� WHEREAS, the Council approved CF# 257771 on March 21, 1972, CF# 260898 on March 28,
2 1973 and CF# 277782 on December 8, 1981 to vacate, while retaining all urility easements in
s that part of Nevada Avenue lying west of Arkwright Street and east of Weshninster Street; and

s WHEREAS, document number 1875597, filed in the office of the Registrar of Deeds for
6 Ramsey County on January 24, 1974, reserved a perpetual easement over the center 24 feet of
� vacated Nevada Avenue from the East line of Westminster to the West line of Arkwright Street
s for access as a fire lane for emergency vehicles; and

�o WHEREAS, document number 1642877, filed in the office of the Registrar of Deeds for
�� Ramsey County on March 9, 1965, dedicated to the City of Saint Paul an easement for the
�2 purpose of constructing and maintaining a public sewer on, under and across the westerly 30 feet
�s of Lots 12 and 27, Block 8, Morton's Addition, and an easement for construction purposes only
�a on the east 10 feet of Lots 11 and 28 and the east 10 feet of Lots 12 and 27, and the west 10 feet
�s of Lots 13 and 26, Block 8, Morton's Addition; and

�� WHEREAS, the purpose of the said easements for "construction and maintenance" and for
�s "construction only" was to allow construction and maintenance of a public sewer, not by the
�9 City of Saint Paul but by the Metropolitan Waste Control Commission; and

a� WHEREAS, the developer of Blocks 5 and 8, Morton's Addition has constructed buildings that
�2 encroach on the easements in vacated Nevada Avenue and the "consh-uction only" easements in
z3 Block 8, Morton's Addition; and

zs WHEREAS, the present owner of Blocks 5 and 8, Morton's Addition has requested the release
a6 of those easements in vacated Nevada Avenue and Block 8, Morton's Addition that the said
a� buildings encroach upon; and

�9 WHEREAS, the Department of Fire and Safety of the City of Saint Paul has agreed to release
3o that part of the emergency access easement lying westerly of a line 450.00 feet westerly of and
s� parallel to the said West Line of Arkwright Street; and

33 WHEREAS, the Metropolitan Council, as successor to the Metropolitan Waste Control
34 Commission, has concurred with the recommendation by the Department of Public Works of the
ss City of Saint Paul to release the "construction only" easements in Block 8, Morton's Addition,
36 and has requested that ownership of the "construction and maintenance" easement in the said
s� Block 8, Morton's Addition be transferred by quit claim deed to the Metropolitan Council; and

� WHEREAS, the Department of Public Works has agreed to transfer the "construction and
2 maintenance" easement to the Metropolitan Council;

a THEREFORE BE IT RESOLVED, that, with the accompanying Certificate of Intended Non-
s Use filed voluntarily by the Department of Fire and Safety, for itself and on behalf of the
6 Metropolitan Council, the City does hereby waive the right to that part of the permanent
� emergency access easement in vacated Nevada Avenue lying westerly of a line 450.00 feet
s westerly of and parallel to the West Line of Arkwright Street and easterly of the East Line of
9 Westminster Street;

�� BE IT FURTHER RESOLVED, that, with the accompanying Certificate of Intended Non-Use
�2 filed voluntarily by the Department of Public Works on behalf of the Metropolitan Council, the
�s City, for itself and on behalf of the Metropolitan Council does hereby waive the right to the
�a "construction only" easements on the east 10 feet of Lots 11 and 28 and the east 10 feet of Lots
�s 12 and 27, and the west 10 feet of Lots 13 and 26, Block 8, Morton's Addition.

�s directed to convey to the Metropolitan Council, by quit claim deed, the easement for the purpose

Dear Mr. Carlson:
As a follow-up to your conversation with Carol Johnson of the Metropolitan Council's staff, the
Metropolitan Council has no interest in the temporary construction easement owned by the City

operate a sanitary sewer within the permanent easement on that property. It is my understanding
that you have agreed to transfer those easement rights to the Metropolitan Council at the same

RE: Release of Construction Easements in Block 8, Morton's Add.
A review of the above referenced request has been completed.
The Department of Public Works has no objections to releasing the temporary
construction easements, per document #1642877, across the following described
property:
The east 10 feet of Lots 11 and 28 and the east 10 feet of
Lots 12 and 27, Block 8, and the west 10 feet of Lots 13 and 26,
Block 8, Morton's Addition to the City of Saint Paul.
In addition, the Department of Public Works is in favor of transferring the sewer
easement referenced in document #1642877 to the Metropolitan Council (MWCS)
since it is their sewer, not ours. See attached sewer records. The permanent sewer
easement to be transferred is across the following described property:
The westerly 30 feet of Lots 12 and 27, and the vacated alley
adjacent, Block 8, Morton's Addition.
If a certificate releasing our utility rights needs to be signed please forward the
necessary document(s).
