Grantee shall proride for the prevention and conh�ol of soil erosion within the right-of-way, as required by the Grantor, that might be affected by oonstruction, operation, or maintenance of the road or trail arni ahall plant and raaintain vegetation of aut- abk speciea on all earth cut or fill alopea feasible for revegetation or on other area where giound cover is destroyed, provided that it be mutually determi�ud by the Commiseioner of Natural Resources and an authorized repreaentative of the Grantee prior to completion of conshuction, that such stepe are mcessary and the Grantee ahall maintain all terracing, water bara, lead-off ditches, culverts r+�here mcessary, and other pteventive worka that may be required to accomplieh such aereed objectives 9. Grantee shall establiah np borrow, sand, or gravel pita, stone quarry or permanent storagc areas, sitea for road operationa and maintenance facilities, camps, aupply depots or diaposal area within rightof-way, except with the prior written approral of the Grantor. 10. Graatee may maintain the sight-of-way clearing by means of chemicals upon approvaR in writing by the Grantor. 1!. Grantor hereby reserves for ita own use, all the iron, coal, gold and other valuabk minerals, and all water power, and all oila and gasea, upon all lande covered by this easement, and the right to enter upon aame for the purposea of exploration and mining same. After thirty yeara from the,date of execution of.this agreement, the Grantor, its leaecea, or asaignees may mine any or all of the Ianda covered by this eaeement, and construct all necessary roads, bu�ldinga and improvements relating to mining, without payment of any damages to the Grantee. The easement and rightof-way herein conveyed may be ternrinated either by mutual agreement of the partiea hereto, or by the Grantor upon thirty daya wrItten notice to the Grantee if Grantee fails to comply with applicable lawe or the terms of this easa ment;otherwise to remain in effect as long as used for the purposes granted, provided, however, if the easement and right-of-way or any part thereof ehall be abandoned or ishall cease to be uaed by the Grantee for a period of one year, the rights and privilegea hereby gianted shall cease and terminate and the land traversed by the abandoned or unuaed segment shall be freed from thia easement and right-of-way. In the evecrt of such agreement to terminate or abandon, the Grantee, by authorized representative, shall fumish to the Grantor, a statement in recordabk form evidencing termination.
