 . 05 (e) of the St . Paul Legislative Code
provides that unless all of the terms and conditions contained
in resolutions vacating public streets be complied with within
thirty (30) days from the publication of the vacation resolution,
the said vacation shall be null and void provided, however, that
the City Council may by five affirmative votes adopt an amendment
to the vacation resolution prior to the expiration of the said
30-day period so as to extend the time for compliance of the said
terms and conditions for an additional period of thirty (30) days ;
and
WHEREAS, The Council has received a rec{uest to extend the
time for compliance for an additional 30-day period for reasons
including the fact that a lawsuit has been commenced questioning
the legality of the Council 's vacation of portions of Sixth and
Neill Street; now, therefore, be it
RESOLVED, That upon the request of petitioner, Union Gospel
Mission, and in accordance with Section 228 . 05(e) , vacation of
street Resolution C. F. No . 268203 vacating portions of Sixth
and Neill Street be and the same is hereby amended so as to
extend the time for compliance with the terms and conditions
contained in said vacation of street resolution for an additional
30-day period.

Saint Paul, request is respectfully made that the City Council
of the City of Saint Paul extend for a period of thirty days the
time within which the Mission may file its acceptance and other
requirements in respect of vacation of streets authorized by the
City Council by R.esolution 268203 adopted 7 December 1976,
approved by the Mayor 10 December 1976 and published on 18
December 1976, all pursuant to Chapter 228 of the Saint Paul
Legislative Code of the City of Saint Paul.
