WHEREAS, pursuant to resolution, C. F. No. 269175, approved June 3, 1977, a public hearing was duly held on �.ine 9, 1977 before the Council of the City of Saint Paul, said hearing pertaining to the condition of the structure located at 1037 Dayton Avenue, Saint Paul, Minnesota; and WHEREAS, upon the facts presented at the said hearing consisting of photographs, inspection reports and the reeommendations of the Building Department, it is found and determined by the City Cbuncil that. according to the records and files in the office of the Register of Deeds the last record owners of the above described property are Philip Rosenbloom and Frieda Rosenbloom, 1888 Ford Parkway, St. Paul, Minnesota, 55116; and that Fred Grothen, 61 Cambridge St„ St. Paul, Minnesota, 55105 is a holder of interest; and that lien holders of interest are the Board of Water Commissioners, City of St. Paul, Minnesota, and W. T. Opitz, 1583 East Hoyt Avenue, St. Paul, Minnesota; and that it is further determined that the above described building constitutes a hazardous building within the definition of Minnesota Statutes Section 463.15 for the following reasons: �. The conditions outlined above constitute a public hazarc7. . c. The owners have made no attempt to satisfactorily repair the damage; d. The continued vacant and boarded up condition contributes a blighting influence on the neighborhood; now, therefore, be it RESOLVED, That in accordance with Minnesota Statutes Sections 463.15 through 463.26, and based upon the foregoing findings of the City Council, the Council of the City of Saint Paul does hereby make the follownng Order; ORDER 1. The owners of t3�e above described building shall mal� the same safe and not detrimental to the public peace, health, safety and welfare by having the said building razed and the materials there- from removed from the premises within thirty (30) days from the date of the service of this Order; 2 . In the event that the building is to be razed by the City of Saint Paul pursuant to judgment of the District Court, all personal property or fixtures of any kind which may unreasonably interfere with the razing and removal of this building shall be removed within ten (10) days from the �ntry of judgment; and if not so removed, the City of Saint Paul shall remove and dispose of such personal property and fixtures as provided by law; 4. The legal description of the property is: Lot 17, Block 1, Roger's Addn. The subject property has been baarded by the city on January 5, 1976, Janu- ary 19 , 1976, April 22, 1976, April 6, 1977, April 29 , 1977 and May 23 , 1977. This building because of age, deterioration, fire damage, vandalism and lack of proper maintenance should be condemned and removed as soon as possible. Inasmuch as the conditions outlined above aonstitute a pubTic hazard and the owner has made no attempt to satisfactorily repair the damage despite our warnings, and the continued vacant and boarded up condition contributes a blighting influence on the neighborhood, it is the recomanendation of this Division that this matter be referred to the City Attorney's office for razi and removal through District Court proceedings.
