1 WHEREAS,the City Council requested that a request for proposals(RFP)be issued to qualified law firms which
2 provide bond counsel and related public finance services; and
3 WHEREAS,the intent of the Council in directing a request for proposals was to increase competition among firms
4 that provide these services and bring a savings to taxpayers; and
5 WHEREAS, under Section 5.02 of the City Charter, the City Attorney has requested the appointrnent of special
6 counsel to provide bond counsel and related services to the City.
7 NOW, THEREFORE, BE IT RESOLVED BY THE SAINT PAUL CITY COUNCIL:
8 Principal bond counsel for the City will be selected from the following firms:
9 (1) Briggs and Morgan;

11 (3) Leonard Street&Deinard �- "•s�"-� s �v�v i`e s ,
12 Appropriate City offi e authorized to execute agreements with firms on the above panel for specific
13 bond issuances. Membership of the panel will be for three (3) years, at which time the City will issue
14 another RFP for services. Membership on the panel may be subject to cancellation by either the City
15 Council or the law firm. The amount to be paid for such services shall be no greater than$150 per hour for
16 advisory services and no greater than$160 per hour for arbitrage and rebate services. The fee for individual
17 bond issues shall be determined in accordance with Minn. Stat. §481.21 (1994).

The City Council requested that a Request for Proposals be issued to qualified
bond counsel law firms. The RFP was issued in January, 1996. Eiqht law firms
responded. The responses were reviewed by a staff team appointed by the City
Attorney which served as the basis for the City Attorney's recommendation. In
accordance with Section 5.02 of the Charter, it is the responsibility of the
City Attorney to make recommendations on special counsel to be used by the Cit .

14 City, and appropriate City officers are authorized execute an agreement with Briggs and
15 Morgan for such services. The term of the agree ent may be for three years and may be
16 automatically renewed subject to earlier cancel tion or notice of non-renewal by either party.
17 The amount to be paid for such services shal e no greater than $150 per hour for advisory
18 services and no greater than $160 per hour r arbitrage and rebate services. The fee for
19 individual bond issues shall be determine n accordance with Minn. Stat. §481.21 (1994).
