Westphal 2073 Margaret Street Dear Ms. Mix: On June 23, 1977 your office received letter from the Ramsey County Department of Property Taxation submitting a petition for abatement of tree trimming assessment sub- mitted by Ben F. Westphal. This matter was referred to the Forestry section of the Department of Community Services, and a copy of their information and report is submitted for your files. According to the Forestry section, there are 10 trees located on Margaret Street between Ruth and Winthrop, and these trees were trimmed on February 18, 1975. r�ir. Westphal' s petition states that there are no trees within two blocks of his property. It is this statement of Mr. Westphal' s which is in dispute. Based upon the report of the Forestry section, it would appear that the Council was correct in determining that Mr. Westphal' s property was benefited by the tree trimming. Ware's Eastern Heights Acre Lots and, WHEREAS, assessment levied was invalid in that there are no trees situated on said property, NOW, THEREFORE, be it resolved that the application made to abate such assessment is hereby granted and the Department of Property Taxation is hereby requested to cancel said assessment from the tax rolls.
