96-1091 Council File # /lV � 7 f Green Sheet # RE ION F T PAUL, MINNESOTA Presented By Referred to Committee: Date 1 WHEREAS, the Divisio arks & Recreation is hosting the Minnesota Orchestra concert 2 on Harriet Island on Saturday, September 7, 1996 and anticipates a crowd in excess of 3 seven thousand (7,000) people; and 4 5 WHEREAS, parking on Harriet Island is very limited so we must look to neighborhood 6 streets and parking lots to accommodate the number of spectators expected; and 7 8 WHEREAS, the following private business have agreed, at no expense to the City, to 9 allow the use of their private parking lots for concert attendees: 10 Health Partners, 205 S. Wabasha Street, Saint Paul, MN 55107 11 Gross-Givens Manufacturing, 75 W. Plato Blvd, Saint Paul, MN 55107 12 All, Inc. 185 W. Plato Blvd, Saint Paul, MN 55107 13 Tursso Companies, 223 E. Plato Blvd. , Saint Paul, MN 55107 14 Crepeau Graphics, 120 W. Plato Blvd, Saint Paul, MN 55107 15 16 WHEREAS, the promise of indemnification and defense for such a purpose will facilitate 17 sufficient parking for this event and enable it to take place; now therefore, be it 18 19 RESOLVED, that the Council of the City of Saint Paul on behalf of the City of Saint 2 0 Paul hereby agrees to defend, indemnify and hold the above mentioned organizations 2 1 harmless from any and all damages it may be required to pay as a result of suits, 22 claims, actions or judgments arising out of activities connected with the Minnesota 23 Orchestra concert for or on account of any injuries or damages received or sustained by 24 any party, parties, or property by reason of any act of negligence or omission of said 25 City, its contractors, agents or employees; and be it 26 2 7 FURTHER RESOLVED, that the foregoing defense and indemnification does not cover any 28 damages in excess of the City's liability limits as set forth in Minn. Stat. 29 §466.04 (1994) .
