1 WHEREAS, the State of Miuuesota Department of Natural Resources through its
2 Outdoor Recreation Grant Program has made funding available to assist local governments in
3 acquiiing pazktand and developing or redeveloping outdoor recreation faciliries; and
4 WHEREAS, the City of Saint Paul is an eligible applicant and desires to submit an
5 Outdoor Recreation Grant Program application to the Department of Natural Resources in the
6 amount of $308,000 for the Highland Pazk Picnic Area Renovation project; and
7 WHEREAS, the City of Saint Paul, Division of Parks and Recreation owns the property
8 on which the Highland Park Picnic Area located; and
9 WHEREAS, the Highland Park Picnic Area is heauily used by groups (136 groups
l0 pemuts in 2000, over 25,000 attendees) and informal picnickers alike; and
11 WHEREAS, the Highland Pazk Picnic Area has not been renovated for more than 30
12 yeazs; and
13 WIIEREAS, the Highland Pazk Picnic Area will greafly benefit from the completion of
14 renovation efforts which include new tables and grills, walkways, parking, lighting, play area,
15 landscaping and fencing; and
16 WHEREAS, the City of Saint Paul has the legal authority to apply for fmancial
17 assistance, and the institutional, managerial, and financial capability to ensure adequate
i8 conshuction, operation, maintenance and replacement of the proposed project for its design life;
19 and
2 0 WIIEREAS, the City of Saint Paul has not incurred any costs or entered into any written
21 agreements to purchase property related to the above-referenced project; and
2 2 WIIEREAS, the City of Saint Paul has not violated any Federal, State or Local laws
23 pertaining to fraud, bribery, graft, kickbacks, collusion, conflict of interest or other unlawfiil or
24 corrupt practice; and
25 WFIEREAS, upon approval of its application by the State, the City of Saint Paul may
2 6 enter into an agreement with the State of Minnesota for the above-referenced proj ect, and the
2 7 City of Saint Paul certifies that it will comply with a11 applicable laws and regulations stated in
2 8 the contract agreement and described in the Compliance section of the Outdoor Recreation Grant
29 Programapplication;

3 o NOW, TAEEREFORE, BE IT RESOLVED, that the City of Saint Paul act as legal
31 sponsor for the Highiand Pazk Picnic Area Renovation project contained in the Outdoar
3 2 Recreation Grant Application to be submitted on Mazch 31, 2001 and that the Mayor and proper
3 3 City officials aze hereby authorized to apply to the Department of Natural Resowces for funding
34 of this project in the amount of $308,000 on behalf of the City of Saint Paul; and

BE IT FINALLY RESOLVED, that the Mayor and proper officials of the City of Saint
Paul aze hereby authorized to execute such agreements as are necessary to implement the project
on behalf of the City.
