Hunter SUBJECT: Rec{uest waiver of St. Paul Legislative Code, Section 54. 13, pertaining to basement occupancy for one unit more than 50% below grade , because larger windows have been ins-t�a1<Ied to imp�ove light and ventila- tion and can be used as emergency exit . APPEARANCE : John C. Hunter PROCEEDINGS : Mr. Hunter said he had renovat�d� this apartment building, but one unit was more than 50% below grade and he had been advised by the city inspector to appeal for a variance . Alice Bijjani said she had made the inspection and had found that new, larger windows had been installed, with large windaw-wells outside them which made them suitable for use as an emergency exit. She said the basement unit was very nice and that her dep artmen t would not object to a variance being granted. BOARD ACTION: Mr. Coleman moved that a variance of St. Paul Legislative Code , Section, 54 . 13, pertaining to basement occupancy, be granted. Mr. Heider seconded. MOTION CARRIED AND SO ORDERED. Mayers (7 units) SUBJECT: Request waiver of St. Paul Legislative Code , Section 54. 13, pertai ng �to b asement occupancy of one unit , because income is needed to make operation of building feasible. APPEAR.ANCE : A1 M. Mayers PROCEEDINGS : Alice Bijjani , of the Housing Code Enforcement office , related that. bir. Mayers had agreed to do all the work reQuired by the city, hut there was one unit which was more than 50a below grade , thus rec{uiring a waiver from the Board. She said Mr. Mayers had installed larger windows to provide sufficient light and ventilation in the unit , and they were easily accessible for use as an emergency exit. He had also installed mechanical ventilation in the bathroom. The city would not object to granting of a waiver for basement occupancy. There was one thing Mr. Mayers had done in an attempt to adjust the grade level; he had excavated a one-foot wide, three-foot deep area around the foundation, which she felt should be filled in. Nir. Mayers replied tha� he had understood the inspector to say that this would correct the grade level problem. Ms . Bijjani said this was an error, excavating a distance of one foot out from the building did not constitute a change in grade. Acting Chairman Tieso stated that, as he understood it, Mr. Mayers would complete all the work items listed on pages 2 and 3 of the May 2 , 1977 , Survey Letter. BOARD ACTION: Mr. Glassman moved to grant a variance of St. Paul Legislative Cod.e, Section 54 . 13, pertaining to basement occupancy, provided the excavated area around the building foundation be filled in and aIl items remaining on the list in the Survey Letter of 5/2/77 be campleted in a manner satis- factory to the St. Paul Code Enforcement Divisien.
