WHEREAS, questions have been raised as to the validity
of signatures on a rezoning petition for property located at
the Southwest corner of I-94 and White Bear Avenue; and
WHEREAS, the City Attorney has recommended to the Council
that these questions be resolved by a hearing prior to the
hearing on the petition to rezone the property; and
WHEREAS, the Council, upon the recommendation of the
City Attorney, has determined tha.t the matter of the validity
of the petition would best be heard by an independent hearing
examiner who would make a recommendation in writing to the
Council; and
WHEREAS, this is a special circumstance which is con-
templated under Chapter S of the Charter of the City of St.
Paul; now, therefore, be it
RESOLVED, that upon the-request of the Ci���Attorney .�hat
a representative from the State Office of Hearing Examiners
is appointed as special counsel to hear this ma.tter and that
compensation shall be at the rate of $35.00 per hour
